PLANNING BOARD MINUTES TTS
MARCH 24, 1994
PRESENT: Chairman Madan
PLANNERS: Benda, Flynn, Sullivan
Shaun P. Burke, Director of Planning and Development
1. Meeting called to order at 7:00 P.M.
2. Street Acceptance Policy Discussion
The board discussed changing its street acceptance policy.
Mr. Burke suggested making any changes easy to apply and
equitable. Chairman Madan said he was concerned about the
drainage problems many subdivisions may experience in the
spring and said he would rather see the problems after Town
Meeting.
Motion: To revise the Planning Board's policy on street
acceptances to not support any partially completed
streets; to require all streets within a subdivision
to be completed before any are supported for
acceptance; and to require the street, including all
punch list items, to have been completed for one full
year prior to acceptance.
(Sullivan - Flynn) All in favor. PASSES.
Chairman Madan said that since the Planning Board is only
making a recommendation on acceptances to the Board of
Selectmen for their public hearing, why not leave it up to the
Selectmen to inform the residents and developers.
Mr. Burke asked what the board wanted to do about the four
streets it had already voted to support, since their punch
list items had not been done until the previous fall.
Chairman Madan said since the town was the developer, the DPW
would have to do any improvements on those roads.
Planner Benda said because the board had voted to sponsor
those streets before the policy change, it should continue its
sponsorship.
Mr. Burke said he would check to see how long the other
streets on the list had been completed and asked what the
board would like to do about Whitetail Lane. Planner Flynn
suggested talking to the Road Commissioners about their plans

Motion: To support the Planning Board's original four streets
and Ware Street and to check how long Longwood,
Jefferson, Megan's Way, Rosewood, Serena Allen and
Donovan had been completed.
(Sullivan - Bonda) All in favor. PASSES.
3. Zoning Article Discussion
Mr. Burke said he had written to Town Counsel concerning the
pesticide question in Article 8 but had not received an
answer. The Engineering Department had received a letter from
the DEP, but it did not address the issue of pesticide
control. Mr. Burke suggested leaving it in until he hears
from Town Counsel, and if he suggests removing the section, it
can be done at Town Meeting.
Chairman Madan said he was uncomfortable waiting until the
night of Town Meeting to make a recommendation. Mr. Burke
said he had asked Town Counsel for a written recommendation by
April 1, 1994 and suggested meeting on April 13, 1994 to
complete the discussions of zoning amendments.
Chairman Madan asked to have a meeting for April 13, 1994
posted with the agenda left blank except for the zoning
amendment discussion. He also suggested the board go through
the Town Meeting warrant and make recommendations on
appropriate articles.
Mr. Burke told the board it could vote to support Articles 8
and 10 at this meeting and amend the vote at the April 13,
1994 meeting or at Town Meeting, if necessary. Planner
Sullivan suggested leaving the articles as written and
changing them later, if needed.
Planner Flynn said there were a few things the board wanted to
change in Article 8, including increasing the capacity to 115
percent, changing "percable lots" to "lots suitable for
construction ",. changing six feet to 10 feet, and changing
"historical" high water mark to "mean annual ".
Motion: To support Article 8 with the above changes.
(Sullivan - Flynn) Three in favor. One abstention.
PASSES.
Motion: To support Article 10 as written.

4. Correspondence
Motion: To appoint Planner Sullivan Acting Clerk.
(Flynn - Bonda) All in favor. PASSES.
1. Appeal of Building Inspector's issuance of a Building
Permit by Carole and Elizabeth Clemmey.
Mr. Burke said he thought the appeal had no merit, since
there is nothing in the by -law which says access has to be
through the shortest frontage on the lot.
The board discussed the other points of the appeal and
thought the use is a permitted one and could be
recreational, educational or amusement. The board also
thought the facility is a building, according to the by-
law,
Motion: To support the Building Inspector's issuance of a
building permit because the facility is a
permitted use; is a structure and a building; and
has the required frontage. (Sullivan- Flynn) All
in favor. PASSES.
5. Adjournment
Motion: To adjourn at 8:05 P.M. to the Town of Norton Town
Hall, continue the meeting there and adjourn after the
completion of that discussion.
( nn- Sullivan) All in favor. PASSES.
