MINUTES
February 17, 1993
PRESENT: Chairman Madan, Acting Clerk Flynn
PLANNERS: Caponigro, McClanahan *, Sullivan
1. Meeting called to order at 7:30 P.M.
2. 7:30 P.M. - Discussion with South Park Lane Residents
Residents of the South Park Lane subdivision attended the
Planning Board meeting to express concerns over drainage
in their back yards. During the discussion, residents
submitted pictures of standing water in their yards.
*7:40 P.M. Planner McClanahan entered the meeting.
Representatives of East Coast Development showed the
residents and the Planning Board preliminary plans to
correct the drainage problem. In order to go ahead with
the plans, East Coast Development will have to retain an
easement from a homeowner in the area because the
drainage area is privately maintained as well as
privately owned by the homeowners in the area.
The Planning Board stated that they would like to receive
input from the Town Engineer, Bob Swanson, prior to
making any decisions on the developer's proposal.
At the end of the discussion, a consensus of the Board
was to continue this discussion to March 3, 1993 at 7:30
P.M. if input has been received by the Engineering
Department by that time.
MOTION: Planner Flynn to act as Clerk.
(McClanahan - Madan) All in favor. PASSES.
3, 8:00 P.M. - Appletree Farm - Definitive Subdivision Plan
Public Hearing
Acting Clerk Flynn read the public hearing notice.
Ralph Maloon of Rim Engineering presented the proposed
seven lot subdivision plan to the Planning Board and the
public. All of the 'lots perk at under- two minutes per
inch; the land is gently graded towards the river until
it gets closer towards the wetland and it is relatively
steep. There is little runoff from the land. The
roadway is three hundred and forty -two feet long to the
center of the cul -de -sac.
Following the presentation of the plan, Acting Clerk
Flynn read Department Head comments from the Police
Department, Fire Department, Engineering, and the Light
Department.
Public Comments:
Carol Andrews, 211 Willow Street, stated that she is a
direct abutter to the land but was not included on the
abutters list.
Apparently, abutters to the "remaining land" owned by the
applicant were not notified of the public hearing.
Chairman Madan informed Mr. Maloon that he is at risk for
a procedural defect because all abutters were not
notified and suggested that the hearing be readvertised
ad all abutters notified. Chairman Madan also questioned
why the scenic road hearing is not being held
concurrently with the subdivision public hearing.
Mr. Maloon stated that he was waiting to hold the scenic
road hearing until he received all Department Head
comments and then would file for the hearing at the same
time as filing for Conservation.
Planner Sullivan stated that it is his opinion that the
filing fee should be adjusted for eight lots, which would
include the "remaining land ", rather than seven.
MOTION: To continue the public hearing to March 31, 1993
at 8:00 P.M.. The applicant shall readvertise,
notify abutters, and pay the balance of the
filing fee.
(Flynn - McClanahan) All in favor. PASSES.

zg, Public Discussion
Karl Clemmey stated that he feels that applicants for
variances should be made aware of the time that the
Planning Board will be discussing their request and,
making a recommendation to the Zoning Board.
Chairman Madan informed Mr. Clemmey that the Board has
discussed this in the past, and the Board is not of the
same opinion as he because they are only making a
recommendation.
Mr. Clemmey stated that he hopes the Planning Board
studies the Plymouth Street project as closely as they do
other projects in Town. Mr. Clemmey also stated that he
hopes the Planning Board will request that the Special
Town Meeting be held after the Annual, since a quorum
could not be reached at the original Special Town
Meeting. Mr. Clemmey was informed that the order of
articles or the Special and Annual Town Meetings is not
within the Planning Board's jurisdiction.
