A resident of Mansfield, Karl Clemmey, stated that he is opposed to the plans and that the review of the plans should have begun with the Planning Board. 5. 8:00 P.M. = Rezoning Petition of Michael Morizio Clerk Cadden read the public hearing notice. Michael Morizio presented the requested zoning change to the Planning Board and to the public. Michael Morizio. is petitioning to rezone Assessors Parcel 29 of Map 10 and a portion of Assessors Parcel 8000 of Map 44 from Industrial 1 to Residential 1. Mr. Morizio stated that the presently zoned industrial land is not accessible through the adjacent industrial land but only through residential land. Mr. Morizio also stated that he would like this area rezoned for the purpose of residential harmony. Public Discussion: Faith Williams, 9 Old Elm Street, stated that she signed the petition to rezone this area because there is presently a great deal of water in the area and an industrial use may increase the water. Mrs. Williams also stated there is a great deal of natural wildlife in this area. Karl Clemmey, West Street, stated that he is concerned because the subject area was already zoned industrially at the time the - abutting property owners bought their homes. Mr. Clemmey also stated that the meets and bounds, as well as engineered plans, of the area to be rezoned should be submitted. Mr. Clemmey also asked the Board to look at both the advantages and disadvantages of this area being zoned either Industrial -1 or Residential -1. Jean Nordberg, 242 School Street, referenced the number of homes which have been built in Mansfield in the last couple of years. Ms. Nordberg stated that she does not think Mansfield needs any additional residential land but that it does need to preserve the industrial land. i Faith Williams, 9 Elm Street, stated that she would like the area to stay exactly the way it is (undeveloped). Michael Morizio, 857 School Street, stated that he too would like the land to stay in the same state as it is now. Mr. ( Morizio also stated that the only zoning issue is residential harmony, that he feels the area was miss zoned, and he thinks it is the Planning Board's charge to review the industrial and residential areas and ensure preservation of their uses. Karl Clemmey of West Street stated that maybe the Plymouth Street play fields should have been located on this property rather than the proposed area on Plymouth Street and maybe it should not be rezoned at this time but rather be included in a study. Mr Clemmey stated that he would like the land left industrial. Board Comments: Planner Flynn questioned the abutting zones. Clerk Cadden stated that it may be better to leave the land industrial. Shaun Burke, Director of Planning and Development, stated that he feels that there is a greater incentive for the land to be developed industrially rather than residentially. Faith Williams of 9 Elm Street asked what the Planning Board's authority is and what role abutters may play during the permitting process for developments in this area. Planning Director Shaun Burke stated there is a site plan approval process in which the Planning Board gives a recommendation to the Inspector of Buildings on the site and that there are also buffer by -laws in the Zoning By -Law which must be adhered to. Chairman Madan stated that there is not a lot of public input during the site plan review process. MOTION: To close the public hearing. ( Cadden- Flynn) All in favor. PASSES. A concensus of the Planning Board was to wait until the conclusion of all zoning amendments public hearings before making recommendations on any of the amendments. 6. 8:45 P.M. Zoning By -Law Amendments Public Hearing Clerk Cadden read the public hearing notice. Planning Director Shaun Burke presented the first Zoning By -Law amendment to be discussed, Regulated Refuse Incinerators regulations. ( Mr. Burke stated that there are many minor but significant changes proposed to the current by -law which come as a result of the Medigen facility in Foxboro. The current by -laws in Mansfield would allow the Medigen facility to operate in Mansfield unregulated. The proposed amendments would prohibit smaller facilities and allow larger facilities by special permit. The by -law amendments are mainly technical changes such as renumbering paragraphs; however, there are new paragraphs proposed also. Public Discussion: Karl Clemmey of West Street questioned Section 5.9.3.4 Protected Uses setbacks. *8:55 P.M. Planner Annino entered the meeting. Public Discussion: Karl Clemmey of West Street questioned the amount of wetlands on the proposed recreational facility site on Plymouth Street. Shaun Burke, Director of Planning and Development, presented the last proposed zoning amendment to be discussed at this hearing, the addition of a Temporary Uses by -law. Mr. Burke stated that this amendment is a result of several temporary non - profit organization fund raising events occurring in Mansfield witout the benefit of the use being defined as allowable in the Zoning By -Law. Public Discussion: Karl Clemmey questioned if Great Woods fairs would fall under this by -law. Board Comments: Clerk Cadden questioned the restrictiveness of the number of days the use would be allowed and who would obtain the permit. The Planning Board discussed whether or not churches should fall under this by -law or if they should be exempt. Planner Sullivan expressed_ concern over the number use would be allowed. of days the Planner Flynn asked if site plan approval would be required for temporary uses. Planning Director Shaun Burke stated that this may be too costly for a non - profit organization. Karl Clemmey of West Street asked if the Great Woods antique show would fall under this by -law.
