Motion: To open the public meeting for the purposes of entering into Executive Session to discuss litigation
matters. Public meeting will be reconvened to adjourn only.

Elizabeth explained that out of the list of all the consultants with P.W.S.'s that had been provided to the Attorney for
Mr. Wolfe, the consultant they ended up choosing was not a P.W.S., Mark Maganello from LEC. Mr. Maganello
will be meeting with Scott Goddard, M[r. Wolfe's wetland consultant, to walk the site. It looked like the meeting
would be either on Monday or Tuesday, the 23`d or the 20. There was some discussion regarding the dates for
walking the site with the Consultants and whether the Commission was available to attend. It was decided to just
set up the meeting and those who could attend would.
Elizabeth explained that Mr. Maganello would also like to have the opportunity to view the site before meeting
with everyone. Although this would be preferable Mr. Wolfe and his attorney have insisted that their consultant
be there to walk the site with the Commission's consultant, Mr. Maganello. That meeting will probably take place
later this week.
On another matter the Commission voted to approve the allocation of up to $6,000.00 from the Wetland
Protection Act fund to be payable to the Commission's attorney, Ken Whittaker, for legal services rendered on the
Gilbert Street SORAD appeal. Carole made the motion, Michelle seconded it. Motion passed 6 -0 -0.
Motion: To close the Executive Session at 9 25 pm and return public meeting.
