6. Public Hearing - Wayfield
The clerk read the public hearing notice.
David Grant, Tilton Associates, representing Kevin Delaney, explained this
would be a seven -lot subdivision on six acres abutting the Industrial zone. He
said the 837 foot long road conforms to the minor road requirement with a 15
foot grass strip on the east side. The site will be severed with an eight inch
pvc pipe and two water mains to West Street. There will be two fire hydrants
and three street lights in the proposed road, with electric, cable, fire, and
telephone in an underground duct bank.
There will be eight sub -catch basins which will drain into the street system,
then into a retention/detention Swale on Lots 3 and 4. Mr. Grant explained the
slopes in the detention area are 3 to 1 and that post development, flow from
the site will not go into West Street. During the 25 -year storm, Mr. Grant
said he measured 1.93 cfs pre - development and an increase to 2.08 post -
development on -site. Off site, he measured 2.4 cflo re-de elop 7 and post
post - development. During the 100 -year, p P
will be 4.02 cfs on -site and 4.57 cfs pre- development and 4.02 post -
development.
Mr. Grant explained sight distance is not a problem with the removal of one
tree. The applicant will be requesting four waivers: for the radius of the
pavement from 70 feet to 50 feet in the cul -de -sac; and the radius of the
property line from 80 feet to 63 feet in the cul -de -sac. Mr. Grant said he had
spoken with the Police and Fire Departments, both of whom had no problem
with these. He explained this would reduce the amount of pavement by
approximately 51 percent, as he was trying to reduce the amount of water
reaching the detention basin. The third waiver is for the stormwater drainage
system. The regulations say retention basins are allowed only on the water
supply protection district, which this site is not in. The last waiver is for the
cover over the drainage pipe.
The clerk read the department head comments.
Officer Lance Lawson - Mr. Grant said they could extend the sidewalk and
install a streetlight at the intersection.
Engineering Department - Mr. Grant said they have a verbal agreement with
the abutter for the tree planting easement and will agree to a utility easement.
Mr. Grant explained they could not relocate the basin because of the water
table and the fact it would be within 100 feet of the property line. He said the
project would not come under the DEP format for test pits, which does not
take effect unitl January 1996.
Water Department - Mr. Grant agreed to all comments.
Mr. Burke - Mr. Grant said he would show Lot 1 as non - conforming on all
sheets and would show the curb cuts on all lots. He said he was willing to
discuss the outlet structure, but didn't think they needed a guard rail around
he whole drainage area, perhaps just aroond the outlet structure.
Fred Fishner, Fishner Engineering, designed the drainge for the site. He said
there would be no real drainage through the site except through the wetland.
He said this would not make current conditions worse, and may improve them
slightly. He said water would go into the ground before it gets to the wetland,
and sand and gravel in the area would recharge the ground water.
Public Comment
Cheryl Wink, Walnut Street, said she ice skates on this site and asked what
would happen with the houses. Mr. Grant explained the wetland would not
change and the water from the site would go into the existing wetland and
the amount of water getting to the wetland would be lessened by the street
drainage. He noted there is an existing problem on the Darby property, and
they have installed a catch basin in their back yard.
Karen Allen said the schools are too crowded and was concerned that the
lights from the industrial park would effect her when the trees were cut down. the non-conforming
French explained he applicant would about
be able to build on thattloChairman t.
Sandra Levine, Walnut Street, asked what would be done with the gravel
gravel from he back of Mr.
he lots abutting the industrial zone. He adddd he remove
abutter on the industrial side is planning some work and they may get some of
their gravel for fill on this site.
Mrs. Levine asked how the composition of the wetland was determined. Mr.
Grant told her that had been done through observation, with no test holes
within the wetland, and he believes that to be a seasonal wetland. Mrs. Levine
told him that site had been a cranberry bog in the 1800s with a spring feeding
the bog. Mr. Grant said they had no plans to disturb the wetland. Mrs. Levine
asked about plans to clean out the wetland. Mr. Grant told her if the
Conservation Commission wanted them to, they would remove trash, tires,
etc. Mrs. Levine was concerned about changing the way the water flows if the
wetland is disturbed.
Mrs. Levine asked about the stone wall. Mr. Grant said it would depend on
the lot, and it could be left in the back of lots, but that it would be taken out
for the road. Mr. Burke said the only by -law protecting stone walls is on a
scenic road when it falls within the right- of- way, which this does not.
Mrs. Levine said a large part of the lots near the wetland would be very wet
and had many mosquitoes. Mr. Grant agreed. She asked what would prevent
the homeowners from doing something to the wetland. Chairman French
explained any work within 100 feet of a wetland is governed by the
Conservation Commission and the Wetlands Protection Act. Mr. Grant said
they would be filing with the Conservation Commission for the road and each
house which falls within 100 feet of the wetland.
Mrs. Levine asked why rip rap would be necessary if they will not be
increasing the volume or the rate of water. Mr. Fishner explained they would
be intercepting the drainage in the road and running it through a retention area,
which would make it a point source discharge. Where the water had been
coming from all over the site, now it,would be coming
rom one point. It will
ng
be the same amount and flow, but coming out at one point, with the rip rap to
dissipate the force in order to minimize erosion. Mrs. Levine asked the board
to consider that water currently flows over the existing property lines.
Dianna Cole, 437 West Street said she was concerned about development in
town. She told the board she had an agreement with the developer to deed her
part of his property so she could put a driveway on the new road, then changed
the deal. Mr. Grant said that could be worked out. Mrs. Cole asked what
would happen after development and the existing homes have problems. She
said she wants access to her back property and is willing to grant the
developer a tree planting easement when there is a written agreement. Mr.
Delaney

Mr. Burke asked if the Conservation Commission had agreed to the wetland
line. Mr. Grant said they had not filed yet. Mr. Burke said they could go to
the Board of Health for the groundwater adjustment for July.
Clerk Sullivan suggested adjusting the outlet control so more water will stay
in the structure.
Planner Dolan said he would like written confirmation from the Police and
Fire Departments they have no problems with the cul -de -sac waivers.
Chariman French asked what would happen in the detention area if the ground
is frozen. Mr. Fishner said we don't usually get the kind of storm he is
dealing with when the ground is frozen. He said he could put a leaching catch
basin inside the drainage basin, but that would be close to or at groundwater
level. Chairman French suggested making sure the runoff will not increase in
any situation.
Jane Haddigan, 440 West Street, said there is an existing house on Lot 1. Mr.
Grant said it would be moved, probably to Lot 2. Clerk Sullivan suggested
showing that on the plan.
