Burke, Director of Planning and Development 1. Meeting called to order at 7:30 P.M. 2. Preliminary Plan Review - Classic Court The clerk read all department head comments. Ralph Maloon, RIM Engineering, presented the plan for seven lots, including one existing home, on the border of the R -1 and R -2 zones off Mill Street. The applicant is requesting a waiver for a corner rounding easement. Planner Bonda asked if there were any features on Mill Street which would require a scenic road public hearing. Mr. Maloon and the applicant said they did not think there were any large trees or stone walls in the right -of -way. Planner Flynn asked if all the lots in the proposal conformed to zoning requirements. Mr. Burke told her they did. Clerk Sullivan noted that the Conservation Commission had been concerned about the wetland line on Lot 2. Mr. Maloon said he. thought the line was the same as when the plan was submitted as a residential compound. Planner Sullivan asked if there was provision for drainage overflow at the front of the subdivision. Mr. Maloon said there was not, but the galleys had been sized for the 100 -year storm. Planner Sullivan said the site would need permeability tests and test holes. Planner French asked what would become of the existing garage between Lots 1 and 2. Mr. Maloon said it would be moved onto Lot 1. Planner French requested the applicant check with the Conservation Commission to verify the wetlands line. Chairman Madan asked how close the existing home on Lot 1 is to the right -of -way.' Mr. Maloon told him it was about 18 feet from the road and would be moved. Chairman Madan said he was concerned about the alignment of Classic Drive with Ephriam Drive and asked how granting a corner rounding easement would be in the best interest of the town. Mr. Burke said he was very concerned about the drainage on Lot 7 and suggested an overflow so storm water doesn't flow onto other properties or onto Mill Street. Planner Flynn asked how close the property line is to the pond. Mr. MacDonald told her the water was approximately 300 feet from the property line. Garrin Bresnick, the applicant's attorney, told the board the project had originally been a residential compound with a special permit, which had lapsed. He said his client would rather do a residential compound and requested the balance of the original filing fee, if any remained. Mr. Burke suggested returning the 45% of the submission fee covering inspections, since none were done. Motion: To approve the plan with all department head and board comments noted. (Flynn - Bonda) All in favor. PASSES. 3. Preliminary Plan Review - Kaybrit Woods Chairman Madan excused himself from the meeting at this point and handed the gavel to Planner McClanahan. The clerk read all of the department head comments. Ralph Maloon, RIM Engineering, presented the plan for a five lot subdivision with an 800 foot road to the center of the cul -de -sac. He said the plan had originally been submitted as • residential compound and the applicant would prefer that to • traditional subdivision. Mr. Maloon said the existing driveway would be expanded, with drainage and a grass swale along the road. In a residential compound, the existing barn ( would be removed; in a subdivision, the existing house and barn would be removed. Planner Flynn said she would prefer the residential compound so the town wouldn't have to maintain the road. Clerk. Sullivan said the applicant would need permeability tests, test holes and monitoring wells. Planner French said he was concerned about drainage. Mr. Burke said he would prefer to see a residential compound, which would have a longer road, but less paved area, and smaller drainage areas. He asked how far the road was from Clare Avenue and was.told 400 - 500 feet. Clerk Sullivan said the Form B did not have Susan Brown's signature, but based on a letter from Town Counsel, Mass General Law doesn't reference the Form B. Consensus of the board was that based on that, a Form B lacking a signature of one of the owners is not sufficient grounds to reject the submission of a preliminary plan. Motion: To approve the preliminary plan with all board and department head comments and with the signature of all I owners. (French - Bonda) Five in favor. One abstention. PASSES. 4 Consensus of the board (four in favor, two abstentions) was that-it would rather see the plan as a residential compound. Preliminary Plan Review - Eastfield Village Chairman Madan returned to the meeting at this point. Ralph Maloon, RIM Engineering, presented the plan. The clerk read all of the department comments and said according to the plan, the owners are Steve and Jay Zola, but the Form B was only signed by Stanley Zola. The applicant intends to eventually extend the road into Easton, where they own an additional 32 acres of land. Planner Flynn said she was concerned about the alignment of Noreen and Patty's Roads and suggested the board consider an open space lot. Chairman Madan suggested the applicant not include the future road expansion on the definitive plan. Clerk Sullivan said he thought there should be something on the plan about the road expansion. He added the applicant would need monitoring wells and said he was also concerned about the road alignment. Planner French asked if the site would be on septic if it was approved. Mr. Maloon said it would be, but the lots had not been perked yet. Planner French said he was also concerned about the road alignment. Chairman Madan agreed with the rest of the board about the alignment and added a concern about potential water pressure problems in the area. He requested current hydrostatic test numbers for the area and a plan showing all of the upcoming subdivisions in the area. Planner Annino was also concerned about the road alignment and asked to see what natural vegetation is in the area. Mr. Burke asked what the impact of moving Noreen Road to better align with Patty's Road would be. Mr. Maloon said one lot would be lost. Motion: To deny the preliminary plan based on board and department head comments; especially because sewerage disposal and road offset, and water are not shown, and because the relationship between the site and adjacent properties is unclear. (Sullivan - Annino) All in favor.
