2. Site Plan Review - Day Care Center - School Street - Wayne Carrigan
The clerk read the department head comments. Ralph Maloon, RIM Engineering,
presented the plan for a day care facility with a fence and gates into play areas and 11
parking spaces with a turning area of 50 feet. He said there would be four employees
working at a time, so there will be plenty of parking. Mr. Maloon proposed a yield sign
for traffic coming off of Route 140.
Public Comment
Wayne Carrigan, owner, said he had done everything the town asked and disagreed
- - with Officer Lance Lawson's comments about traffic safety. He said he had looked at
police records and found there had been no accidents at that driveway. Steven Dean,
attorney for the applicant, said the former use of the property had a comparable level
of traffic with larger vehicles. He said the state would not grant a curb cut in a
different location, but they were willing to make leaving the driveway a right turn only.
Board Comment -- - -
Planner Flynn said she was concerned about the safety of the children at the day care
and those driving in and out of the site. Mr. Maloon explained the driveway would be
27 feet wide and the children would be dropped off in the back of the house. Planner
Flynn said she would like to see Officer Lawson's comments on the new plan, dated
June 16, 1995,
Planner McShane suggested a rotary -type set up in the drop off area and fewer parking
spaces with more turnaround area. Mr. Maloon said with the 50 feet, there would be
plenty of room to turn around.
Acting Clerk Bonda asked if the fence was within the property line. Mr. Maloon said
the granite bound on the plan is not the property line, and the fence is within the line.
Acting Chairman Sullivan asked about the soil. Mr. Maloon told him it was gravel with
high ground water, adding they would use 6 inch crushed stone in the play areas, which
is required and will allow infiltration. Acting Chairman Sullivan was concerned they
would be adding to the impervious surface area and about the traffic and safety issues.
Planner Dolan agreed a right -hand turn should be the only way out of the driveway and
said he would want a stop sign at the end of the driveway.
Mr. Burke explained the applicant had tried to relocate the curb cut, but the state would
not allow it. He said the site is difficult, and the use would be creating more traffic
3.
than the previous use. He added he did not know if the board could prohibit a left turn
into the site. - - - -
Planner Flynn asked if the site would drain onto adjacent properties. Mr. Maloon said
the detention basins on the site were to catch runoff from the driveway. Planner Flynn
asked what would have to be done to increase the number of children from 30. Mr.
Carrigan said he would have to redo the second floor, though it would be a long time
before he would be able to do that.
Acting Chairman Sullivan asked if the plan addressed the landscaping requirements.
Mr. Maloon answered Mr. Cook did not feel it comes under those requirements.
Planner McShane asked if the applicant had spoken to Officer Lawson since he
received the new plan. Mr. Carrigan said he had not, but would.
Mr. Burke suggested the board could send the Building Inspector a recommendation
contingent on Mr. Cook receiving Officer Lawson's report on the revised plan prior to
granting a building permit.
Planner Flynn said she wanted to see Officer Lawson's comments on the new plan
before making a recommendation.
Motion: To have Mr. Burke get in touch with Officer Lawson for a written
recommendation on the June 16, 1995 plan and postpone making a
recommendation until the July 12, 1995 meeting.
(Flynn - Bonda) All in favor. PASSES
Surplus Material Removal Application - South Main Street - Karl Clemmey
Acting Chairman Sullivan excused himself from the discussion and left the room.
Motion: To appoint Acting Clerk Bonda Acting Chairman and Planner Flynn Acting
Clerk
(Dolan - McShane) All in favor. PASSES
The clerk read correspondence, including a building permit which was issued on May
4, 1995. Mr. Clemmey explained he would be moving two piles of excess material,
removed during parking lot construction, to a site on West Street.
Board Comment
Planner Flynn asked about the ground water. lvh•. Clemmey showed her several
monitoring wells on the plan and said the highest groundwater they found was at 13
feet, and the site is on sewer. Planner McShane asked if there would be screening of
the site from the roadway. Mr. Clemmey explained the state owns the land right
along South Main Street, but would do some landscaping at the front of his site.
Motion: To send the Building Inspector a positive recommendation
(Dolan- Flymr)
Mr. Burke suggested the board use the conditions in the standard draft he had
prepared. Planner McShane asked about the status with the Conservation Commission.
Mr. Clemmey said he should have an Order of Conditions within 10 days.
All in favor. PASSES
4. Subdivision Rules and Regulations Discussion
Acting Chairman Sullivan returned to the meeting.
The board had decided several months ago to go to public, hearing with four items, and
several items remained unresolved.
Sight Distance Plan and Profile - Acting Clerk Sullivan said this was important to a
lot of plans. He said now, plans don't show large trees or rocks, which are often the
problem. The board discussed adding "Sight distance must be shown on the definitive
plan in plan and profile. Sight line showing trees, shrubs and other obstructions to
sight distance shall be added to the plan." The board discussed keeping the ASHTO
reference or using MPH, and whether using MPH would be defensible. Planner Flyer
suggested waiting to discuss the issue when Chairman French returns.
Consensus was to require a plan showing sight distance plan and profile. The question
is whether to use a reference other than ASHTO.
Sidewalks -The board discussed requiring one or two in a subdivision. Mr. Burke
reminded the board he had given the some cross sections of roads with different
widths. Planner Flynn suggested leaving the requirement at two sidewalks and waiving
one where appropriate, but if one is required, it wold be hard to make developers do
two. Planner McShane said he would rather see more paved pedestrian surfaces and
less car surface, adding that one sidewalk makes the street look unfinished. Planner
Dolan agreed with requiring two one through streets, but didn't see the need for two on
a cul -de -sac road.
Consensus was to require two sidewalks on through roads and waive one when
applicable. The questions is whether to change to current regulations on cul -de -sacs.
Planner Dolan suggested the sidewalk go to the last driveway in the cul -de -sac. Acting
Clerk Sullivan said the regulations require that now, and if the board were to allow one
sidewalk, it should serve the maximum number of lots. Mr. Burke suggested requiring
two on minor roads, and considering waivers for cul -de -sac roads.

55 foot secondary road with 24 foot pavement and a 9 foot grass strip. Acting
Chairman Sullivan suggested leaving the major road as is, at 60 feet with a 40 foot
pavement and changing the minor and secondary requirements.
