Burke, Director of Planning and Development 1. Meeting called to order at 7:30 P.M. 2. Public Hearing Continued - Winslow Estates The clerk read new correspondence from the Engineering Department. Michael Trowbridge, Hutchins - Trowbridge Associates, showed the board revised plans wherein he addressed Planning Board and department head comments. The Engineering Department had requested monitoring wells, and Mr. Trowbridge said he would do them at the infiltrator and detention basin. He said because March is high ground water month, he would request a continuation of the public hearing until April. He added he checked on the culvert under East Street and found it cannot handle the 100 -year storm. Mr. Trowbridge requested waivers for the fence around the detention pond and the oil /water separator at the front of the subdivision. In exchange, he will plant an extra 200 feet of trees as screening for existing abuttors. Planner Trombetta asked about the benefit of waiving the oil /water separator. Mr. Burke told him it had been done recently on subdivisions in the area, but those were no longer in the Zone II district, while this still is. Planner Trombetta said he would like justification for the waiver. Mr. Burke explained the abuttors are concerned about additional noise, and planting a buffer was the developer's attempt to lower the noise. Mr. Trowbridge said the chance of an oil spill at the catch basins is slim, and the oil /water separator would just be one more thing for the town to maintain. Mr. Trowbridge said he got his drainage calculations from Ralph Maloon, RIM Engineering and they would be reviewed by the Engineering Department to look at how much water goes under East Street and how much the drainage system could handle. In a straw vote, Planner Dolan abstained, Planners Trombetta, Honda, French and Chairman McClanahan said they would be inclined to be in favor of the waivers, and Clerk Sullivan said he would not be in favor of the oil /water separator waiver. He would, however, be in favor of the fence waiver and suggested staggering the trees. The board agreed that would be more attractive. Motion: To continue the public hearing until April 5, 1995 at 7:30 P.M. with a corresponding extension in the deadline for final decision to April 21, 1995. ( (French - Sullivan) All in favor PASSES 3. Public Hearing Continued - Smithfield Estates The clerk read new correspondence from the Engineering Department. Michael Trowbridge, Hutchins- Trowbridge Associates addressed some of the comments. He asked what more detail the engineers wanted on the plan. The existing water main on Balcom Street is the property of the City of Attleboro and Mr. Trowbridge said he would note on the plan the applicant must get a connection permit. He said the engineers had been concerned about ground water and explained he is well above it. Clerk Sullivan asked Mr. Trowbridge to get. Scott Leite's adjustment figures. The engineers had also asked for the fire hydrant to be moved. The Planning Board told Mr. Trowbridge to place the hydrant at the end of the cul -de -sac. Planner French asked if the corner rounding easement was existing. Mr. Trowbridge told him it is. Planner Sullivan asked if the plan changes with the established wetland line. Mr. Trowbridge responded it does not. Chairman McClanahan asked if the abuttors' concerns had been addressed. Mr. Trowbridge said all but one were satisfied, and they were working with the last one. Motion: To continue the public hearing until March 8, 1995 at 9:00 P.M. (Sullivan- French) Clerk Sullivan said he was concerned about lots 4 and 9. Jack Smith said they would be given to the Conservation Commission or to the City of Attleboro. Clerk Sullivan said he would like that to be noted on the plan. Mr. Trowbridge said he would discuss it with his client before the next meeting. All in favor. PASSES 4. Public Hearing Continued - Classic Court The clerk read the public hearing notice. Ralph Maloon, RIM Engineering, presented the plan, which had been approved in 1991 as a 6 -lot residential compound. Since then, one lot has been removed and sewer has been added. There will be a private driveway owned and maintained by the residents. The Conservation Commission has verified the wetlands line. Attorney Garen Bresnick told the audience the open space would be left in a natural state permanently, according to the by- law. Mr. Maloon added the owners of the lots will jointly own the open space, which will not be built on or filled. William O'Brien, Conrod Court, asked about the restrictions on the open space. Mr. Maloon told him there would be no building, filling, changing of the topography or clearing of the lot, which would be required to remain substantially as it is when the plan is approved. Department Head Correspondence The clerk read comments from the Engineering, Conservation and Police Departments. Mr. Maloon said many of the Police Department concerns had been addressed in the revision. Board Comment Planner Dolan said the entrance was in a good location. Planner Bonda remembered at the preliminary stage, the intersection offset had been an issue and wanted to discuss it. Mr. Burke said he would send a memo to Officer Lawson A 5. asking him to reexamine the offset.- Mr. Maloon said he could move the driveway, but it would be hard to center it with the road across the street. He added that based on Officer Lawson's comments, moving the driveway would make the sight distance worse. Clerk Sullivan asked Mr. Maloon to explain the drainage; Mr. Maloon said the driveway pitches down to the sidewalk. Clerk Sullivan requested proposed contours and spot shots in the driveway. Planner French asked where the sewer is. Mr. Maloon told him it comes from Mill Street with a manhole in front of the subdivision. Clerk Sullivan asked why no test holes were shown. Mr. Maloon said he could provide the information or do new ones. Mr. Burke asked if there were any street lights proposed. Mr. Maloon said there is a light existing across the street near the proposed entrance, and.two planned for the driveway. Clerk Sullivan asked about the three houses shown with dry wells. Mr. Maloon explained that was a Conservation Commission request because those lots fall within 100 feet of the wetland line. Mr. Maloon said he would get dry well details. Public Comment William O'Brien asked why the open space lots did not appear to be connected. Mr. Maloon explained they are adjacent, with a wetland strip between. Mr. O'Brien asked what the regulations would be if the owners put a swimming pool in the open space. Chairman McClanahan explained the applicants would have to go before the Planning Board and Conservation Commission, and if they fall within 100 feet of the wetland, the abuttors would be notified. PASSES Public Discussion Karl Clemmey told the board the Back Bay Brook goes through his proposed subdivision, Woodlot Estates, and that he will have to go through the Engineering Department and the Corps of Engineers to bring it up to approval. Chairman McClanahan told him the board would not discuss his subdivision outside the public hearing. . Mr. Clemmey requested time on the Planning Board agenda to discuss other issues. He also asked the board who he should speak to about building a road over town -owned property because he is trying to buy a house over the town's interceptor. He told the board he would prefer not to continue his public hearing to the same night as Woodland Park. The board will place Mr. Clemmey on the agenda February 15, 1995 at 9:30 P.M. for discussion. Michael Trowbridge said he was concerned about the board's proposed amendment to the lot width definition, saying it would be impossible to define on a curve or cul -de -sac, and suggested deleting it. Mr. Burke said it was to prevent lots from having acute angles and keep them more regularly shaped. He asked Mr. Trowbridge if the proposed measure wouldn't work, what would? Mr. Trowbridge asked if he came up with another proposal, would the board look at it? Mr. Burke said it \ would, since the amendment had not gone to public hearing yet. 7. Planner Bonda agreed. Motion: To send the Town Manager a letter requesting his facts and rationale for moving the Planning Department offices to Town Hall. The board would prefer things be left as they are and request he reconsider the move. Send a copy of the letter to the Board of Selectmen (Sullivan- French) All in favor. PASSES 8.
