Public Hearing - Stearns Hill Estates sewer modification
Ralph Maloon, RIM Engineering, represented the applicants,
Jess Realty Trust and Mac Homes in their request to add a
public sanitary sewer to the previously approved 180 -lot
subdivision. The applicants will bring the sewer to Route 106
so it will someday be able to go to the Easton line, if the
town wants. The sewer will not require a pumping station, and
the depths have been raised since the last discussion.
The applicants requested a waiver from the filing fee.
Public Comment
Mike Flynn, 10 Erick Road - Asked if Erick Road would be re-
dug to install the sewer line. Mr. Maloon said the sewer line
already runs up Erick Road and there would be no need to re-
dig.
Bob Flynn, 32 Wexford Road - Asked where the sewer line would
come out in Eastleigh Estates North. Mr. Maloon told him
about half way back in that subdivision.
Bob Morisson, 151 Stearns Avenue - Asked if the sewer would be
brought all the way up Stearns Avenue. Mr. Maloon explained
it wouldn't, since they were trying to avoid the large hill.
He added there would be a hook -up available for future
connections farther up the street.
Patrick Kenny, 19 Erick Road - Asked why the town didn't run
the sewer line up Route 106. Chairman Madan said he thought it
was a money problem at the time.
Board Member Comments
Planner Annino asked what the depth of the deepest manhole
would be. Mr. Maloon responded approximately 34.5 feet.
Planner Annino then asked if the sewer lines would run to the
property lines so others could be hooked up later. Mr. Maloon
said yes.
Planner Annino then asked the applicant why they requested a
waiver from the filing fee. Paul Folkman said they would be
doing $40,000 in off -site work to bring the sewer to the site,
which the town could use later. Planner Annino said other
developers were charged this fee. Mr. Folkman told him the
area in question is environmentally sensitive and he does not
want to put in 180 septic systems.
Clerk McClanahan had no comments.
Chairman Madan asked if the plan for sewer was being done in
harmony with the Master Plan, Mr. Maloon said he did not
know. Chairman Madan asked if the applicant had the necessary
permits from the Board of Selectmen as Sewer Commissioners for
where the sewer will go. Mr. Maloon responded that they had
to receive Department of Environmental Protection ` p nits
first. Mr. Folkman said they had tried to work with where
the town went with the East Mansfield sewer.
Planner Sullivan asked if some of the lots could be put on
septic. Chairman Madan said he had spoken with the Chairman
of the Board of Health, Henry Austin, who said they could not.
Planner Sullivan wanted to know if test holes had been done on
the deepest cuts, Mr. Maloon said they had been done in the
area, though not along the specific planned sewer lines, and
they had not hit any ledge. Planner Sullivan responded he
thought it unlikely to go that deep without having to blast
something and disturbing the abutters. Mr. Folkman said they
were looking at a location for a second easement, which would
eliminate the deepest cuts.
Planner Flynn asked if they received a second easement, would
the deepest cuts indeed be eliminated. Mr. Folkman said they
would, but was unsure about the easement. She also asked for
a copy of the Master Plan sewer plan.
Planner Bonda had no comments.
Mr. Burke said when the subdivision was approved, one of the
board's concerns was that the phases be able to stand on their
own. He asked if the sewer phases would be able to, as well.
Mr. Maloon answered they would stand alone in phases and in
ownership.
Motion: To close the public hearing.
(McClanahan - Annino) All in favor. PASSES.
Motion: To approve the modification as submitted, except for
the last phase, Lots 32 -36 and 72 -76, because of a
possible easement to eliminate the deepest cuts.
(McClanahan - Annino)
Planner Flynn asked if it was the Planning Board's job to
determine whether the applicant adheres to the sewer Master
Plan. Mr. Burke told her it was the Sewer Commissioner's job;
the Planning Board's authority is limited to the site in
question.
All in favor. PASSES.
Motion: To waive the filing fee.
(McClanahan - Annino)
Planner Flynn asked what the difference was between the
Planning Board's fee and the Sewer Department fee for
inspection,
Mr. Burke said he had not known the Sewer Department was also
charging an inspection fee.
Chairman Madan said it didn't make sense to naive the Planning
Board fee. Clerk McClanahan argued that the applicant is
offering to make concessions to the town.
Mr. Burke said the board could not grant a waiver until the
matter was discussed with the Sewer Commissioners, so the
board may want to consider tabling it.
Planner Flynn suggested approving the waiver but having the
applicant come back after the matter was discussed with the
Sewer Commissioners.
Three in favor, three opposed.
FAILS.
Motion: To table the waiver until the applicant gets the
easement straightened out and talks to the Sewer
Commissioners to resolve the fee question.
(McClanahan -
Motion withdrawn.
Motion: Not to grant the waiver.
(Flynn- Bonda) Five in favor. One opposed. PASSES.
3. Public Hearing - City of Attleboro Wading River Pumping Sta-
tion Continued
Planner Flynn removed herself from the meeting, leaving five
planners.
Representing the City of Attleboro were Robert Stoops and Sara
Seckinger from Camp Dresser and McKee and Paul Nicholson,
Attleboro Water Superintendent
Mr, Stoops went through the memorandum sent to the board
addressing all department head and board comments.
Public Comment
Leonard Flynn, 102 Jewell Street - Said he still has questions
about the poor condition of the dam on the site and about the
city's plans for Blake's pond. Mr. Stoops explained there is
a grate to reduce silt and other material from getting into
the pond, and that the city plans to remove 90 cubic yards of
material. He added that the site work will have no impact on
the dam.
Mr. Nicholson said the city has not plans to improve the dam
at this point and added it is not in danger of collapse. He
was not opposed to calling Dam Safety for an inspection.
