Public Hearing Continued - Carleton Estates The clerk read the updated traffic study and accompanying letter. Michael Trowbridge, Hutchins - Trowbridge Associates, told the board that with the removal of the trees approved at the scenic road public hearing, Douglas Drive's sight distance would be 250'. Board Comment Planner Bonda thanked the applicant for updating the traffic study. Planner Flynn had no comments. Planner French asked how the applicant got the original sight distance of 227 feet. Mr. Trowbridge told him they used Mansfield measuring techniques for a 30 mile - per -hour zone. Planner Annino said he was concerned that most drivers go faster than 30 in that area of West Street. Chairman Madan said the board had to go by the statute, which says the sight distance must be tested under the posted speed limit. Planner French requested a plan of how the traffic engineer arrived at 250' and suggested part of the regrading should include a sight easement so future plantings will not block sight distance. Public Comment Carleton Briggs said he thought the applicants had done more than required and there seemed to be an attempt being made to delay the project. Planner Annino said the board was not trying to delay the project, but the applicants had not satisfied the board's concerns about sight distance and public safety issues. Wayne DeLorio said he lives in the existing house on the sight and has never had any problems getting in and out. Planner Flynn asked if all the work on increasing sight distance would be done on the right -of -way. Mr. Trowbridge said some work would be done on the Briggs property. Mr. Burke suggested the traffic engineer may already have done a plan similar to the one Planner French requested. Perry DiMascio, one of the applicants, said it would be an expensive and extensive task to do one. Chairman Madan asked if it would be possible for Mr. Trowbridge to do the plan. Motion: To continue the public hearing until 10 P.M. (McClanahan- Madan) Two in favor. Four opposed. FAILS Motion: To continue the public hearing until June 1, 1994 at 7:00 P.M. (McClanahan - Flynn) All in favor. PASSES. 6. Public Hearing - Mill Street Scenic Road Bob Swanson and Dave Archard of the Mansfield Engineering Department presented the plan. Mr. Swanson said sewer would. be installed for the Mill Farm subdivision by Jack Riccio, who was planning to do trenches but no laterals to existing homes. The Engineering Department is working with Mr. Riccio to get laterals to all the homes and to get the road repaved following the project. Mr. Swanson said he did not know yet who would be doing the installation of laterals. Board Comments Planner Annino asked if any stone walls or trees would be removed. Mr. Swanson said no trees would be removed, and any stone walls that were disturbed would be replaced in the same location. Planner McClanahan asked if there would be a betterment charge to the abutters. Mr. Swanson said there would not be. Motion: To close the public hearing. (Flynn- McClanahan) All in favor. PASSES. Motion: For a positive finding on the scenic road with the 1 provision that "applicant, contractor or subcontractor" be added to the decision. (Flynn- McClanahan) All in favor. PASSES. 7. Discussion of Weaver Lane and Cooper Road with Folkman and Zola Builders Paul Folkman said they were taking care of the safety problems on Weaver Lane and had Paul Aldinger, a soil specialist look at the situation. Mr. Aldinger suggested cutting the asphalt and tying into the existing drainage. Mr. Folkman said they were willing to find an equitable solution to the problems. Board Comments Planner Flynn said she would like to see Mr. Aldinger's credentials. Chairman Madan suggested holding an informal hearing on modifications after the applicant's engineer does a plan and gets comments from the Town Engineer. Mr. Folkman said he would have a plan of action within 30 days. Jay Zola said the catch basin on Cooper Road had to be enlarged per the Conservation Commission, and a lot was lost. He said they had considered doing a modification with Tara Estates to get the area needed, then decided not to involve Tara. The applicant is requesting a waiver for a 40' right - of -way in order to get the required area for Lot 24. Mr. Zola said the town would retain any interests it currently has and it would guarantee the connection of Cooper Road with Tara Estates. An informal poll showed the board to be generally in favor of the applicants pursuing this course of action. 8. Preliminary Plan Review - Jameson Farm Acting Clerk McClanahan excused himself from the meeting. The clerk read the department head comments. Board Comments Planner Benda said she was concerned about the proposed road's proximity to Van Gemert Drive, sight distance and wetlands. Planner Flynn asked where the other subdivisions in the area are in relation to this site. She was also concerned with the sewer and drainage hook -up, turning radius and right -of -way, and wetlands. Mr. Burke asked why there was an easement shown on the plan when that property is owned by the applicant. Planner French asked if there was an infiltrator on the site. Mr. Burke said the same kind of infiltrator was used as was used in Van Gemert Estates. Chairman Madan said he was concerned about the site being close to possible town well sites and would like to see the impact of this development on the wells on an Environmental Impact Report. Planner Flynn said he would like to see existing vegetation lines and types on an Environmental Impact Report, Motion: To approve the plan with all department head and board member comments. (French - Annino) All in favor. PASSES. Correspondence Continued Acting Clerk McClanahan returned to the meeting. 14. Letter to Leonard Flynn RE: SRPEDD development district 15. Around the Table Planner Flynn said she was distressed the board had to judge preliminary subdivision plans on state regulations alone and suggested putting subdivision regulations on the board's work list. She suggested changing Mansfield's regulations to resemble the state's or lobbying the state to change its regulations. Mr. Burke said he would like to do that over the summer, perhaps with a public hearing in August. The board will discuss the issue on June 22, 1994. Chairman Madan said there, had been a meeting concerning the train station to which the Planning Board had not been invited. He suggested sending the MBTA a letter requesting a representative come in for a presentation. Motion: To request a presentation from the MBTA. Copy the Train Station Committee. (French - Bonda) All in favor. PASSES. Mr. Burke said he would be sending out a revised work plan and asked for any suggestions for inclusion. 10. Adjournment Motion: To adjourn at 10:30 P.M.
