PLANNING BOARD MINUTES 9' lUr` I AN 13 33
June 4, 1997
'A< O IE D
Present% Thomas French, Chairman; John Sullivan, Clerk; Bernie DMad MAM Vd&E T TS
Flynn; Thomas McShane and Kenneth Torman.
Meeting called to order at 7:40 p.m.
1. Letter from Roy MacDonald requesting a two -year extension of the Classic Court
Residential Compound Special Permit. Mr. MacDonald advised the Board
that there has been a street cut moratorium on Mill Street due to its repaving
within the last five years and that he would not be able to cut into it for a
water connection until the spring or summer of 1998. He requested a two -year
extension in case it became too late in the season next year to complete the
connection and repave.
Motion: To grant a two -year extension to the Classic Court Residential
Compound Special Permit to May 1, 1999, finding that there was
just cause to extend it due to the street cut moratorium.
(Dolan - Torman) 6 -0 PASSES
The Board also requested that a list of repaved roads, showing the expiration date
of the moratorium for each, be obtained from Dan Clifford, DPW Director.
Richard Devine of Morgan Road was present to thank the Planning Board for the
assistance they provided with his Scheduled Development Zoning By -law which was
approved at Town Meeting. He advised the Board that he felt the amendments they had
made to it made the By -law stronger and helped to get it passed. He also requested that
the Board send a letter explaining the Scheduled Development By -law to the Attorney
General.
The Clerk read the Public Hearing notice which
on May
21, 1997 and May 28, 1997. Correspondence in support of the proposed subdivision was
read from the following individuals:
Laura A. Woodward, Peter DeTrolio, Jr., Diana L. Mahana, and Robert W. Jewett
Also read was a letter in opposition from Judith A. Ferguson.
Attorney Edward W. Valanzola, representing Charles and LeAnn Campbell, explained
that the applicants have already acquired a variance for the frontage and that they are
looking for a waiver from the subdivision frontage requirement and a waiver of the
subdivision filing fees since the plan presented is not a typical subdivision plan. He
reviewed the plan with the Board, pointing out that the applicants are requesting to create
a 200,000 sq. ft. lot on which to build one single - family house. He stated that the lot will
have 116 feet of frontage, which is only 4 feet short of the frontage required as recently as
1989. Also noted was the fact the total parcel being divided is large enough to
accommodate a road and subdivision and that creating only one lot with a single- family
house on it is better for the Town and the neighborhood.
Speaking in support of the proposed subdivision were Ann Marie Mahana of 90 Oak
Street, Rens Hayes of 125 Oak Street, and Al Slaney, father of LeAnn Campbell and a
direct abutter to the property.
Motion: To close the Public Hearing at 8:45 p.m.
(Torman - McShane)
Motion: To approve the subdivision plan prepared by David E. Grant dated April 25,
1997, with the waivers noted on the plan.
(Sullivan - Flynn)' 6 -0 PASSES
Motion: To reduce the filing fee to the fee that would be required for an ANR plan, since
this plan does not require the usual review and detail of a subdivision
plan, and that the applicant be responsible for the costs of advertising and
notification of abutters.
(Sullivan - Dolan) 6 -0 PASSES
Mayhew Farms` Public Hearing continuation
The continued Public Hearing for Mayhew Farms was opened at 8:50 p.m. Robert
Colleran was present to request that the hearing be continued to allow the Town Engineer
additional time to review the changes recently made.
Motion: To continue the Public Hearing to June 18, 1997 at 8:30 p.m., with
final action no later than July 2, 1997.

2. ZBA Application of Chrysler Motors Corporation for a variance from Section
4.7.2.2 of the Zoning By -law for a wall sign to replace their existing sign on the
side of the building which faces Route 495 instead of placing it on the front of the
building. Mr. Burke, in a memorandum to the Board, suggested a positive
recommendation be sent to the ZBA since granting the variance would not be
detrimental and would not seriously derogate from the intent of the Zoning By-
law.
Motion: To send a positive recommendation to the ZBA for the reasons stated.
(Flynn- McShane) 6 -0 PASSES
3. Letter from Stephen Benoit requesting permission to install an 8 -inch water line
from Canoe River Estates, through two lots on a proposed subdivision, and out
to Ware Street. Board members noted that, as suggested by Mr. Burke, this is not
a matter for Planning Board approval. However, the path of the requested
installation falls within a subdivision which has not been approved.
Motion: To send a letter to the Water Department pointing out that a
portion of the proposed route of installation which goes
between two specific lots does not fall on any subdivision
plan which has been approved and that any connection done
in this manner would be at the applicant's own risk and that
the request should be denied.

Board members offered various comments on Town Meeting and discussed sending a
letter to the newspaper thanking the citizens for attending. It was suggested that when the
Scheduled Development by -law is sent to the Attorney General's office for review, it
should be noted that the by -law had the support of the Planning Board, Finance
Committee, Conservation Committee and School Committee.
Mr. McShane inquired as to whether the Williams Street bridge reconstruction was
covered by the Scenic Road Act and asked for a status report on the bridge
reconstruction.
Mr. McShane also asked for an update on the total number of building permits issued this
year.
Mr. Sullivan asked if we have received a reply from Mr. Clifford regarding the amount in
the Sidewalk Fund and a list of priority areas. He also noted that the Board needs to
review Subdivision Regulations with respect to drainage. He asked that a copy of the
