PLANNING BOARD MINUTES 97 JILIN _b D 8:15
May 21, 1997
Present% John Sullivan, Clerk; Bernie Dolan; Marydee Flynn; Duane Fre00fij9l9JTb0 rtgK j' T S
McShane and Kenneth Torman. Also present was Shaun P. Burke, Director of Planning
and Development.
Meeting called to order at 7:35 p.m.
Mr. Dolan volunteered to be acting chairman in the absence of Mr. French.
1. Letter from Bob MacLacklin and RIM Engineering reauesting permission to remove
25,000 cubic yards of excess material from Canterbury Estates during
construction. Mr. MacLacklin outlined the areas where material would be
removed, stating that the largest area would be from Colonial Drive, abutting
Pilgrim Road. He said they are already moving material on -site and that they
would like to move it off -site, using five to six trucks, each making six to seven
trips per day. He anticipated that it would take two to three weeks to do the
section at Colonial Drive and stated that he would like to be permitted to work
Monday through Saturday. Feeney Corporation has been hired to do the work and
he has talked to Police Chief O'Neill. Chief O'Neill said that Patrolman Lance
Lawson would be keeping an eye on the situation and that a police detail would be
required at the intersection of Steams Avenue and Route 106 if the trips are not
spaced properly. The excess material removed will not include topsoil or subsoil
and loam will be stockpiled to be used on other lots within the subdivision.
Dr. Torman said that he was concerned about traffic backing up on Route 106
during peak commuter hours with the trucks coming out of Stearns Avenue. Mr.
MacLacklin said that they would be working on -site during the morning commute
and that work would be stopped prior to the evening commute. Mr. Burke said
a greater concern would be for the drivers of the truc'a: trying to get out onto
Route 106. Mr. Dolan said he would like to get something from the Police
Chief saying they don't require an officer and that they will monitor traffic to be
sure there is no problem.
Motion: To approve the excess material permit, subject to review and
verification by Town Engineer of quantity of materials to be removed,
and to send a letter to the Police Chief expressing concern for the
safety of residents of the area and requesting a written response from
him regarding how the situation will be handled. Also, that excess
material is not to include topsoil or subsoil and that it be stockpiled on
Lots 130 -131 for future use on the lots on Plantation Road. Further,
that work hours be limited to 7:30 a.m. to 4:30 p.m. Monday through
Friday; that loaded vehicles be suitably covered; that Carriage House
Lane, Old Stable Drive, and Stearns Avenue be maintained free
of mud and stones and that sweeping be completed daily or as
necessary; stockpiled material shall be stored in a manner to present no
hazard to the public and shall be covered or stablized to prevent airborne
dust and silt from leaving the site; that the neighbors be notified in writing
prior to commencement of work, and that the notification include a phone
number and contact person to be called with any questions or concerns.
(Flynn- Sullivan) 5 -0 -1 with McShane abstaining. PASSES
The continued Public Hearing for Mayhew Farms was opened at 8:15 p.m.
Motion: To adjourn the Public Hearing until such time as the board
returns from the Board of Selectmen meeting, expected to be
ten to fifteen minutes.
(Sullivan- Frederick) 6 -0 PASSES
Board members met with the Board of Selectmen regarding the Great Woods joint grant
application with the Town of Norton. Mr. McShane represented the board, explaining
that the Planning Board declined to participate in the joint grant application due to the
lack of time given to review the application prior to the deadline and because board
members felt it would be better to first meet with the Selectmen and the Norton Planning
Board to find common goals on which to base a joint grant application. The application
the Planning Board was asked to support favored development of the Great Woods,
which the Planning Board felt was contrary to the goals expressed by the Town of
Mansfield for the Great Woods. The Board of Selectmen noted that they supported the
joint grant application mainly because they felt it would be better to be a part of it and
know what was going on. The discussion concluded with the Planning Board stating that
they look forward to meeting with the Norton Planning Board and beginning a dialogue
to develop common goals.
The hearing re- convened, with Mr. Sullivan reading the following correspondence:
• Memo from Dan Clifford, DPW Director, dated May 21, 1997 regarding the opening
of School Street
• Memo from Lee Azinheira, Town Engineer, dated May 21, 1997 regarding drainage
analysis
• Memo from Dan Clifford as Tree Warden, dated April 15, 1997 regarding permission
granted for tree removal necessary for sight distance requirements
• Letter from Ralph Maloon to the Town Engineer dated April 9, 1997 regarding
revisions to the Drainage Study and Plans
The board discussed at length the revisions to the drainage plan with particular attention
being given to the location and size of the Swale which was moved to go around the big
hemlocks. Board members expressed further concern about damage occurring to the root
system of the hemlocks with the swale going between them. Mr. Sullivan noted that with
the drainage calculations meshed together, he was not able to determine how much water
used to go in one direction and now goes in the other. Board members felt the Swale
needed revision to allow for greater infiltration.
The cast -in -place three -sided box culvert also came under scrutiny. John Schrom, an
abutter, stated that it should be a monolithic pour. He stated he did not believe a ten foot
culvert was going to hold a forty foot spread. He also said he is concerned about the
stream being studied as an "intermittent" stream. Mrs. Flynn agreed that the stream is
there all the time. Mr. Culleran said they would be going to Conservation Commission
next week.
Mr. McShane pointed out that in granting a special permit, the Planning Board should be
getting some benefit for the Town and he is not sure that there are benefits of the plan that
outweigh the detriments. Mr. Culleran pointed out that he would be deeding the open
space land to the residents to provide them with better buffers, that the cluster design
creates better looking, better shaped lots. Mr. Dolan asked how he plans to handle the
open space land. He responded that after talking with Shirley MacPhee in the Assessors
Office, he is planning to divide the open space land by six and deed a portion to each lot.
Mr. McShane responded that in the case of another recent special permit cluster, the
developer deeded the land to the Town for conservation and that he fails to see what net
benefit this offers as a cluster.
Mr. Sullivan noted that during preliminary review it was stated that going with a cluster
development would require less pavement, resulting in less runoff. Mr. McShane
responded that this does not result in less impact on municipal services or the natural
environment, which are the things he believes the board should be looking for in
exchange for granting a special permit. Mr. Culleran said that with a conventional
subdivision he could do more clearing, and that the cluster preserves more trees. Mr.
Dolan remarked that the issues being raised - -sight distance, safety and others - -still exist
whether its a special permit cluster or a conventional subdivision, and that with a
conventional subdivision, more area is being disturbed.
Mrs. Flynn asked if the board can stipulate that the open space land will be given to
a homeowners' association. She stated that this has been discussed previously and that
she is disappointed that the applicant did not come in with a document stating how this
will be handled.
Board members requested the following information be available for review prior to the
next meeting on June 4, 1997:
1. Certification from a professional engineer that the culvert is adequate for a 100 year
storm event based of observations
2. Would like Ralph Maloon to do a new study on the flood elevations
3. Need structural engineer to submit stamped calculations for design of culvert for its
ability to take the load
4. Draft of open space document
5. Draft of association covenant
6. Answers about how plowing will be handled
7. Information regarding if the open space land will be left in a natural state and what
restrictions homeowners will have
8. New drawings of Swale showing how deep, how wide -- particularly in the area around
the trees - -with a cross section every fifty feet
9. Information from Ralph Maloon on how he intends to hold water in the Swale long
enough for it to infiltrate, adding stones every fifty feet if he has no other ideas
10. Add a note to the lot layout sheet No. 4 referring to roof drainage
11. Perimeter clearing easement showing on land for trees that have to be removed for
sight distance
12. Information from structural engineer on why he is not doing a monolithic pour
13. Building sites should be clearly marked on the plan
Discussion ended at 9:50 p.m.
Motion: To continue the hearing until June 4, 1997 at 8:30 p.m., with all
requested information to be submitted for review prior to that meeting.
(Sullivan - Torman) 6 -0 PASSES
1. Minutes of May 1, 1997.
Motion: To approve as submitted.
( Torman- Frederick) 5 -0 -1 with Mr. Sullivan abstaining. PASSES
2. Minutes of May 7, 1997.
Motion: To approve as submitted.
(Flynn- Sullivan) 6 -0 PASSES
3. Minutes of May 12, 1997. Mrs. Flynn said that on page 2, it shouldn't say we
"agreed" with the builders, but rather that it was "discussed" with the builders
and that in order to reach consensus, "compromises" were made.
Motion: To approve the minutes as amended.
(Sullivan- Frederick) 5 -0 -1 with McShane abstaining. PASSES
4. ZBA Application of Siobhan Fitzgerald for a Variance under Schedule 4.2.1 Lot
Area, and 1.5.17a, Lot Width, to build a single family home at 195 Essex Street
in an R -1 zone. Mr. Burke suggested that the Planning Board send a negative
recommendation to the ZBA since the lot being created is cut out of a parcel of
land the applicant's family already owns and that the current owner has 33 acres
of land and has the ability to reconfigure the lot to get at least one lot.
Motion: To send a negative recommendation to the ZBA because the applicant
has plenty of opportunity to reconfigure the parcel in a way that they
don't have to go for a variance and to send a letter to the applicant
advising him that Lot 2 can be made conforming.
(Dolan- McShane) 5 -0 -1 with Sullivan abstaining. PASSES
5. Public Hearing Notice - Foxboro ZBA
6. Public Hearing Notices (2) - Attleboro Planning Board
7. Conference announcement - "Getting Started on Downtown Revitalization"

13. Memo from Dan Clifford re: Sidewalks on Brook Street
Motion: To accept $2,500 to be put into the sidewalk fund and to request
that Mr. Clifford advise the Planning Board of the amount in the sidewalk
fund and a list of his priorities for future sidewalks.
(Sullivan - Flynn) 5 -1 with Flynn opposed. PASSES
14. ZBA Decision for John Scarpellini for lot area, frontage and lot width at 19 Clinton
Street in the R -2 Zone. Variance denied. Planning Board recommendation was
negative.
15. Six Town Aquifer Advisory Committee - Summary of May 8th meeting and mission
statement.
Mr. Frederick suggested that it would make sense, when we suggest to developers that
they come in with a cluster development, to discuss with them what it is the board would
like to see. Mrs. Flynn commented that it's all spelled out in the Zoning By -Law, but the
developers read a generic state by -law and don't understand that we expect to see a
benefit to the town. She said that the general attitude is becoming that you shouldn't
come in with a special permit request because the Planning Board makes you do too
many things and that they're better off coming in with a regular subdivision.
Mrs. Flynn asked if we have received a copy of a new proposal the builders have come up
with on the Scheduled Development by -law. She said that she has heard that the builders
are calling all their subcontractors and laborers to get them to attend Town Meeting.
Mr. Burke advised the board that he would be on vacation from May 22nd until June 2nd
and was not sure he would be in the area for Town Meeting on Tuesday night. Mrs.
Flynn said she would like to see him there; other board members felt as though they
could handle the presentation on their own. He agreed to attend if he was in the area.
Motion: To adjourn at 11:15 p.m.
