2. Discussion of Article 23
Motion: To reconsider vote of September 4, 1996 on Article 23.
(Flynn- McShane) All in favor. PASSES
Mr. Burke introduced four variations of the proposed amendments to Article 23,
Section 4.2.3.3 Building Permit Limitations and an amendment to Section 4.2.3.4
Building Permit Standards which added the words, "or building permit
applications" to the first sentence. After discussing the four variations of the
Section 4.2.3.3 amendment, the Board felt that version #4 "...115 permits, of
which 15 shall be reserved for owners of single lots not shown on an approved
definitive subdivision plan." most clearly expressed their intent.
Motion: To amend Article 23, Section 4.2.3.3 from the floor with proposal #4.
(McShane - Dolan) All in favor. PASSES
Discussion continued on the proposed amendment to Section 4.2.3.4. Board
members expressed their belief that the amendment was necessary and
their concern that it might kill the motion with a resulting loss of credibility.
Consideration was given to withdrawing the article and waiting until the Annual
Town Meeting and taking the time to do it right. However, since the Board of
Selectmen were the sponsors, that might not be possible. The board decided that
it was best to proceed and get something into the by -law with the possibility of
amending it at the Annual Town Meeting in the spring.
Motion: To amend Section 4.2.3.4 of Article 23 to add the words "...or
building permit applications." to the first sentence.
(MeShand- Flynn) All in favor. PASSES
Mr. Burke advised the board that the Town Moderator might not accept the
amendments as proposed because he has said that they substantially change
the article. The consensus of the board was to go forward and if the motions were
disallowed or failed to pass, to do some more work on them and bring them back
to the Annual Town Meeting.
Discussion of Articles 27 -30
These articles are for the acceptance of Oakland, Park, Reservoir and Spring
Streets which, although not new streets, have never been accepted by the Town.
Motion: To support Articles 27, 28, 29 and 30.
(Flynn - McShane) All in favor. PASSES
