Public Hearing - Carlton Estates preliminary Engineer Mike Trowbridge, Hutchins /Trowbridge Engineering, representing Wading River Realtv Trust, presented the preliminary plan for a subdivision located off of West Street. Department Head Comments Light Department - Plan appears ok Police Department - Appears ok - show streetlights on plan, address possible traffic problem Douglas Drive onto West Street. Conservation - May need to file applications with Conservation office depending on where the houses go in relation to the wetlands. Engineering - Calculate sight distance, proposed contour lines, 100 -year flood, drainage calculations. Public Comment There was no public comment. Board Member Comments Planner Flynn asked about moving the egress of Douglas Drive to address the Police Department's concerns about traffic. Mr. Trowbridge said moving the road would make the turn too sharp and he questioned how the Police Department came up with its distance of 195 feet when the center line of West Street is not marked. He said it was unlikely the Police Department could have measured the distance that exactly. Planner Sullivan asked about the sidewalk. Mr. Trowbridge said the sidewalk would go around one side of the project. Mr. Trowbridge said he would like the board to consider allowing him to deviate from the traditional catch basin design, and instead spread the detention area around to make it more gradual, more shallow and more attractive. Chairman Madan said the board would probably be interested in seeing such a proposal. Mr. Trowbridge said he would mark the center line of West Street on the definitive plan. Planner McClanahan asked if the applicant would be applying for any waivers. Mr. Trowbridge said they would if the board agreed to do a variation on the drainage area. Planner Caponigro suggested that the former resident of the land, Carlton Shepard, never had an accident leaving the site, it shouldn't be a problem. Mr. Burke said he had spoken to Mr. Trowbridge about revising the drainage area and witnessed several perc tests. He said the area seems to be able to handle a lot of storm water. He suggested getting away from the typical hole in the ground drainage system and suggested that by doing this, the town would not have to maintain a fence or deal with abatements. Planner Sullivan suggested doing permeability testing to account for the soil being able to handle large amounts of water. Planner Flynn asked how close the project would be to the Wading River. Mr. Trowbridge said on average, it would be 250' from the wetlands and 280' from the river itself. He said at its closest point, it would be 160' away from the river, but that the subdivision would be 20' higher than the river. Mr. Burke asked if the board wanted to discuss the environmental impact issues. Planner McClanahan said the applicant should take special care so close to the Wading River. Mr. Trowbridge said he had done an Environmental Impact Report for another project he worked on, Riverwood, in 1989, and the board had been happy with it. Planner Sullivan asked if there would be individual septic systems in the subdivision and said there was some concern about nitrate loading on the river from these systems. Motion: To give the applicant a positive recommendation to continue with the plan, addressing all department head and board member comments. (McClanahan - Caponigro) All in favor. PASSES. 5. Site Plan Review - Revised 310 North Main Street Ralph Maloon, RIM Engineering, representing applicant Mary Steele, told the board what had been changed on the revised plan. Changes included showing the lighting, a right of way for parking, plantings, removal of chain link fences, raised stoops /bollards, drainage, traffic pattern, parking spaces, and sight distances. Board member comments Planner Flynn asked about the possibility of getting more parking spaces, Planner Sullivan asked if the applicant had sent a copy of the legal agreement for the parking right of way to the building inspector. Edward Valenzola said they had not, but planned to. Planner Sullivan said he thought the applicant had met most of the requirements set by the board at the first site plan review. Chairman Madan said according to the zoning by -law, the applicant did not have to supply off - street parking, but since they were, they should comply with zoning as much as possible, which he thought they were doing. Clerk McClanahan did not have any comments. Planner Caponigro said he thought it was a good idea for revitalizing the downtown area. Mr. Burke said the Inspector of Buildings would have to make the call on the parking situation but said according to the zoning by -law, the applicant did not have to supply off - street parking. Since they are, however, it shall be in accordance with Section 4.4 of the by -law. He said the proposed parking would make the situation better, but the applicant would still have to follow the by -law. Mr. Valenzola said the applicant had tried to comply as much as possible. Chairman Madan asked Mr. Burke to read the section of the by- law that addressed this situation. Mr. Burke said the situation goes to the design standards section for parking and is covered by all of Section 4.4. Planner Caponigro said the board should decide on the issue and if anyone had problems with the decision, they could challenge it, Mr. Valenzola said the building was built around the turn of the century and is on its own lot; it is in the original footprint. Motion; To send a positive recommendation to the Building Inspector. (Caponigro - McClanahan) Discussion Planner Caponigro said this would be an improvement of the site and Main Street needs a project like this. Chairman Madan said he agreed but said it would ultimately be up to the Building Inspector, not the Planning Board, which should just point out its concerns in its recommendation. All of the board members said they thought the parking situation should be brought to the attention of the Building Inspector. Planner Sullivan suggested noting that this would be an improvement and the site does have cross - parking. Add to the motion the board felt the parking issue should be brought to the attention of the Building Inspector, that this would be an improvement and that the site has cross - parking. All in favor. PASSES. 6. Around the Table Mr. Burke told the board there was a Great Woods Land Use Study Workshop and a public hearing scheduled for the December 1, 1993 meeting. The public hearing will be on the reconsideration of the rescission of approval on Van Gemert Farms, Planner Flynn asked if a letter had been sent to the Board of Selectmen regarding suing Folkman and Zola. Mr. Burke said it had not, but he planned to take care of it. Mr. Burke reminded the board that Planner Caponigro's last meeting would be December 15, 1993 and asked if the board would like to do something for him. Regarding the 310 North Main Street site plan, Mr. Burke told the board whether it agreed additional parking improved the site was beside the point, since it is not up to the Planning Board to enforce zoning. It should just bring up the points it has concerns about in its recommendation to the Building Inspector. 7. Adjournment Motion: To adjourn at 9:00 P.M. (Flynn- Sullivan) All in favor. PASSES. Date of next meeting: December 1, 1993 at 7:30 P.M.
