Conservation Minutes
August 9, 2010
Present: Paul Boyden, Vice Chairman; Colin Cauldwell; Michele White; Carole Matthew;
Elizabeth Leidhold, Conservation and Environmental Planner.
11. Meeting called to order at 7:10 pm.
2. RequestforDetermination of Applicability: Dean Street, Map26,ParceL63 .-Drainage
Improvements to. Dean. Street.
The RDA was filed for the installation of an emergency sewer overflow on Dean Street. The
work is adjacent to areas of wetlands; all proper erosion and sedimentation controls, including
silt fencing will be installed up slope of all vegetative areas. The disposal of any material into
the wetlands, streams or other water resource areas will not be permitted.
Rick Alves, Interim Town Engineer, was present. He told the board the filing is for drainage
improvements to Dean Street at the corner West Street. He is requesting a Negative
Determination of Applicability because the work within the buffer zone will not alter an area
subject to protection under the Wetlands Protection Act.
Rich told the board the Department of Public Works is proposing to install an emergency sewer
overflow approximately 371 linear feet within Dean Street, from the intersection of West and
Dean Streets. Construction activities will include saw cutting, trenching approximately 6 to 10
ft. deep, install two (2) sewer laterals and a concrete encasement, connecting the sewer main
from existing manhole to existing manhole. Also, the installation of a catch basin and a flared
end section (replacement of what is existing). The existing catch basin is filled with debris. It
outlets to the east side of Dean Street to an existing headwall. The catch basin will be
demolished along with the existing clay pipe. The proposed sewer main - the emergency
overflow - as it exists now flows thru the pipe. The work proposed would raise the elevation
approximately Y2 ft.
At the outlet control, rip rap will be placed along with filter fabric under the rip rap to prevent
any type of adverse impact to the wetlands down stream. Wetlands are approximately 50 ft.
from the work area. Wetlands were not flagged.
DPW will be on site during the work. The work will be contracted out. Rick Alves will do sewer
inspections while the work is being done.
Rick Alves and Elizabeth have looked at the site. Elizabeth said the project will improve existing
conditions; right now silt is entering the wetlands. She said it is a good project.
Rick Alves told the board the last storm in March triggered the emergency sewer overflow.
Colin Cauldlwell made the motion to find a Negative 3 Determination for the sewer overflow for
the Dean Street project as proposed by the DPW, plan dated July 20, 2010 (Plan of record:
Plan of Sewer Extension within Dean Street - sheets 1 of 2 and 2 of 2, dated July 20, 2010).
Siltation controls are to be inspected by Elizabeth and she is to be notified before work
commences.
Michele White seconded the motion.
Motion passed 4-0.
4. Request JorCertificate of Compliance: Planners Designers Architects, Inc., 55 Cabot
Boulevard #211"0826.
Rich Riccio from Field Engineering, representing Tyco Valve and Controls LP, was present.
An amended Order of Conditions was issued May 10, 2010. The plan was amended to include
the reconstruction of the existing parking and loading areas and the construction of two new
concrete sidewalks with railings within the 100 ft. buffer of bordering vegetated wetlands
(BVW). The original Order of Conditions was issued April 14, 2009.
A letter, dated July 21, 2010, from Rich Riccio states the work has been done in compliance
with the Amended Order of Conditions and the record drawings are acceptable in issuing a final
Certificate of Compliance. He told the board the site has been stabilized.
Rick Alves, Interim Town Engineer, in a memo dated August 9, 2010, states he has reviewed
the record drawing dated October 16, 2009 and stamped July 12, 2010 for 55 Cabot Boulevard,
prepared by Field Engineering, Co., Inc. and says there are no out-standing conditions.

Elizabeth told the board the RDA states the wetland boundaries have been accurately
determined under the filing; the wetland boundaries have not been determined under the filing.
There are no flags.
She suggested wattles be used instead of hay bales. The wattles will be placed at the
perimeter of the grass area. Elizabeth is to be called to inspect the wattles before any work
begins.
Rob Hoekstra said he would like to have Elizabeth come to the site prior to the start of the work
and have her do spot checks as the work progresses.
Colin Cauldwell asked about the catch basins - how will they be protected? Rob Hoekstra said
socks will be installed around the basins for protection.
Michele White made the motion to issue a Negative 3 Determination to TCG New Jersey, Inc.
for work proposed on Hampshire Street on the plan submitted and dated July 23, 2010. (Plan
of Record: Hampshire Street, prepared for TCG, by UC Synergetic, dated 7/23/2010 and
Hampshire Street, Foxborough/Mansfield, MA Petition Plan sheets 1-5 of 5, dated 6/28/ 2010)
Elizabeth will go out to the site prior to the start of work, with spot checks done once the work

15. Old/New Business:
Colin Cauldwell made the motion to approve the June 28, 2010 minutes.
Carole Matthew seconded the motion.
Motion passed 4-0.
The minutes of July 12, 2010, approved at the last meeting, were signed.
Agent's Report:
1.) Potential wetland violation at 27 Lakeview Avenue. Conservation received a
complaint regarding the expansion of a concrete wall and the addition of a retaining
wall; homeowner has changed the waterfront plantings, replaced 1 fence and
extended another fence, torn down the front steps and have made a new driveway
area. Elizabeth is to call the homeowner to let them know someone has filed a
complaint about activities on their property and the Commission need to investigate.
2.) Working on a planting plan for Catherine Memory's property at 23 Lakeview Avenue.
Michael Trowbridge will be submitting the plan shortly for approval by the board.
3
3.) Elizabeth met with Walter Parker for the Jordan Jackson light project and helped him
fill out the necessary paperwork for the Notice of Intent.
4.) Elisabeth met will the contractor for the Plymouth Street Soccer field project. She
said 2 or 3 more waddles will be needed over by the trenches by the detention basin
and in the area by the snack shack.
5.) Elizabeth will be meeting will Mass Highway tomorrow, Tuesday August 10th at 9:30.
6.) Elizabeth will be meeting with representatives for the School Street project to discuss
the concerns of the board from the last meeting: wetland areas not defined, the
O&M plan, erosion control, snow removal.
7.) Permit Extension Act: Permits issued tonight will be good for 5 years instead of the
normai 3 years. All permits issued from August 15, 2008 to August 15, 2010 will be
extended for an additional 2 years past the original expiration date. The new law
supersedes local by-laws. Environmental permits included in the Act are water
discharges, wetlands, waterways and MEPA as well as approval under 40A, 40C and
40R but not 40B. Elizabeth said a list of potential projects that will qualify under the
Act should be developed. She told the board permits will be extended only on
projects as long as the project is exactly what was approved; if changed, expiration
date stays the same. She said a Notice of Intent/Order of Conditions can be
amended within the 2 year extension. If an RDA is due to expire and the approved
project is changing, there is no method to amend an RDA. The applicant would have
to re-fiIe.
8.) DEP Circuit Rider Workshops: Elizabeth gave the board a list of workshops to be
conducted by Christine Odiaga. The board is to let Elizabeth know if they are
interested in any of the topics. The board will have to decide if they want to do this
before or after a regular meeting - the workshops take about 2.5 - 3 hours each - or
on another night. They can be done also during the day. Michele White said she
thought it would be better to do them on a non-meeting night; more residents might
come to the workshops. Workshops would have to be posted.
9.) Elizabeth told the board she has a COA volunteer to help organize the Conservation
Land files and another volunteer to help prepare the old files for storage.
10.) Elizabeth told the board about Give Your Lake the Blues, concerning buffer zone
plantings to provide protection for the waterways. It was suggested that Lake
Associations be contacted. Also, this might be another topic for discussion at
another meeting. Carole Matthew asked if an educational topic could be placed on
the town's web site once a month. She suggested the Arbor Day Foundation. Colin
Cauldwell suggested the cable channel be used.
11.) Elizabeth has been in contact with Priscilla Chapman of the Taunton River
Watershed. She thinks she might be able to help with the Give Your Lake the Blues.
Elizabeth has also asked Priscilla about grants for purchasing additional land.
Colin Cauldwell told the board he has applied for a building permit for the bridge over the
Rumford River at Judy's Lane. Nick Riccio will waive the fees. Nick will have to inspect the
bridge work because it is a public bridge. Colin has also done the paperwork for the RDA
needed for the bridge work - filing will be on the next agenda.
