Public Hearing Continued - Massapoag Estates Modification The clerk read new correspondence from the Fire Chief and the Town Engineer. Ron Bonvie, Remus Realty Trust, said he and his partner were trying to be cooperative but said he did not want to install pumps in homes where they are not needed. Public Comment Steve Cummings, 11 Donald Allen Drive, suggested the testing be done at peak water use times. Chairman McClanahan said test times would be up to the plumbing inspector. Mr. Cummings said the NFPA suggests 2,000 gallons /minute for residential fire flow. Mr. Burke said the Water Department used ISO standards, which suggest 750 gallons /minute, and the town is getting 1,000 gallons /minute. Mr. Cummings expressed concern about how future development in the area will affect water pressure. Mr. Burke said development will help the pressure at Massapoag because future development will complete the loop. Board Comment Clerk Sullivan said if the fire chief thinks fire flow is adequate for fire flow, then residential pumps should be the main issue. Planner Bonda agreed, saying she wanted the residents to be satisfied. Mr. Burke said the board should keep the issues of public ( safety, convenience, and the surety separate and if the work was being completed, surety should be released. Planner Flynn asked if the town could use the 10% contingency to complete anything within the subdivision. Mr. Burke said the contingency was to complete any required improvements, but any individual deals the developer had made with homeowners could not be funded by that money. Planner Flynn asked what that meant regarding the pumps. Mr. Burke said that would probably not come under required improvements. Planner Flynn asked if the board could request additional surety be posted for the pumps. Mr. Burke suggested increasing the 10% surety to be sure all improvements are completed. Clerk Sullivan suggested making the contingency 13 %, to bring it up to $100,000, to come out of the last payment. Motion: To require the developer to test all homes in the subdivision now and install water pressure booster pumps in those which do not meet state pluming code; to test all homes upon completion of the subdivision and install water pressure booster pumps in those homes which do not meet state plumbing code at that point; that the testing be done at peak water use periods;, that copies of the test results be supplied to the Planning Board and the homeowners; and that the contingency be raised to 13% to be held until all testing and pump installation, and with all required improvements within the subdivision, are completed. The above will be incorporated into an agreement between the Town of Mansfield and Remus Realty Trust to be signed by Wednesday, September 14, 1994. The developer will have 60 days from the date of signing to install water pressure booster pumps. (Sullivan - Flynn) All in favor. PASSES. Motion: To find the developer no longer in default as a result of the agreement reached at this public hearing pending the signing of a new agreement between the developer and the town. (French - Sullivan) All in favor. PASSES. Motion: To release $3,000 from Bond B. (French - Flynn) All in favor. PASSES. Motion: To release $7,301.94 from Bond C. (Flynn - Sullivan) All in favor. The clerk read the corrected Police Department traffic study. Michael Trowbridge, Hutchins - Trowbridge Associates, Inc. said the new numbers were reflected in a new count diagram. He said the his original numbers and Officer Lawson's new numbers were similar. Mr. Trowbridge said the applicant had worked out the water problem with the Habeebs and Ed Jameson by agreeing to a catch basin on Mr. Jameson's property with a 10 foot drainage easement. Mr. Jameson will install and maintain the basin. Mr. Burke suggested tying the work on the subdivision with the work on Mr. Jameson's property by having the catch basin installed prior to the installation of the binder coat. Motion: To close the public hearing. (Sullivan- French) All in favor. PASSES.
