MINUTES
January 27, 1993
PRESENT: Chairman Madan, Clerk Cadden
PLANNERS: Annino *, Caponigro, Flynn, McClanahan *, Sullivan
1. Meeting called to order at 7:30 P.M.
2. 7:30 P.M. - Discussion with Karl Clemmey
Karl Clemmey requested the Planning Board's input on a zoning
change that he may be submitting for inclusion on the Annual
Town Meeting warrant. The proposed zoning change is for land
bounded by Route 140, South Walnut Street to the west, the
Cabot Industrial Park to the South, and West Street to the
North. Mr. Clemmey would like to extend the Industrial Zone
further into the existing Residential Zone to accommodate
parking requirements on the Industrial lot.
Mr. Clemmey also requested the Board's input on one private
road servicing both a cluster development on the residential
property and an industrial use on the adjacent lot.
The Planning Board expressed concern over the buffer zone
between the industrial and residential property, illusionary
frontage on Route 140, principal verses accessory uses on the
industrial lot, ( *Planner Annino entered the meeting - 7 :50
P.M.), and a private vs. public roadway ( *Planner McClanahan
entered the meeting - 7:55 P.M.).
Planner Annino suggested that one main access road be used for
both the residential and industrial land; maybe a boulevard
could act as a buffer.
Chairman Madan suggested that Mr. Clemmey submit the exact
meets and bounds of the parcel to be rezoned with the article.
At the end of the discussion, the Planning Board tentatively
scheduled another discussion with Mr. Clemmey for February 17,
1993.
3. Special Town Meeting Article Recommendations
A. Zoning Map Amendment - Mark Blanchette
MOTION: To recommend against the article at Special Town
Meeting for the following reasons:
1. It derogates from the intent of the Zoning By-
Law.
2. It's not in harmony with the residential
neighborhood.

3. It's not consistent with the Master Plan.
4. The hardship demonstrated by the applicant
is self - inflicted.
5. It sets bad precedent.
(Cadden- McClanahan) (6 -0 -1) Planner Sullivan
Abstains. PASSES.
Prior to voting on the above motion, the Planning Board
discussed the zoning map amendment stating that it could be
considered almost spot zoning, there could.be potential for
a bad traffic situation, and that the subject parcels are
within the "study area ".
B. Moratorium Article Sponsored by the Planning Board
MOTION: To support the moratorium article at Special Town
Meeting.
(Annino- Flynn) (3 -3 -1)
Prior to voting on the above motion, the Planning Board
member discussed arguments for and against holding a
temporary moratorium, such as-- landowners grandfathering
land within the study area prior to the conclusion of the
study, traffic issues may be studied, it world enable
stricter guidelines to be developed, there ^no.apparent
infrastructure problem to back a moratorium, only a fraction
of the land within the study area may be impacted by the
Lego Development, it is unfair to a small group of
landowners within the study area that would be affected,
narrowness of study area, residential moratorium should be
talked about, and the lack of residents speaking in favor of
the moratorium.
After the vote of whether or not to support the article at
Special Town Meeting, the Board discussed the procedure in
which this article will be presented at Special Town
Meeting. A consensus of the Board was for Shaun Burke,
Director of Planning and Development, to give a technical
presentation the townspeople, after the presentation two
Board members, one in favor and one opposed, will each
present the reasoning for their support or lack of.
8:40 P.M. The Planning Board went on break for ten minutes.
*Planner Sullivan excused himself and left the meeting room during
the following discussion:

MOTION: To send negative recommendation to the Zoning Board of
Appeals. The applicant should explore other

to the lot for fire and other emergency apparatus and
would also alleviate address problems.
( Annino- Sullivan) All in favor. PASSES.

`i

Planning Director Shaun Burke asked the Board members if they
would like the article format within the warrant to include
both existing and proposed by -laws. A concensus of the Board
was to include the existing and proposed by -laws.
Planner Flynn suggested that the public hearing ad for the
zoning by -law amendment public hearing include a synopsis of
each amendment to generate public interest. Planner Sullivan
stated that legal problems could arise if including a synopsis
in the ad because of different interpretations of the
amendment.
Planning Director Shaun Burke asked if the Planning Board would
like him to draft a zoning by -law for non - residential findings
followed by a special permit. A concensus of the Board was in
favor of drafting a by -law for structure but not use non-
residential findings.
Chairman Madan suggested that findings for non - conforming uses
also be looked at. (This will be discussed at a later date.)
