Burke suggested the board could sign the plan, but may want to add a note regarding the other lot. which is also non - buildable. Acting Clerk Bonda noted the owner's name is not on the plan. Motion: To table the Form A discussion until the August 30, 1995 meeting to give the applicant time to have the notes added (Flynn- Trombetta) All m favor. PASSES 4. Public Hearing - Citizens' Petition to Rezone Garden Street -- Planner Bonda left the meeting at this point. Motion: To appoint Planner Dolan Acting Clerk "mi- Trombetta) All in favor. PASSES The clerk read the legal advertisement and citizens' petition. Edward Benson, Pleasant Street, said he had tried to buy Garden Street, which abuts his property, hi 1972. At the tine, it was a public way, so Ndr. Benson petitioned town meeting to abandon the street, which it did. He tried to buy it again in 1976, but could not. He said when the zoning in the neighborhood was changed, the zone line was run up the center of Garden Street, making one side of the street residential and the other business. Vir. Benson contends that is wrong, because as an abandoned street, the zone line should go down the western side of the street instead of down the middle. Mr. Benson said he did a title search and found he has an easement over the former Garden Street property, which he said is too small to be built on. lh% Benson's attorney has been in touch with Town Counsel Mangiaratti regarding the easement. He gave the board a letter from an abutter, William Richards, saying he had no objection to the rezoning. The clerk read it and a town meeting vote abandoning Garden Street into the record. Public Comment Nick Anagnos, Nick's Realty Trust, said he had always assumed the Bensons owned that parcel, but found it is town- owned. He said he would like to be able to use the parcel and is opposed to the rezoning petition because it would be more valuable as commercial property. He suggested leaning the zoning as is and each party buying half. NMrs. Benson said she wanted to separate their property from the business zone. Tom Alitley, Nick's Realty Trust, said it would be better for the town if it were left as is. Acting Chairman Sullivan asked what difference it would make if the property is left alone and the Bensoiis have an access easement over the whole thing. Mrs. Benson said she wanted the whole property zoned residential. Board Comment Planner Flynn asked how long the Bensons had maintained the parcel and was told 15 years. Planner Flymn added there is a lot of information with this issue and town counsel is needed before tine board can maize a recommendation to town tweeting. She said if the street had been abandoned, it was reasonable to trove the zonings line to connect with the existing one. Planner Dolan agreed the board should hear from Attorney iMangiaraui before making a recommendation. Motion: To close the public heating (Flynn- Dolan) All ht favor. PASSES Motion: To send the Board of Selectmen a letter saying the Planning Board needs additional information from Attorney Mangiaratti before making a recommendation to town meeting (Flynn- Dolan) All in favor. PASSES 5. Public Hearing Continued - Eastfield Village Planner Bonda returned to the meeting at this point. The clerk read a letter from the applicant requesting the public hearing be continued to October 11, 1995 and a copy, of a letter informing the abutters of the request. Acting Clerk Bonda was concerned the public hearing process had gone on too long. Acting Chairman Sullivan agreed. Planter Trombetta was concerned that if the public heating were closed, the abutters may, come to the nest meeting expecting to speak. Planner Bonda suggested making October 11 the last continuance. Acting Chapman Sullivan suggested requiring a written response to the Planting Board's punch list letter two weeks before the continued hearing, readvertisinng the public heating and renotifving the abutters. Motion: To continue the public heating to October 11, 1995 at 7:30 PAL with the Planning Board's final action date to November 11, 1995. Send \1r. Folkman a letter requiring he send a written response to the Planing ( Board's punch list letter by September 26, 1995 and inform him the board will not be receptive to further continuance requests from hum beyond October 11, 1995. Readvertise the public hearing and require Mr. Folkman to renotifv the abutters. (Dolan- Bonda) All in favor. PASSES 6. Site Phut Review - 120 Forbes Boulevard Matt Smith, Norwood Engineering, presented the plan for a 22,000 square foot addition to the existing 53,000 square foot building with parking on two sides. Mr. Smith said he had filed with the Conservation Commission. The proposed addition would add to the existing office and warehouse use, with new parking and a one- way driveway to improve fire and delivery access. NIr. Sinith said the water would be extended around the building and the sewer brought in from Forbes Boulevard. Drainage will be to a detention basin at the east end of the site with catch basins into an oil, water separator, then into another detention basin, then out. Mr. Smith said there was not enough elevation to put a catch basin at the new driveway, so he designed it stilling basin. The clerk read the department head comments. The plan had already been raised according to the comments. Board Comments Planner Flynn asked if the plan niet parking and buffering requirements and was told it did. She asked if the drainage would work. \ it-. Smith responded it had been tested for the 10. 25. and 100 -year storms had been tested, adding there is a ( drainage easement over the property. He said with 100 percent use, ttiere would be 10 hours of storage capacity in the wet well if the pump failed. Planner Dolan asked if the dumpster would be enclosed and on a concrete pad and was toll it would be. Nlr. Burke complimented the engineer on his thorough and cooperative work. Acting Chairman Sullivan asked about the soil logs and the slope of the basin walls. Mr. Smith explained the test holes had been done last spring, (hiring high ground water season and the slope of the basin walls would be gentler and seeded toward the residential side and steeper within the site. Ivh% Smith said the sewer would be pumped off site. The drainage calculations did not account for infiltration because it flows naturally. He said a six inch pipe will slow the flow in the basin with a 12 inch overtlow pipe above the 100 -year storm line, and the water will back up in the basin and no out slowly. Ah•. Smith explained the drainage structures were designed for the 10 -year storm, but because water will be entering the basin at a low point, neater would have to fill the basin and go over the curb, but if the water were to get that high, it would push out into the overflow pipe. Acting Chairman Sullivan was concerned about the stilling basin accumulating silt. Mr. Smith said that may happen, but suggested the Conservation Commission could make cleaning the basin out periodically a requirement. :Notion: To send the Building Inspector a positive recommendation on the plan (Flynn- Trombetta) All in favor. PASSES Around the Table Planner Bonda asked if Folkrnan and Zola Builders had started work on Weaver Lane, Mr. Burke told her the street had been marked, but work had not begun. Planner Dolan asked what the other members thought about the East Street options. Planners Bonda and Flynn said they liked the ideas for traffic cahning. Mr. Burke said there did not seem to be much staff support for the idea. Planner Bonda suggested doing an article for the newspaper discussing the options before the joint meeting on September 27. 8. Adjournment Motion: To adjourn at 9:30 PAI. (Dolan - Bonda) All in favor. PASSES Date of next meeting: August 30. 1995 at 7:00 P.M. Signature of Clerk Date of Approval
