I 1. Meeting opened at 7:00 pm. I 2. Notice of Intent: Stan Feck, Christian & Feck Development -Dolan Estates,WareSfreet, Map 32,YarceI13; #2lF0856 Construction of a four iot cluster subdivision with related grading and utilities. Due to limited access approximately 6,190 square feet of wetland filling and a stream crossing is proposed. Applicant requested a continuance to March 21, 2011. Derek House made the motion to continue the hearing for Dolan Estates, Ware Street to March 21, 2011. Michele White seconded the motion. Motion passed 5-0-0. 13. NoticeoflntEmb Stephen Mancinl,Mansfleld Realty, LLC, 111 Plymouth Street,Map14, Parcel 802. #211- 0862 8rian King, Crossman Engineering, Scott P. Rabideau, Natural Resource Services, Inc., Paul Castagliolo, Mansfield Realty, LLC, Dave Socci, Mansfield Realty, LLC, Stephen Mancini, Mansfield Reaity, LLC. The Notice of Intent was filed for Belknap White Alcco for a new loading area along the building's northerly wall at grade, a new driveway from Plymouth Street to the new loading area for delivery trucks and proposed culvertlstormwater infiltration basin. The proposed driveway would require the crossing of a stream and would be in the riverfront area. The roadway falls entirely within the 200 ft. Riverfront Area of Hodges Brook. The hearing was continued from the November 15, 2010 meeting. Scott Rabideau, a Wetland Biologist and Professional Wetland Scientist of Natural Resource Services, Inc. was asked to do an outline of the DEP Performance Standards applicable to this project and a Wildlife Habitat Evaluation. He said the Notice of Intent was filed to allow the crossing of an intermittent stream to access the property for the continued and expanded use of the business. He told the board on-site resource areas include two perennial streams, a pond and the associated 100-foot buffer zone and the 200-foot Riverfront areas. The streams are located along the eastern and southern property lines. The pond is located southeast of the project. Water enters the pond from the intermittent stream as well as drainage from culverts located in the northeastern part of the pond. There is also an unnamed perennial stream off-site within the 200 ft. Riverfront Area. Mr. Rabideau said portions of the Riverfront Area are maintained as lawn. Mr. Rabideau told the board there will be 9,500 sq. ft. of impact to the inner and outer riparian zone. The applicant is proposing approximately 12, 000 sq. ft. of mitigation in the lawn areas that are immediately adjacent to the Intermittent stream. These areas will be re-vegetated and allowed to revert back to a natural state. The applicant will be altering Bank because of the proposed stream crossing. This is fully consistent with Mass River and Stream Crossing Standards; a 3-sided box culvert is proposed and meets the openness ratio. The board had asked for a Wildlife Evaluation (Appendix A); a long term study on the site had not been done to determine the wildlife habitat. The applicant had identified resource areas but not the characteristics of the habitat. The board wanted a more detailed report on what is currently on site and what is utilizing the site. A detailed Wildlife Habitat Evaiuation, following DEP guidelines, was done in January 2011 to assess wildlife habitat functions and to identity travel corridors within the immediate vicinity of anticipated impact areas. Off-site resource areas were aiso evaluated, namely the 200 ft. Riverfront of Hodges Brook. Elizabeth told Mr. Rabideau the Wildlife Habitat Study was very well done. Brian King reviewed the Alternative Analysis for the driveway with the following options: Option 1. No-Build Alternative - Brian King toid the board Belknap White Alcco needs to upgrade their shipping process to rneet the current demands of the industry and to provide a more efficient and safe way to load and unload delivery trucks. Belknap has two methods of loading/unloading trucks. Trucks are loaded from either a 4 ft. high loading dock or they are loaded at-grade. The current loading area has the 4 ft. high loading dock and is not suited for the at-grade type loading. Using this area for at-grade loading has been conducted outside and has resulted in damaged product and employee safety issues. The additional loading area is necessary to allow for at-grade loading inside the building. This area can not be modified to accommodate the new loading dock. Option 2. Building Alternative - Northwest Access, 145 Plymouth Street. Applicant made several attempts to obtain permission from 145 Plymouth Street. Belknap White Alcco would install a new driveway off the driveway at 145 Plymouth Street for access to 111 Plymouth Street. Brian King told the board a certified letter was sent to the owners of 145 Plymouth Street; the owner will not give permission to use the existing driveway or their property for access to the proposed loading area because of security issues. Option 3. Building Alternative - Northeast Access. A 183-space parking lot used by employees and visitors to Belknap offices is located to the northeast of the proposed loading area and a vacant office unit. Belknap employees, visitors and the future occupant of the vacant office unit will utilize this parking lot. The 2-lane driveway to the parking lot has only one access from Piymouth Street. The addition of trucks to this driveway would be a safety concern. Brian King told the board at the Site Plan Review Meeting on November 16, 2010, Mansfield Police Department Safety Officer, Lance Lawson, stated his concerns with combining trucks and cars within the existing parking lot. In a January 19, 2011 e-mail, Officer Lawson again expressed his safety concerns combining truck car traffic through the existing parking lot. A letter was received from Massachusetts Registered Professional Traffic Engineer regarding the safety concerns if the northeast access is used. Brian King said the use of this access route would result in slgnificantiy more impact to the wetland resource areas. Option 4. Building Alternative - Southern Access. The southerly area of the site contains the existing building and fronts on Plymouth Street. A narrow area exists along the southwesterly side of the building which could be used for the access driveway for truck traffic. There is an intermittent stream running parallel to the building, approximately 80 to 90 ft. away. This area is within the 100 ft. buffer of the intermittent stream and completely within the 200 ft. Riverfront area associated with Hodges Brook. A new access driveway in this location would require tree removal and extensive grading within the buffer zone. The impact from this alternative to the resources areas has been determined to be greater than the impacts from the preferred alternative. Option 5. Building Alternative - Southwest Access. This is the preferred alternative because of safety Issues and the resource areas. The proposed driveway would be exclusively for truck traffic from Plymouth Street. The proposed driveway would cross the intermittent stream at its narrowest points, crossing the stream at a 900 angle. The pavement width would be 24 ft. and a 3-sided bottomless culvert with headwalls would be used to keep the natural stream bottom. The natural bottom facilitates the continued use of the channei as a migratory corridor for wildlife. To mitigate the loss of habitat from the crossing of the intermittent stream, the applicant is proposing a bank restoration area south of the driveway within areas of existing iawn. The re-vegetation of existing lawn areas within the riverfront area is at a 1.38: 1 ratio. The area will be planted with trees and shrubs and allowed to re-vegetate naturally. Elizabeth had asked for a comprehensive plan referencing the resource areas such as streams and buffer zones within the. n {-<I'- property. Brian King said an "Existing Resource Area Map" has been prepared by NRS._ \ov--" W & "";--).o,~s/,>l;,,,,, ~\-~ ~ The applicant was asked to provide an outline of the DEP Performance Standards that apply to this project. The design meets the Performance Standards. NRS has submitted a letter describing how the project design meets the standards for each resource area. Brian King toid the board the project meets the definition of a limited project as outlined in the DEP wetiand regulations; the proposed driveway width has been reduced from 30 ft. to 24 ft., the minimum width acceptabie. The driveway will be wider at the entrance but 24 ft. at the resource area. Mr. King said the proposed driveway would not restrict the fiow of water. The proposed driveway has been designed to pass the 100-year storm fiow. A 3-sided culvert, 10 ft. wide, 4 ft. high with an open bottom is proposed and the culvert has been designed according to the Massachusetts River and Stream Crossing Standards: the open bottom culvert will be used to maintain the existing stream channel; openness ratio requirements have been met - the standard requirement is 0.25 meters, the culvert is designed to provide 0.27 meters; proposed culvert exceeds the 1.2:1 width ratio; the requirement is 9.6. The proposed width of the culvert is 10 ft. Brian King told the board a 401 Water Quality Certification was not required because the proposed improvements are not listed in 314 CMR 9.00; the proposed improvements wiil not result in a loss of more that 5,000 sq. ft. of bordering or isolated vegetated wetlands, or land under water and is not listed In 314 CMR 9.04; the proposed improvements wiil not dredge land under water or discharge dredged material; bordering vegetated wetland replacement is not required and the site is not within an Outstanding Resource Water. Elizabeth's comments: She does not know if the applicant has met the performance standards for Bank, Land Under Water, Bordering Vegetated Wetlands (BVW) and Riverfront. She said the Notice of Intent states 90 ft. of Bank wiil be disturbed with no replacement. Mr. Rabideau said this figure has been reduced down to 76 ft. A plan showing all the resource areas has not been provided and until this is done she said she can not determine the proposed means of access to the site is the least detrimental to the resource areas. The Notice of Intent does not mention any BVW alteration or replacement. Mr. Rabideau said there are no impacts to the BVW associated with the project. It is strictly Riverfront. Elizabeth toid him it should be shown on the plan. There is 450 sq. ft of Land Under Waterbodies and Waterways with no replacement; in these areas, the applicant is proposing a 3-sided culvert. There is no lost of Land Under Waterbodies and Waterways. The Notice of Intent states there wiii be 2,000 sq. ft. of impact to the inner riparian and 10,000 sq. ft. of outer riparian impact. Scott Rabideau said the applicant is proposing 12, 000 sq. ft. of mitigation in the lawn areas that are immediateiy adjacent to the intermittent stream. The 12, 000 sq. ft. is in excess of the 2 to 1 ratio required. Elizabeth asked that Mr. Rabideau develop a chart showing the amount of alteration and restoration to show how the applicant is meeting the performance standards. Mr. Rabideau said they are not replicating Bank. Elizabeth said the NRS report states there are no Impacts or alterations to the buffer zones. Mr. Rabideau said they are altering the buffer zones. The NRS report refers to two additional perennial streams, one along the eastern portion of the property and one along the southern portion. Elizabeth asked that the additional perennial streams be shown on the plan so the board can review these areas. Mr. Rabideau said the stream on the right and the back of the property was not delineated because this area is not in the project location. DEP comments: This does not appear to be a limited project since 2 accesses to the upland already exist. Alternatives should be scrutinized closely since the southern access would appear to avoid/minimize resource impacts. MA stream crossing guidelines need to be consulted. Is there a snow removal plan? A snow storage site is shown on the plan. A memorandum, dated February 9, 2011, from Rick Alves, Interim Town Engineer, states that after reviewing the drawings prepared by Crossman Engineering, dated October 2010 and revised January 2B, 2011, the revised site plan drawings satisfactorily addressed all comments of the December 10, 2010 memorandum. Mr. Alves said a copy of all approved shop drawings for the project must be submitted to the Town of Mansfield Engineering Department for approval. Colin Cauldwell asked if a mitigation plan had been submitted. Brian King said there is a list of proposed landscaping on the drainage plan. Michele White asked that a Construction Pollution Prevention Plan be attached to the plan. Elizabeth asked if the board wanted to condition the project. 5he would like the standard conditions for industrial projects and would like to see more information regarding the resource areas for the file. She asked about hay bales and silt fence. She said an Operations and Maintenance Plan should be submitted. Brian King said there is an O&M plan on the second sheet of the site plan. She said vegetation growth should be monitored for 2 or 3 years to make sure the plantings are healthy. The issuance of a Certificate of Compliance is contingent upon 2 annual reports being submitted on the health of the plantings and the restoration areas. Wetiandjbank restoration reports, by a qualified wetiand scientist, shall be submitted to the Conservation Commission annually for a three year period. The Operations and Maintenance Plan should be attached to the Order of Conditions to be incorporated as one of the special conditions of the project. Joe Mulkern made the motion to ciose the public hearing Carole Matthew seconded the motion. Motion passed 4 in favor - 1 opposed. Joe Mulkern made the motion to accept the plan as iong as the applicant works with Elizabeth on the best way to put the driveway in with the special conditions as outlined by Elizabeth. Carole Matthew seconded the motion. Motion passed 4 In favor - 1 opposed. 4. Notice of Intent: Acorn Manufacturing, 457 School Street, Map Parcel. #211~0863 The Notice of Intent was fiied for the construction of a 7,500 sq. ft building with associated site preparation, grading, landscaping and stormwater modifications. The site is not within an ACEC or within an area identified by the Massachusetts Natural Heritage and Endangered Species Program as Estimated or Priority Habitat of Rare Species. Eric Delong, Acorn Manufacturing Co., Inc. and Jim Pavlik of Outback Engineering, Inc. were present. The 7,500 sq. ft. building wili be constructed in the northeast corner of the site. The construction wili not alter any resource areas. The board asked that the wetiands be delineated by an outside consultant. Lenore White of Wetland Strategies, Inc. was hired to review the bordering vegetated wetlands through vegetation and soils. In a letter dated January 5, 2011, Lenore White asked that wetland flag A6 be moved 10 feet up-gradient of its current location and flag 12 should be moved 20 ft. up- gradient of its current position. She said flags A1 and 19 were not found. She recommended these modifications be made in the field and on the plan of record. Any missing flags should be replaced. The wetland boundary of the isolated wetland was also changed. She said Flags 1-6 to the northern property line that borders Forbes Boulevard were not necessarily bordering vegetated wetland but were actually top of bank associated with an intermittent stream. Jim Pavlik said Lenore White's comments have been addressed. Jim Pavlik said they have met with all town boards and all boards have signed off on the project. He said they met with the Planning Board last week and received site plan approval. Elizabeth's comments: She said she was satisfied with the delineation by Wetiand Strategies. She said the Stormwater Management has been reviewed by Rick Alves, Interim Town Engineer. A memorandum dated January 24, 2011 states the Engineering Department has reviewed the revised Stormwater Management Report dated January 20, 2011 for the proposed building at 4S7 School Street, prepared by Outback Engineering, Inc. and the revised drainage calculations satisfactorily addressed the Engineering Department's remaining comments of memorandum, dated January 10, 2011. She recommended double-staked hay bales and silt fence to be inspected by the Conservation Agent before any work begins. She asked if the board wanted to consider roof drains for the new building. Jim Pavlik said the roof run-off is to be discharge to the drainage basin. She asked that the gravel pile be pushed back away from the wetland area and then the area re-vegetated. There were no comments from the board. Michele White made the motion to issue an Order of Conditions for DEP #211-0863 with the following special conditions: erosion controls to be checked by Elizabeth prior to construction; the Conservation office is to be contacted before erosion controls are removed; the gravel pile is to be moved away from the resource area and the area re-vegetated; roof drains are to discharge to drainage basin. Joe Mulkern seconded the motion. Motion passed 4-0-1. I 5. Notice ()f!flterit: Brian&Leellnn Fallon, 20Winsl()wWay; Map41,ParceI446.#211-0864 , . The Notice of Intent was filed for a proposed addition, patio and spa with grading within the 100 ft. buffer of bordering vegetated wetlands, an Estimated Habitat of Rare Wildlife and within an ACEC, the Canoe River. Michael Trowbridge, Hutchins-Trowbridge Associates, Inc., representing Brian and LeeAnn Fallon. Mr. Trowbridge told the board he contacted Natural Heritage and asked that they make an inspection of the site. The response from Natural Heritage was they do not need to do an inspection to make a decision. . The board asked that the applicant submit a Wildlife Habitat Evaluation - Appendix A, to be performed by a Wildlife Specialist. John C. Jahoda, Wildlife Biologist, was hired to do the assessment of the site to determine whether the proposed addition to the house and patio area wouid have an impact on the potential habitat of the Marbled Salamander. In a letter dated February 9, 2011, Dr. Jahoda said he found the area is within the footprint of an existing house or on existing lawn and would pose no impact to any rare species habitat. He also said that Dr. Jonathan Regosin of the Natural Heritage and Endangered Species Program, agreed the proposed work Is confined to a landscaped area adjacent to the existing house and "therefore, we can and have determined, without conducting a site visit, that the work area is not habitat for the state-listed species in question (Marbled Salamander) and that the proposed project will not in any way adversely affect nearby habitat". Mr. Trowbridge said revised plans have been submitted indicating the foundation in the back would be a crawl space. Blue prints of the actual plan have aiso been submitted. Elizabeth said there are no comments from DEP and the letters from Natural Heritage and Dr. Jahoda state there are no issues. Because the addition is very close to the 25 ft. no touch and the bank is steep, she would recommend the use of double-staked hay bales with silt fence. She said at the last meeting, Joe Mulkern suggested signage be placed on the 25 ft. line. Elizabeth said the slgnage should be part of the Order of Conditions. Derek House made the motion to accept the plan as drawn for 20 Winslow Way and Issue an Order of Conditions with the following special conditions: double-staked hay bales and slit fence at the limit of work, to be inspected by Elizabeth before any work begins; 3 metal signs on metal posts on 50 ft. centers to be installed on the 25 ft. no disturb line that read "Environmentally Sensitive Area, Do Not Disturb". Carole Matthew seconded the motion. Motion passed 5-0-0 6. Request for Determination of Applicability: Chris Cox, Mansfield MuniCipal Electric Dep'lrtment, High Street storage yard, Map 21,- Parcel 137.' .':- ','. - -. The Request for Determination of Applicability was filed for the trimming of trees and cutting back the brush along the fence line between the storage yard (at parcel 21-137) and the Rumford River. The work Is necessary due to continual break-ins and theft of materlai from the fenced in storage yard. The tree trimming and cutting of brush will need to be done on an annual basis to provide visibility to the storage yard. Tree trimming and cutting back brush was already been done in the Spring/Summer of 2010 with out a filing. The applicant has requested the hearing be continued to March 21, 2011. Derek House made the motion to continue the hearing until March 21, 2011. Micheie White seconded the motion. Motion passed 5-0-0 I 7; RequestJoiExtellsIon;#21r-0744, IItty. Richard Bland; Gilbert Park Attorney Richard Bland, representing Aldo Paglia, Trustee, Massapoag Realty Trust. Attorney Bland has requested an extension of the Order of Conditions issued on January 25, 2006 for Gilbert Street, Map 3 & 4, Parcels 2, 3, 5, 14, IS, 25, 26, 136-140: this parcel of land is part of a six-lot sub-division. Attorney Bland said a Conservation Restriction for the 60 acres was required and has been recorded. Attorney Bland said the road work and construction have not been started because of the economy. He said there wouid be no change from the original filing. Michele White made the motion to issue a 3 year extension of the Order of Conditions for DEP #211-744. The Order of Conditions will be extended to February 15, 2014. Derek House seconded the motion. Motion passed 5-0-0 1 8. Reqaest}orEl<t:ensioii//liil-07881A\:ty'.Ric!iardBland, Lot? Carole Matthew seconded the motion. Motion passed 5-0-0. Derek House would like a copy of Nick Riccio approval of the Engineering Plans, etc., regarding the building permit for the Mariner Tower. Elizabeth said there are stili some outstanding conditions. 10. Certificate of Compliance: Route 140 School Street, LLC, W/S Development Associates, LLC. Map 12, Parcel 4, 31rAl-.-#211-704-':",'~"_: . -. ... ........u --. -- -- - Ann McMenemy of Environmental Resources Management (ERM) and Jeffrey Stearns, Project Manager from Woodard & Curran, were present. Ann McMenemy told the board construction of the project permitted under the Order of Conditions, dated December 13, 2005, was completed in the spring of 2007. This Order of Conditions expired in 2009 with the wetland mitigation and stormwater monitoring program incomplete. Elizabeth has not been able to review the restoration areas because of the snow cover and probabiy won't be able to until spring or summer and, because of the unfinished building pads, G and H, from the original filing, she recommends a partial Certificate of Compliance be issued. Ann McMenemy told the board in July 2010, a new Order of Conditions, DEP #211-0852, was issued for the construction of Building Pads G and H; these pads are within the 100 ft. buffer zone. These buildings were also permitted under the 2005 Order of Conditions. Ann said once constructed, a separate Request for a Certificate of Compliance (COC) will be filed for DEP File #211-0852. Colin Cauldweli said he was concerned about the snow being pushed so close to the restoration and resource areas and the use of sait. He asked Ann to check that non-sodium de-icing salt is being used. Ann said W/S Development submitted a letter to their contractors about using only non-sodium salt products. She said she would check to make sure salt products are not being used. Colin suggested they used parking areas for snow storage; at least the run-off would be going through the stormwater system. He said Lou Masielio, W/S Development, told the board if the snow storage areas become overwhelmed, the snow would be trucked off site. Jeffrey Stearns told the board Woodard & Curran has performed monthly inspections of the 70 catch basins, the 4 detention ponds and 2 underground filtration systems as outlined in the Operations and Maintenance Plan (O&M) beginning in January 2009 thru December 2010. The inspection for the catch basins included measurement of sedimentation accumulation as well as conditions of the grates, frames, hoods and overall structures. He said the accumulation of sediment Increases from January to eariy April and decreases In November. He said the accumulation of sediment on-site was not significant enough in the catch basins to merit once a month inspections. He said the Massachusetts Department of Environmental Protection recommends quarterly inspections. Jeffrey Stearns said he spoke with Rick Alves, Interim Town Engineer, about decreasing the monthly inspections to quarteriy inspections. Rick Alves said the monthly inspections should continue for a year and then be reviewed again. Woodard and Curran submitted a letter dated January 21, 2011 to request a decrease In catch basin Inspections with the stipulation that bi- annual catch basin c1eanings, once in the spring and again In the fall, be continued. Woodard & Curran would stili provide an annual report documenting their inspection summaries. Jeffrey Stearns told the board the monthly inspections of the detention ponds and the infiltration systems would continue. Rick Aives, In a memo dated February 11, 2011, stated the Engineering Department has reviewed the request for a Certificate of Compliance along with the Operations and Maintenance Request prepared by Woodard & Curran. He said he found the data provided in the O&M Request to decrease catch basin inspections from monthly to quarterly acceptable. After the Certificate of Compliance is issued, the O&M Plan must continue and reports, stamped by a Registered Engineer detailing the performance, maintenance and repairs to the stormwater management system must be submitted to the Engineering Department. Jeffrey Stearns said a yearly report would be submitted to Conservation and Engineering with dates of the inspections and an explanation of any action he asked them to do and the follow-up to that action. Elizabeth asked that the memo be attached to the Certificate of Compliance. Derek House made the motion to change the Operations and Maintenance Plan for the inspection of the catch basins from monthly to quarterly inspections. The detention ponds and Infiitration system inspections wili continue to be monthly. Joe Mulkern seconded the motion. Motion passed S-O-O. Ann McMenemy asked if the partial cac Is for the catch basins only or if it is for other elements of the project. If not, would the permit be held open until the seasonal conditions can be met? She said the applicant is required to do bi-annual samplings of the pond and wili have to schedule one In the spring, at considerable cost to the applicant. She said the operations and maintenance of the stormwater management system is required in perpetuity beyond the issuance of the Certificate of Compliance but if there has not been a degradation of the water quality, the condition is written that the applicant can petition the commission to either reduce or eliminate the sampling program. She has requested within the Certificate of Compliance filing that the sampling program be eliminated because the purpose of it has been achieved; it was put in place because two areas of treated stormwater are being discharged into the pond and it was to verify pre- during- and post construction whether any changes in the water quality occurred from that permitted activity. She said the data from 2006 to 2010 not only has been consistent but shows the water quality resuits below the standards considered acceptable for aquatic life and that the purpose of the monitoring has been fulfilled. Colin Cauldwell questioned the data on the pond as far as the chloride content. The levels have gradually increased. Ann McMenemy said she would do some research on this and get back to the board. She said drainage from a wetland area and the parking lot go through a stormceptor with two outlets to the pond but are relatively smail areas of acreage versus the acreage and depth of the pond. Colin would i1ke at least one more round of testing done because of the Increasing salt content. Colin Cauldweil said the hearing can walt until spring so another round of testing can be done and Elizabeth can look at the replication areas; then Ann McMenemy can apply for a full Certificate of Compliance. Elizabeth reminded the board there are still two incomplete building pads. Ann McMenemy said they are under their own permit with another DEP number. Ann said she does not know when there wili be a tenant for these pads. Ann McMenemy asked if she would need to submit another request for a Certificate of Compliance for the remainder of the work. Derek House asked if a motion could be made to table this request for the COCo Elizabeth: "Are you issuing a partial?" Colin Cauldweil: "The board wili issue a partial for relief from the inspections for the catch basins". Ann McMenemy: She said if she has to re-appiy, she will change the date on the paperwork and add the information regarding the chloride content in the pond. She asked if the filing could be re-activated. Elizabeth: "You want to use the same Request for a complete Certificate of Compliance?" Derek House: "We will table it until the replication areas have been verified in the spring and new testing data on the pond has been submitted". Ann McMenemy: "You are taking action for the partial and tabling the rest?" Elizabeth said she has never done this before, usually you get a partial and then you reapply for a full Certificate of Compliance. Colin Cauidwell said there is a motion on the floor to table this request. Joe Mulkern seconded the motion. Motion passed S-O. Colin Cauldwell told Ann McMenemy to just re-submit the paperwork with the additional information. Derek House said the tabling of the hearing just means we bring it up for discussion at a later date. Elizabeth asked if it would be done in a public hearing. Derek House said it is not a public hearing. The board does not need to close it and reopen it. Ann McMenemy: "It is just administrative business." Derek House: "A motion to table just means it can be brought up in the future for discussion. No action has been taken and can be brought up anytime in the future for discussion". Ann McMenemy said she would check with Elizabeth in late April or early May for a future date. 111. Old and NewBusin~ss: A bill has been submitted for Wetland Strategies for consultant work on the Acorn Manufacturing Co., Inc. project: $1000.00 was put into a special consultant account - the bill for Wetland Strategies is for $720.00. The remainder, $280.00 will be given back to the applicant. Carole Matthew made the motion to pay Wetland Strategies $720.00 for the consultant work for 457 School Street and refund $280.00 to Acorn Manufacturing Co., Inc. Michele White seconded the motion. Motion passed 5-0-0. The minutes for January 10, 2011 will be approved at the March 21, 2011 meeting. Minutes need to be revised. Approve "Policy for Hiring Outside Consultant". Michele White made the motion to adopt the up-dated version of Section 7 Regulation, "Policy for Hiring Outside Consultants". Carole Matthew seconded the motion. Motion passed S-O-O. Check List: A check list has been developed by the state. Elizabeth will be working with Brian Butler of Oxbow Associates. He has volunteered to help develop a simplified check list in order to comply with Section 6 of the regulations. Elizabeth asked the board to review the check list and send their comments to her. Elizabeth asked for a vote to send the warrant article regarding fees back to the Selectmen for review and to placed the article on the next Town Meeting Warrant. This article was removed last year because the Selectmen did not have a chance to review the fees. Elizabeth said any articles need to be in by March 1, 2011. Michele White made the motion to present the warrant article regarding the fee schedule for the Conservation Department to the Board of Selectmen for review. Derek House seconded the motion. Motion passed 5-0-0. Elizabeth told the board the state has certified a vernal pool, #6471, on Gilbert Street. She said Michele Grenier, the former Conservation Agent, certified the pool with Jennifer Carlino, the Norton Conservation Agent. National Grid: A letter was received on February 9, 2011 from National Grid; the construction phase of the electric utility maintenance project - replacement of electric poles in the utility right-of-way - on Oak Street in Mansfield to the Foxborough Town Line has been put on hold temporarily. The Big Y, a supermarket chain, will be built in Foxborough, in the Foxfield Plaza. The supermarket will be built just over the Mansfield{Foxborough line. Elizabeth asked if the board would consider doing a slide show about vernal pools. Colin Cauldwell said the show could be put on the cable access channel. Elizabeth said she could do the show at Town Hall and have Martin tape it. The board decided to do the show in April. Michele White suggested a field walk be done, perhaps the Saturday after the presentation. Elizabeth said the walk would give people the chance to identify a vernal pool and how to collect information to document a vernai pool for the state. She said a vernal pool couid be certified at that time. Michele White thinks it is a good idea for Elizabeth to do the presentation. She said it could be opened to the public. She said it would be a good opportunity to talk more in a conservation direction which is also part of what the Commission is supposed to do and not just the permitting aspect of it. It would be a good way to incorporate more conservation into the Conservation Commission.
