Motion: To open the public meeting for the purpose of entering into Executive Session to discuss litigation
matters having to do with the Lot 4, Gilbert Street, DEP #211 -0878. Public meeting will be reconvened for
the sole purpose of adjournment.

Vote: 5 -0 -0 Passes
Carole Matthew had been unable to attend the appeal pre- hearing therefore the Conservation
Commission gave a brief review of last Tuesday's meeting with Gary Makuch and his counsel David
Bragg, Pamela D. Harvey, Presiding Officer MassDEP Office of Appeals and Dispute Resolution, Mr.
William Wolf and his representatives - Scott Goddard and Atty. Wattsky. Mr. Ken Whittaker acted
as counsel for the Commission.
The Commission voted to approve the "General Structure of the Settlement Agreement" for Lot 4
Gilbert Street, 5 -0 -0. The Commission voted to empower both Elizabeth and Mike Healy to
negotiate /discuss any non - material terms as advised by counsel that may arise during the
settlement.
Motion: To close the Executive Session and return to the public meeting.
