7. Discussion with Paul Folkman Regarding Beaumont's Pond
Modification
Paul Folkman asked the Planning Board for assistance in
working with Mr. Penney to settle an agreement for an easement
on Mr. Penney's property to construct an access road to the
Beaumont's Pond subdivision without having to construct a
retaining wall. Mr. Folkman referenced a letter that he has
recently sent to Mr. Penney regarding terms of the easement.
Planning Director Burke referenced the George Fram Estates
public hearings in which he worked with the- developer and
abutters in order to settle easement agreements. Mr. Burke
also stated that he does not want the modification hearing to
get constructive approval because of expiration of the time
frame for filing the decision due to lack of an easement
agreement.
A consensus of the Board was if Mr. Burke feels it would be in
the best interest of the Town to work with both parties than
he may. However, if an agreement cannot be reached, then the
retaining wall will have to be built.
Mr. Folkman will update the Board at its meeting of June 10,
1992.
