OCTOBER 27, 1993
PRESENT: Chairman Madan, Clerk McClanahan
PLANNERS: Annino, Caponigro, Flynn, Sulliva.p,'
Shaun P. Burke, Director of Planning and Development
1. Meeting called to order at 7:30 P.M.
L. Site Plan Review - 310 North Main Street
Applicant Mary Steele came before the board with a plan to
refurbish and rent the building at 310 North Main Street, the
site of the former Sannie's department store.
Applicant stated that the building would essentially stav the
same, but there would be a 30'x10' addition and the property
would be rented to seven (7) tenants. In response to
questions from Planner Sullivan, the applicant said the
lighting and dumpster would remain the same, but the parking
lot would be redone by removing the old pavement and
repaving. The grading would change to provide drainage away
from the building. In addition, a new drainage system would
be installed, Applicant said she also planned to add
landscaping and plantings to the parking lot area.
Planner Annino said he would like to see more detail shown on
the plan for a variety of things, and that without details,
the site plan was unacceptable. (See motion)
Planner Caponigro said it was good to see local people using
downtown buildings and suggested the board make a positive
recommendation but include all of Planner Annino's previous
comments.
Planners McClanahan and Flynn had no comments.
Shaun Burke, Director of Planning and Development, said he
was concerned about traffic flow in the parking lot and
suggested making it one -way. He said he was also concerned
about visibility when exiting the parking lot onto North Main
Street.
Motion: To send a positive recommendation of the concept to
the Building Inspector but to withhold the right to
further comment until seeing the revised plan and to
note that the following should appear on the revised
plan:
1. detail of proposed lighting and foot candle
distribution;
2. location and screening of dumpster;
3. cross easements in the parking areas;
4. detail of planting and landscaped areas;
5. removal of fence at Old Colony Way access;
6. calculation of required and provided parking
spaces for uses within the structure as well as
adjacent uses that will be sharing parking
spaces;
7. data showing that adequate sight distance
exists on entrances and exits;
8. bollards at doors or raised door stoops to
safeguard persons entering and exiting the
structure;
9. determination of the function of the oil gate
valve in the parking lot;
10. dimension of parking spaces and width of
parking aisles;
11. wheelstops for proposed parking spaces
adjacent to structures;
12. details on changes to parking lot;
13. details and calculations on new drainage system;
14. details on use of parking lot material to
fill foundation after moving house currently at
10 Thomas Street; and
15. that all department head comments be addressed.
(Caponigro- McClanahan) Three in favor, three
opposed. FAILS.
Motion: To send a positive recommendation on the
concept for the building permit to the
Building Inspector, including the fifteen
(15) conditions from the above failed motion,
and to have the applicant resubmit a complete
site plan to the Planning Board for review
and comment before any site work is done.
Suggest to the Building Inspector a final
occupancy permit not be issued until a
revised site plan has been submitted and the
work completed.
(Sullivan - Flvnn) Five in favor, one opposed.
PASSES.
Public Hearing - Hodges Brook modification
Chairman Madan excused himself from the public hearing.
Applicant Jack Smith came before the board to request
permission to construct a temporary 850' cul -de -sac, which
would allow him to build the first half of the road to base
coat, and bond the second half before beginning construction.
He said he would like to have the first half done to binder
by December 15, 1993, and the second half in the spring of
1993.
Department Head Comments
The Engineering Department said the temporary cul -de -sac
should be paved and be part of the drainage system.
Planning Board Comments
Planner Flynn said she would prefer to see a 650' cul -de -sac
if only part of the subdivision will be done. Mr. Smith said
a 650' cul -de -sac wouldn't reach the detention area.
Planner Sullivan suggested a temporary drainage easement.
Planner Caponigro suggested building the road as houses are
built and sold.
Engineer Ralph Maloon said they would rather bond part of the
road and use a temporary cul -de -sac, and that they were
willing to get enough of a bond to complete the whole road in
case something went wrong.
Mr. Burke said he would rather the applicant put in an 850'
cul -de -sac and get the drainage as close as possible to where
it will ultimately be rather than put it in at 650' and have
to dig it up and redo the drainage later. He suggested
putting a time frame for completion or the board consider
recision.
Public Comment
Phil Spillaine of 6 Trowbridge Lane, Barbara Stratton of 158
Tremont Street, and Nancy Kitchen of 98 Tremont Street said
they were concerned about the area's flooding problems.
Mr. Maloon said they would not be draining Tremont Street or
the other surrounding streets, but that they would be putting
extra catch basins in at the entrances to the subdivision,
which would help the drainage in the neighborhood.
Sr. Smith offered to run extra drainage lines and tie them
into Tremont Street, and to install an extra catch basin if
the town bought the materials.
Motion: To grant the request for a waiver to install an 850'
temporary cul -de -sac based on the ability of this
length to allow construction of the major portion of
the previously approved drainage system.
( Caponigro- Sullivan) Two in favor, two opposed, one
abstention. FAILS.
Motion: To approve the plan for an 850' cul -de -sac with the
following conditions:
1) the temporary swale at the end of the cul -de -sac
will have a temporary drainage easement;
2) there will be a catch basin installed by the
applicant on Tremont Street with town approval
and if the town will buy the materials, tied into
the subdivision's drainage system by the
applicant, prior to base coat;
3) the applicant will provide capped sewer stubs
along the back of Lots 21 and 22 and drainage
easements along the back of the lots;
4) debris will be cleaned up and access to the
subdivision will be controlled during all phases
of construction;
5) base coat will be completed by August 1, 1994
or approval will be reconsidered;
6) there will be sufficient bond to install a
permanent cul -de -sac.
(Sullivan - Flynn) Four in favor, one abstention.
PASSES.
Motion: To send a letter to the Road Commissioners with a
copy to Engineering saying Mr. Smith offered to do
the catch basin and drainage installation on Tremont
Street if the town will supply the materials, and
would like to begin work as soon as possible. Board
requests the town act on this quickly, since paving
of the subdivision is expected soon.
(Flynn - Sullivan) Four in favor, one abstention.
PASSES.
4. Zone II Workshop
Representatives from the Health, Conservation and Engineering
Departments attended the workshop, and discussed with the
Planning Board plans for revising Zone II zoning. The
Department of Environmental Protection has provided a list of
failings in Mansfield's current Zone II zoning. Some of the
things discussed at the workshop are as follows:
Existing uses in Zone II areas are grandfathered, such as the
DPW's underground storage tanks.
If the town does Zone III zoning, it would also cover
everything under Zone II.
The DEP requested trying to get together with neighboring
towns to try to get the zones to meet across town lines.
If the town drafts a Zone II by -law, the DEP will provide
technical services.
Conservation agent Richard Lewis suggested requesting maps of
other towns' Zone II areas to keep Zone II consistent in the
area. He also suggested sending information sheets home
through the schools or a mass mailing.
Health Agent Scott Leite suggested presenting the Zone II
zoning at Town Meeting as everyone's problem concerning water
quality, not just something the town wants to do.
Mr. Burke suggested drafting a by -law using recommendation
from other departments and help from the DEP before the Ash
site is brought on line.
Motion: To get the Zone II zoning onto the spring Town
Meeting warrant.
(Annino- McClanahan) All in Favor. PASSES.
5. Form A (ANR) Plans
Karl Clemmev came before the board to request approval for
three lots on Perkins Avenue, which had already been created
by a subdivision in 1989. He requested a waiver of the fee,
since a subdivision fee had already been paid.
Motion: To sign the Form A.
(Annino - McClanahan) All in Favor. PASSES.

and the intended use derogates from current Zoning
Law.
(Flynn - Annino) Three in favor, one opposed, one
abstention. PASSES.
Letter from the Board of Selectmen requesting the Planning
Board change its meeting night.
Motion: To let the Board of Selectmen know the Planning Board
