Burke, Director of Planning and Development 1. Meeting called to order at 7:30 P.M. 2. Discussion with Harvey Gack - Class II License Mr. Gack told the board he has had a Class II license in Mansfield for 10 years and had been using a post office box. The Board of Selectmen recently told him he had to get a business address, but the office he was considering renting is in the B2 zone. Used car lots are allowed in this zone by special permit, which Mr. Gack said he should not have to get because he will not be housing the cars on the property. Mr. Burke said he did not think the board could waive the special permit requirements. He said Mr. Gack had two options; go through the special permit process or find another location where his business would be allowed. Chairman McClanahan suggested Mr. Gack find an office in the B3 or one of the Industrial districts, where used car lots are allowed by right. The board gave Mr. Gack some suggested locations where his business would be allowed. 2. Public Hearing - Cedar Ridge Definitive Subdivision Plan Chairman McClanahan left the meeting at this point. Motion: To appoint Planner Annino acting clerk, therefore acting chairman in Chairman McClanahan's absence (Flynn- French) All in favor. PASSES. Motion: To appoint Planner French acting clerk (Annino - Bonda) All in favor. PASSES. The clerk read the legal advertisement. Michael Trowbridge, Hutchins - Trowbridge Associates, represented the plan, a six lot subdivision off of Mill Street. He told the board sewer would come into the subdivision from Norton and had been approved by DEP. Mr. Trowbridge had worked with the Engineering Department to come up with a unique detention area, designed for the 100 -year storm. The applicant requested a waiver on the oil /water separator because the site is outside the water protection district. The clerk read the department head comments. Public Comment Ed Jameson, abuttor, said he was in favor of the project and asked if the detention basin would be fenced. Mr. Trowbridge told him a four foot perimeter fence was proposed. Joan Habeeb, 449 Mill Street, said she currently has problems with water flooding her driveway and asked if the project would effect that problem. Charles Mueller, abuttor, said he also has a water problem and thought it was because of the poorly drained soil. Mr. Jameson said he thought Mrs. Habeeb's problem was that her house had been built lower than the street, so the water flows down into her driveway. Mr. Trowbridge said the construction would not make Mrs. Habeeb's water problem worse and would likely help. He explained that if the houses in the subdivision were built slightly higher than at grade, the water from the front of the lots would drain into the street and into the detention basin. Acting Chairman Annino said he was concerned with surface and subsurface water. Mr. Burke suggested the applicant may need subsurface drainage along the side of the road or could consider an earthen berm along the back of the existing lots. Lincoln Musto, 484 Williams Street, trustee of Tech Realty Trust, said he would like the board to consider allowing a road narrower than 24 feet. He said he would like to have a larger grass strip and the narrower road would be in keeping with the character of Mill Street. Board Comments Acting Clerk French suggested the applicant submit a cross section of the proposed road and asked if there were plans to extend the road in the future. Mr. Musto said there were not and offered to include that stipulation on the plans. Acting Clerk French inquired about the intersection offset with Van Gemert Drive. Mr. Trowbridge told him it was approximately 230 feet, but would put the exact measurement on the plan. Motion: To ask the Engineering Department and DPW Director to review the drainage design in light of the poorly drained soils in the area. (French - Bonda) All in favor. PASSES. Motion; To ask Officer Lance Lawson to do a traffic study in the area of the proposed subdivision. ( Bonda- Flynn) All in favor. PASSES. Planner Flynn inquired about the need for an oil /water separator. Mr. Burke told her the board could require one, even though the site was no longer in the water protection district, because the regulations in place at the time of filing govern the requirements. Acting Chairman Annino asked the length of the cul -de -sac; Mr. Trowbridge told him it was 850 feet to the center. Mr. Trowbridge added the site is heavily wooded with hardwoods. Mr. Jameson said he thought a narrower road was a good idea from a public safety point of view. Planner Flynn asked about the applicant's plans to move the stone wall on Mill Street. Mr. Trowbridge told her he planned to relocate it to the entrance of the subdivision. Motion: To continue the public hearing until the board hears from the Engineering Department and DPW Director and the request for waiver on road width from the applicant. Schedule the public hearing for Wednesday, August 24, 1994 at 8:30 P.M. (Flynn - Bonda) All in favor. PASSES. Planner Flynn suggested the applicant request a waiver for a meandering sidewalk rather than a straight one. The applicant agreed to look into the possibility. 3. Site Plan - RJM Realty Trust - Mansfield Avenue Chairman McClanahan returned to the meeting at this point. Michael Trowbridge, Hutchins - Trowbridge Associates, represented the plan for the site and proposed small office building. The clerk read the department head comments. The Engineering Department was concerned about a potential traffic problem at the intersection and suggested there be one point of access rather than two. The engineers also suggested designing the site to keep storm water on site by overexcavating the leaching areas. Mr. Trowbridge presented a revised plan, where he had addressed the Engineering Department's comments. Acting Chairman Annino suggested identifying the use on the plan, so it has a classification for zoning purposes. Motion: To send the Inspector of Buildings a positive recommendation with the Engineering Department's concerns and the following Planning Board concerns: show a walkway at the entrance and egress of the building, show the use in order to arrive at parking space numbers, screen the dumpster, make sure trucks can turn safely into and out of the site, show tree and shrub sizes, plant shade trees to the right of the building if possible, show detail of bituminous pavement and berm, show dimensions of parking spaces, show distance between parking spaces and building. (Flynn - McClanahan) All in favor. PASSES. 4. Discussion with Folkman & Zola Builders - Weaver Lane Paul Folkman told the board he had done two flow tests on ( Weaver Lane and found there to be no obstruction in the drain. He plans to retain a soil scientist, Dr. Paul Aldinger, who has a proposal Mr. Folkman will submit to Mr. Burke. Mr. 5. Folkman said they may do test pits and /or borings and plan to get staff comment on the testing. Finally, Mr. Folkman told the board he hoped to have the testing done and a solution implemented by mid- to late- October. Correspondence 1.
