Ken Smith stated that the roadways had been cleaned today. East Coast is in the process of hosing down trucks as they come out of the subdivision and putting hay bales on the side of the road to prevent runoff. Planner Flynn questioned if there is going to be enough room on East Coast Development's property to plant street trees without going onto Mrs. Fuller's property, as mentioned in her letter. Ken Smith stated that there is enough room for the street trees and that he is going to be meeting with Mrs. Fuller to explain the subdivision plans to her. Planner Flynn asked that East Coast Development keep the Planning Department or Planning Board informed of their situation with Mrs. Fuller. Planner Flynn also asked if notes have been put on the deeds of lots within Deerfield Village regarding driveways and requested a copy of same. Mark Blanchette's attorney, Steve Fallon, presented the request to rezone Parcels 7 and 8 on Assessor's Map 12 from Residential -1 to Industrial -1 which would allow Mr. Blanchette to run a rug business on his property. Attorney Fallon submitted a traffic study of the subject area to the Planning Board. Public Discussion Joseph Longever, 10 Shaun Drive, requested the Board support the proposed rezoning because the property is somewhat surrounded by train tracks, highway, and School Street. Mr. Longever also stated that he feels Mr. Blanchette operates his business well. Rebecca White, 280 School Street, inquired about the results of the traffic study. Ms. White also stated that rezoning the property to Industrial -1 will allow a variety of different uses, strip malls, etc. Ms. White also stated that she is opposed to the proposed rezoning. Karl Clemmey, 350 South Main Street, asked why the Planning Board is holding this public hearing when the applicant only has ten signatures on his petition rather than one hundred signatures for a Special Town Meeting, as required by the Town Charter. Chairman Madan responded that the Board of Selectmen voted to the put the article on the warrant; therefore, the Planning Board is required to hold the public hearing. Rebecca White, 280 School Street, questioned the order in which this hearing and the proposed moratorium are being held and if the Board is going to assume that Parcels 7 & 8 are industrially zoned during the moratorium hearing. Chairman Madan responded that it is difficult to hold two such hearings in one night and that the Board is not going to assume that Parcels 7 & 8 are industrially zoned at the moratorium public hearing. Board Member Comments: Clerk Cadden asked Chairman Madan to give him the history of Parcels 7 & 8. Chairman Madan stated that the parcels were not forgotten during the Master Plan rezoning but were intended to be zoned residentially to act as a buffer. Planner Flynn stated that there is already enough industrially zoned land in the Town. Planner Annino questioned the zoning around Parcels 7 & 8 and listed uses which would be allowed on the parcels if rezoned. Planner Annino expressed concern of bringing the Industrial Zone across Route 495 to residential uses ( across the street. Chairman Madan informed Air. Blanchette that two- family dwellings are not allowed in the I -1 zone and asked him if he is complying with the Zoning Enforcement Officer's cease and desist. Chairman Madan also asked if Mr. Blanchette would like both the two- family and a business on the same property, which are each allowed in separate zones and why the zoning change would be in the best interest of the Town. Mark Blanchette responded that it is zoned industrially basically on three sides of his property and that he cannot use it as residential property. At this time there was a discussion of placing a covenant on the parcels which would only allow certain uses. Attorney Fallon stated that he feels that this zoning change would be in the best interest of the Town because he feels that it would encourage young people to stay in the Town. Planner McClanahan stated that he would like to take a look at the property. Planner Caponigro questioned the propriety of the submission of the petition with regard to the number of signatures and expressed concern that the applicant would like both a residential use (two- family dwelling), and an industrial use (carpet business) on the same property. Joe Longever stated that there is Industrial land bordering Mr. Blanchette's property and that he feels that the road has already been destroyed. Planner Annino asked that the Board find out why there are not the required one hundred signatures on the petition. Chairman Madan responded that the Board of Selectmen has the option of putting the article on a Special Town Meeting warrant if there are less than one hundred signatures but they have to if there are at least one hundred signatures. MOTION: To close the public hearing. (McClanahan- Annino) All in favor. PASSES. Planner Caponigro left the meeting at this time. 4.
