ConselVation Minutes
May 10, 2010
PRESENT: Joe Mulkern, Chairman; Paul Boyden, Vice-Chairman, Derek House; Carole Matthew; Colin Cauldwell;
Michele White; Elizabeth Leidhold, ConselVation and Environmental Planner.
Meeting called to order at 7:00 pm
11. Partial Certificate of Compliance: Essex Street, "Autumn Park", Map 37, Parcel 16 - #211-776
Ralph Maloon of RIM Engineering and Perry DiMascio, the developer were present.
Mr. DiMascio has requested a partial Certificate of Compliance be issued for "Autumn Park" for work already
completed.
At the April meeting, the board requested the retention pond be delineated and elevations be submitted. Ralph
told the board calculations for the retention pond have been submitted. He told the board the pond was actually
bigger than originally proposed.
A memo from Rick Alves, Interim Town Engineer, dated May 10, 2010, states that the site plan drawings and
volume calculations appear to adequately handle the 100-year storm peak elevation of 115.77.
Rick also noted that the 2: 1 slope is not acceptable unless it is stabilized along the pool's edge with a turf re-
enforcement or rip-rap. The rip-rap as proposed is acceptable only with filter fabric place beneath it, to be placed
on the adjacent lot, 6 DiMascio Drive.
Derek House made the motion to issue a partial Certificate of Compliance for Autumn Park, DEP #211-776, based
on the plan by RIM Engineering, dated April 19, 2010. All compliances by the Town Engineer are to be followed.
Colin Cauldwell seconded.
Motion passed 6-0.
Hearing ended at 7:06 pm.
Ralph Maloon of RIM Engineering, Edward and Marissa Jameson, the homeowners, Dave Hobaica, Easton Pool and
Spa were present.
The RDA was filed for the installation of an 18'x36' in-ground pool within the 100 ft. buffer of bordering vegetated
wetlands.
Rick Alves reviewed the plans and volume calculations submitted by RIM Engineering Co., Inc. (memo dated May
10, 2010). He said the drawings and calculations appear to be adequate to handle the 100 year storm peak
elevation of 115.77 but noted the 2:1 slope is not acceptable unless stabilized with a turf re-enforcement or rip-
rap; the rip-rap is acceptable as long as filter fabric is placed beneath it. Ralph told the board the stone rip-rap on
the slope is in place.
Derek House asked if a dewatering area would be needed because the ground water is so high. Elizabeth said the
board could require a dewatering area be designated but because the pool is not impacting the retention pond, it
does not fall within ConselVation's jurisdiction.
Derek House made the motion to accept the request for the RDA and issue a Negative 3 Determination for the
installation of an in-ground pool at 6 DiMascio Drive, the only stipulation being that filter fabric be installed beneath
the rip- rap as per the Town Engineer.
Carole Matthew seconded.
Motion passed 6-0.
Hearing ended at 7:09 pm.
13. Notice of Intent: Mansfield Athletic Complex, Plymouth Street, Map 10, Parcel 21 - #211-0847.
Robert Weidknecht, Senior Associate for Beals and Thomas Inc., Kelly Kemp, Vice President of Mansfield Youth
Soccer and John Amato, JJA Sports, were present.
The Notice of Intent was filed for the replacement of a grass athletic field with a synthetic turf field with
improvements to the stormwater and drainage system and construction of handicap parking and a walkway to
access the fields.
Robert told the board sub-surface testing has been done and witnessed, as per the request of Rick Alves, Interim
Town Engineer, memo dated March 22, 2010. The elevations and stormwater calculations have been reviewed by
Rick and have been redone. In a memo dated May 10, 2010, Rick states the revised plans have satisfactorily
addressed all remaining comments. He recommends an as built be submitted before the Certificate of Compliance
is issued. Elizabeth said they are required to do this for Zoning.
At the last meeting, John Amato was asked to provide more information concerning paint and associated chemicals
to be used on the fields. He contacted paint suppliers for sports fields. He said the manufacturer does not use
pigments or other ingredients that contain heavy metals or toxic compounds. He told the board, because of the
synthetic turf, volatile organic compounds (VOC's) are used in small quantities to allow the paint to adhere to the
fields. An anti-bacterial agent is also used to keep the latex paint from spoiling; these materials evaporate and do
not leach into the ground. John told the board all synthetic turf paints are safe and meet all federal and state
requirements. He said Material Safety Data Sheets are available and will be submitted by the contractor. He gave
Elizabeth a copy of the MSD sheet for the file. John told the board the need to re-paint each week is reduced
when using synthetic turf.
Derek House proposed the following special conditions:
1. Mansfield Youth Soccer will take sole responsibility In taking the appropriate measures at all times to insure
that the artificial turf field ("turf field") is maintained in a responsible and environmentally friendly manner.
2. Records should be kept on when and from whom maintenance was requested from any Town of Mansfield
department, installer, and/or other contractors, and what speCific task was requested for the turf field,
surrounding area, and retention pond.
3. Mansfield Conservation Commission members may check on the operation of the turf field and rnake
comments or suggestions to the board at any time, regarding the environmentally safe operation of the
field and its surroundings.
4. No solvents, cleaners, paint, or chemical will be used on the turf field without prior written consent of the
Mansfield Conservation Commission.
5. Written Operations and Maintenance manuals must be kept on all activities associated with the turf field
and the area surrounding the retention pond. This should include but not be limited to: maintenance of
piping associated with runoff, maintenance of retention area, and maintenance of runoff outlet to Hodges
Brook. Manuals shouid include, but not be limited to, the amount of products used on the turf field,
manufacturer of product, and date of installation and/or use.
6. Siltation fence will be installed on the outlet of retention pond into Hodges Brook to prevent any unwanted
outflow of construction disturbed sedimentation from the retention pond.
7. A gated fence, with a minimum height of 5 feet, will be installed around the perimeter of the retention
pond to prevent travel through the pond. Gate should be used for the retrieval of soccer materials, retrieval
of debris, and maintenance operations only.
8. This permit is non date specific and can and will be reviewed by the Mansfield Conservation Comrnission on
an annual basis.
9. Mansfield Youth Soccer and the Town of Mansfield, upon issuance of a certificate of compliance, consent
that the Commission will hold all legal rights to indemnify a continued safe and stable environment for the
future preservation of Hodges Brook, intermittent streams, and wetland areas surrounding the property.
2
10. Mansfield ConselVatlon Commission will hold the right to revoke, at any time, without repercussions, this
permit should environmental hazards arise from the installation or maintenance of the turf field.
Condition #1 should be re-written to read "Mansfield Youth Soccer, through Its use agreement from the town, will
take sole responsibility in taking the appropriate measures at all times to insure that the artificial turf field ("turf
field") Is maintained in a responsible and environmentally friendly manner.
The board asked that Condition #8 be changed to "These special conditions are subject to review on an annual
basis", removing the words "This permit is non date specific".
The board asked that Condition #10 be removed entirely because this is already stated in the standard conditions.
Condition #10 will read "Flagging and siltation controls to be removed once the site is stable". Condition #11
"Town of Mansfield Recreation Department will be responsible for scheduling maintenance of the detention pond.
Condition #12 will read "An as built is required before a Certificate of Compliance is issued".
Lenny Flynn, a member of NRT and an abutter, told the board he is concerned about the rubber and toxic material
migrating off the property. He told the board he feels Derek's recommendations adequately address these Issues.
He said he has researched synthetic turf fields and found serious questions as far as health Issues.
Paul Boyden made the motion to accept as presented, DEP #211-0847 for the Mansfield Soccer fields with the
proposed special additions: Condition #11 - Town of Mansfield Recreation Department will be responsible for
scheduling maintenance of the detention pond; Condition #12 - an as built plan is required before a Certificate of
Compliance is issued; original Condition #10 to be eliminated; Condition #10 will read "Flagging and siltation
controls to be removed once the site Is stable"; adopt alternative wording for Condition #1 - "through its use
agreement from the town" and Condition #8 - remove "This permit is non date specific" and add "These special
conditions are subject to review on an annual basis". An O&M plan should be attached to the Order of Conditions.
Colin Cauldwell seconded.
Motion passed 6-0.
Hearing ended at 7:30 pm.
I 4. Abbreviated Notice of Resource Area Delineation: Stan Feck, Ware Street, Map 32, Parcel 13 - #211-0844
Ralph Maloon, RIM Engineering Co., Inc., and Stan Feck, Christian & Feck Deveiopment, were present.
Gillian Davies, Senior Wetland/Soil Scientist of BSC Group was hired as a consultant for the property to assess the
delineation of wetland resources.
The hearing was continued from the April 26, 2010 meeting to allow Elizabeth time to review the site and to give
the board time to review plans and the consultant's assessment submitted at the April 26th meeting. Elizabeth
concurs with Gilliam Davies that the stream on the property is "intermittent"; the watershed size is not sufficient
enough for a "perennial" stream.
Colin Cauldwell added that there will be a SO ft. set back because of the sensitivity of the property - the land is
adjacent to NRT and ConselVation land - so when the applicant designs the project he should be aware of the set
back. Colin said the applicant would probably have to do river bank, riverfront calculations and restoration.
Lenny Flynn of NRT expressed his concerns about the development of this property. He asked what is being
planned. The board told Lenny the wetland delineation Is the only thing being approved tonight. Stan Feck told
Lenny a sub-division is planned for the site.
Arthur O'Neill, 269 Ware Street, told the board he is concerned about the culvert; during the March rains, the
culvert was nearly overwhelmed. He feels any construction on this property will undermine the culvert, causing
serious flooding. He also told the board the vegetation on either side of the stream has been destroyed.
3
Elizabeth has walked the site and said the flags look good. Derek asked Elizabeth if she agreed the stream is
intermittent. She said she agrees with the consultant's assessment of the stream.
Carole Matthew asked about the certified vernal pool located within the bordering vegetated wetlands; it has not
been flagged - should it be flagged? Elizabeth said it can either be flagged or addressed in the ORAD. She
suggested it be addressed in the ORAD.
Colin Cauldwell made the motion to accept the wetland delineation as presented for #211-0844, Stan Feck, Ware
Street, revision date April 20, 2010.
Michele White asked if the board wanted to add something about the vernal pool. Elizabeth said the following
should be added to the motion - the Conservation Commission is aware there is a vernal pool on the property that
has not been identified; should future work be proposed in this area, the issue of the vernal pool will need to be
addressed.
Elizabeth's addition to the motion was added.
Michele White seconded.
Motion passed 6-0.
Hearing ended at 7:39 pm.
I 5. Notice of Intent: Peter Thibault, Maple Leaf Realty Trust, 557 Maple Street, Map 38, Parcel 46 - #211-0842
Michael Trowbridge of hutchins-Trowbridge, Inc., Deborah Hill of Wetland Strategies, Inc. and Peter and Deborah
Thibault, the landowners were present.
The hearing was continued from the April 26, 2010 meeting to May 10th. Wetland Strategies, Inc. was hired to
review the Notice of Intent filed for 557 Maple Street.
The proposed project is a single driveway to service two single-family dwellings off Maple Street within the 100 ft.
buffer of bordering vegetated wetlands and within an ACEC, the Canoe River. The driveway will require a crossing
of an intermittent stream as well as filling of bordering vegetated wetlands. The site is not within an Estimated or
Priority Habitat of Rare Species.
Michael Trowbridge told the board adjustments have been made to wetland flags as per the letter dated April 2,
2010 from the consultant and Elizabeth. The pian has been revised. He said there are a few items outlined in a
letter, dated May 7, 2010, from the consultant that are outstanding.
He said a cross section of the crossing has been providedi the two 18-inch drain pipes have been replaced with a
48-inch drain pipe with 12 inches buried, leaving 3 ft. for an animal crossing. The bottom of the pipe will be filled
with gravel similar to what is there now. He is also proposing to remove the 18-inch RCP. Michael also told the
board a replication plan has been prepared by Walter Hewitson.
The consultant has recommended an opened box culvert for the driveway. Michael said this is a fairly small
crossing and cost wise the box culvert would be very expensive. He feels the proposed plan accomplishes the
same thing as the box culvert.
Debbie Hill reviewed her reports of April 2, 2020 and May 7, 2010. She said the crossing is proposed as a "limited"
project. She said the Wetland Protection Act allows for Commissions to allow "limited" projects up to 5,000 sq. ft.
of alteration to bordering vegetated wetlands and other resource areas, provided the applicant demonstrates a few
things: the applicant has to demonstrate it is the only means of access to the upland area - Debbie said the
applicant has done this; the applicant needs to show they have minimized the impacts and it is the best alternative
to access upland area while providing a minimum amount of Impacts. Road crossings are on the list for "limited"
projects.
Debbie told the board a portion of the driveway will be within the 25 ft. no disturb area. To minimize the impact to
the wetlands, she suggested the width of the driveway be reduced by using the box culvert or a retaining wall to
4
narrow the crossing. She said most driveways are 10 ft. wide.. She said an open box culvert would work very
well to protect the continuity of the stream.
Debbie had asked for a replication plan that meets DEP gUidelines in "Inland Wetland Replication Guidelines"; the
applicant has provided a replication document. She said the replication plan proposes to retain 9 trees located in
the proposed replication area. She does not agree with this; the excavation for the replication would compromise
the root system and would not be good for the overall health of the trees.
Debbie asked for a cross section of the replication area as outlined in DEP guidelines.
She recommended the pipe and stone wall at the cart path be removed. All areas impacted should be restored
back to original conditions. Any temporary impacts would also need to be restored. She recommended that the
old wetland flags be removed before any work starts to avoid any confusion.
Debbie asked that a monitor be hired to be there at certain milestones; when the area is first staked out; when it is
initially excavated to make sure there is adequate hydrology and before they put the wetland substrate in; once
when it is graded but before it is planted to make sure it is the proper elevation and will support a wetland
community. The monitor should also visit the replication area after it is planted and monitor the area for two (2)
growing seasons. The monitor should submit reports and photographs for each growing season.
In the initial report, Wetland Strategies had suggested, because of its location, that the replication area be done
first, but are now proposing to use materials from the crossing for the replication. Debbie said she can help with
conditions to make sure it is done correctly.
Debbie and Michael are in agreement with most of the recommendations accept the box culvert.
Carole Matthew said Debbie is essentially speaking for Elizabeth because, with Elizabeth's reduced hours, she does
not have the time to properly review this project.
Elizabeth said the board needs to look at all the information; she said the biggest concern is the stream crossing.
Because it is a "limited" project in an ACEC, the board is obligated to minimize any impact; minimum standards are
not going to be sufficient. Debbie said she is just looking at the best standard practices for the project.
Greg Abbott, an abutter to the property, told the board he does not object to what is being planned, if it is
permittable and within the guidelines. He said there is a lot of water back there; the area is wet for 8-9 months of
the year. He said he has lived there for 16 years.
Abutter Brad Brooks, 7 Brian Lane: He said he has lived there for 5 years and owns 2.5 acres. He told the board
the area is never dry and he Is very concerned. He said the water is constantly flowing directly on to his property
12 months of the year. Of the 2.5 acres he owns, 1.5-2 acres of the property is consistently under a foot of water.
He is very concerned about the project and how it is going to impact his property.
Colin Cauldwell asked Debbie to outline the deficiencies in the replication plan and the stream crossing and how
they can be remediated.
Some of Debbie's recommendations:
Cross section of box culvert at the stream crossing
Detailed cross section of wetland crossing
Soil analysis
Cross section of replication area showing existing and proposed elevations- to aid contractor during construction
Hire a monitor for the project to oversee the construction of the replication area; the monitor would oversee
excavation, inspect and verify the siltation fence, make sure the hydrology of the replication area is sufficient to
support a wetland plant community
Monitoring plan: replication area plantings should be monitored for two (2) growing seasons to make sure the
plantings are healthy - any dead or dying plants would be replaced. A report should be submitted as to the health
of the replication area at the end of each growing season
5
Restoration plan be submitted for any temporary impacts to the resource areas. Restoration plan for the removal
of the pipe at the cart path should also be submitted
Existing and proposed grading
Proposed silt fence to be placed at the un-impacted wetland and the replicated wetland interface to prevent any
damage to the wetland areas during restoration/replication
All material removed from the proposed replication area should be removed from the site unless the materials are
to be used as part of the replication
Determine adequate hydrology: during excavation and prior to the placement of the substrate, replication area is
to be inspected
Contingency plan for additional needed soils if existing site soils are not sufficient
A wetland seed mix can be planted in the replication area for stabilization
In the replication plan, 9 trees were to remain in the replication area; this comment will be removed from the plan
Colin Cauldwell made the motion to require the applicant to design a box culvert for the application for the
consideration of the Commission and continue the hearing to May 24, 2010.
Colin suggested the board do some research themselves regarding culverts.
Hearing ended at 8:51 pm.
The hearing was continued at the April 26, 2010 meeting so the board could review the letter from Natural
Heritage and the memo from Rick Alves.
Dave White, Woodard & Curran was present.
The proposed project consists of the construction of a clear water storage tank, pump building and backwash
storage tank with associated gravel access drive and underground utilities at the Walsh Well Site within the 100 ft.
buffer of bordering vegetated wetlands and the 200 ft. Riverfront Area of Wading River. The site is also in a
Priority Habitat and an Estimated Habitat of Rare Species.
Dave White toid the board all outstanding comments by Rick Alves, Interim Town Engineer, have been addressed
in a letter dated April 30, 2010.
A memo from Rick Alves states that the revised site plan drawings and drainage calculations have satisfactorily
addressed his remaining concerns addressed in the March 24, 2010 memorandum. In the May 5, 2010
memorandum, he noted that page 8 of 9 shows a Polypropylene corrugate wall stormwater collection chamber but
page 6 of 9 shows an 8 ft. diameter leach pit which is not correct according to the drainage calculations. Page 8 of
9 is correct. The board asked for a revised page 6 of 9.
Elizabeth told the board the letter from Natural Heritage, dated May 5, 2010, (NHESP File # 10-28033) states the
project will not adversely affect the actual Resource Area Habitat of state-protected rare wildlife species. A letter,
dated April 19, 2010, stated a state-listed rare species, the Blanding's Turtle, had been found on the site. The
MESA report stated the project, as currently proposed, will not result in a prohibited "take" of the state-listed rare
species.
Derek House asked that one sign, reading "Environmentally Sensitive Area-Do Not Disturb", be placed at the
entrance way of the property because of the wells.
Derek House made the motion to accept the Notice of Intent for Walsh Well Field Water Treatment Facility, #211-
0849, as presented to the board at the last meeting, pending the submittal of the revision for page 6 of 9; Other
standard conditions to apply: silt fence to be inspected by Elizabeth and remain in place until work is complete and
area stabilized; any flagging, silt fence and hay bales are to be removed with the approval of the agent when the
project is complete before Certificate of Compliance is issuedj one sign, reading "Environmentally Sensitive Area-Do
6
Not Disturb", to be placed at the entrance way of the property; an as built to be submitted for the Certificate of
Compliance.
Paul Boyden seconded.
Motion passed 6-0.
Hearing ended at 9:07 pm.
I 7. Notice of Intent: Perry DiMascio, Essex Street, "Autumn Park", Map 37, Parcel 16 - #211-0850.
The Notice of Intent was filed for the completion of Autumn Park Subdivision; the work is within the 100 ft. buffer
of bordering vegetated wetlands and an Area of Critical Environmental Concern, the Canoe River. The new Notice
of Intent was filed because the original Order of Conditions, DEP #211-776, has expired.
Ralph Maloon , RIM Engineering, and Perry DiMascio were present.
Ralph told the board the base coat for the roadway, underground utilities, culvert for wildlife corridor and detention
areas are done. Siltation controls are in place. The remaining work to be done includes installation of curbing,
construction of the sidewalks, asphalt topcoat, and loaming and seeding of the grass plots on the sides of the road.
Elizabeth told the board that DEP has commented that the new Stormwater Management Regulations would apply
to the new filing. The expired Order was reviewed under the old standards. She said Rick Alves, Interim Town
Engineer, needs to take a look at the project.
Perry DiMascio told the board all the Stormwater Management systems survived the March storms; all functioned
well. He said under the new regulations the only thing that would apply would be the calculations for the 4 inches
of loam needed for the grass areas.
Michele White said he would have to fill out the new form for Stormwater Management and have an 0 & M plan for
the remaining work. The Town Engineer would have to approve the remaining work.
Derek House would like to walt to hear from Rick Alves before approving the remaining work, especially since Rick
has asked that Conservation not issue Orders of Conditions until he has approved a project.
Colin Cauldwelll asked if there were any other issues with the project. Elizabeth said there are some areas where
the silt fence needs to be replaced. Colin asked that hay bales be added to the silt fencing especially around Lot
10. Lot 10 has an active Order of Conditions. Colin also asked that the silt fence in front of the critter crossing be
removed.
Paul Boyden asked if an as built for the sub-division had been done. Perry DiMascio said he can't do the as built
until the curbing and sidewalks are in. He told the board he received a call from Mike Ahern (DPW). Mike would
prefer the roadway not be completed until the project is built out. Perry would like to complete the road and the
residents aiso would like to see the road completed. Perry said he would like to get the approval to get the
remaining work done.
Colin Cauldwell made the motion to continue the hearing for the Notice of Intent for Essex Street, "Autumn Park",
to May 24, 2010, pending the updated Stormwater Check List and the Town Engineer review and comments.
Paul seconded.
Motion passed 6-0.
Hearing ended at 9:26 pm.
I 8. Request for Determination of Applicability: Alan and Pamela Neipris, 9 Day Avenue, Map 23, Parcel 43.
Michael Trowbridge of hutchinsTrowbridge Associates represented Mr. and Mrs. Neipris.
The RDA was filed for a 14'x24' addition to an existing house.
7
Michael told the board all work will be outside the 100 ft. buffer to bordering vegetated wetlands but within the
200 ft. Riverfront area, Lyons Brook. He said siltation control and a drywell are shown on the plan but requested
the board waive both; the actual disturbance will be even greater by putting the drywell in.
Elizabeth said this is a small addition on existing lawn, well below the 10% of the lot and the area is very well
vegetated. Colin agreed with Elizabeth and asked how the board felt about waiving the drywell and silt fence. The
board will not require the drywell or silt fence.
Colin Cauldwell made the motion to issue a Negative 3 Determination for 9 Day Avenue for an addition to an
existing house and to remove the proposed siltation control and the drywell because the area is very flat and well
vegetated.
Paul Boyden seconded.
Motion passed 6-0.
Hearing ended at 9:30 pm.
I 9. Request for Determination of Applicability: Domenic Barbero, 900 West Street, Map 9, Parcel 51.
Domenic Barbero, the homeowner, was present.
The RDA was filed for the installation of an above-ground pool, deck and fencing within the 100 ft. buffer of
bordering vegetated wetlands.
Mr. Barbero questioned the distance of the pool from the wetlands on the property. Elizabeth said the pool would
be located 64 ft. from the wetlands. Derek House went to the property last week and measured 97 ft. from the
wetlands. Elizabeth questioned the measurement and after explaining what criteria is used for determining the
wetland line, the measurement of 64 ft. stands as the true wetland line.
Mr. Barbero told the board there was a pool, decking and a fence in the yard for the last 35 years; he said the pool
was destroyed when the house burned. He wants to replace the pool, to be located where the old pool was. The
filtration system will be upgraded also. The application also includes a shed.
Elizabeth said the fence will be 52 ft. from the pool. Mr. Barbero said the fence would likely be a stockade fence.
He said the fence is not on the property line.
Joe Mulkern asked that signage, reading "Environmentally Sensitive Area - Do Not Disturb", be put on the fence.
Elizabeth had told Mr. Barbero the back of his property is located entirely within a Zone A flood zone according to
GIS and the 2008 Flood Zone Maps. Mr. Barbero said he had RIM Engineering look at the property and RIM has
certified the property is not in a flood plain. This is written on the plan.
Colin Cauldwell reminded the board the fence will be in the 25 ft. no touch. Michele White said there is a gate in
the fence and because the fence is so close to the wetlands, Mr. Barbero needs to be made aware he is not
allowed to dump yard waste or work in this area. Derek House asked that the gate be eliminated. He felt the
fence would protect the wetlands. Mr. Barbero agreed not to put the gate in the fence.
Derek House made the motion to accept the RDA for 900 West Street and issued a Negative 3 Determination for
the installation of a 27 ft. above-ground pool with a deck and fencing as a replacement for an existing pool and to
add a fence at the back of the property line; no gates to be put in the fence. One (1) sign, reading
"Environmentally Sensitive Area - Do Not Disturb", to be place on the fence behind the shed.
Carole Matthew seconded.
Motion passed 6-0.
Mr. Barbero was told there was an endangered species in the back of the property. Elizabeth said there is not. He
also asked that if any members of the Commission would like to come out and view the property, they please call
ahead to make an appointment. He said he would like to be present.
8
Hearing ended at 9:45 pm.
Rich Riccio, Field Engineering Co., Inc. was present.
The amendment to an Order of Conditions, issued April 14, 2009, is for the reconstruction of the existing parking
and loading areas and the construction of two new concrete sidewalks with railings within the 100 ft. buffer of
bordering vegetated wetlands (BVW).
Rich Riccio told the board the existing paved surfaces are in poor condition. The new paved surfaces will be
located in the same area as the existing parking areas.
The new sidewalk on the westerly side of the building wili include concrete steps. Railings will be added on the
wetland side of the sidewalk for safety and to keep anyone from entering the area. The sidewaik will be outside
the 25 ft. no touch. An existing sidewalk on the 25 ft. on touch is faliing apart and will be reconstructed in place
and will also have railings on the wetland side.
The applicant is proposing to remove some portions of the existing paved surfaces in the 25 ft. no touch and
replacing the pavement with a grass swale, resulting in a net decrease of 850 sq. ft. of impervious and a net
decrease of 500 sq. ft. of impervious in the buffer zone.
Rich said he had reviewed the plans with Elizabeth and Rick Alves, Interim Town Engineer. Rick asked that the
applicant clean out the existing flared ends and provide rip-rap pads at the flared ends and add filter fabric under
the rip-rap. Rich Riccio said he did not have a problem with this and it can be added to the Order of Conditions.
In a ietter dated May 10, 2010, Rick said the drawings show no increase in impervious materiai, therefore
additional drainage is not needed and he finds the plan acceptable.
Elizabeth has no comments. She said it is improving what is already proposed. AIi conditions from original filing
will apply to the amendment.
Rich Riccio said the parking lot sheet flow goes to the street or to the depression to the left of the property. He
said they are maintaining ali of the drainage that is currently there, actualiy improving it with the rip-rap around
the pipe at the outlets.
Rich Riccio told the board silt fence with hay bales will be instalied. Erosion controls are noted on the construction
plan.
Paul Boyden made the motion to accept the amendment to the Order of Conditions, issued April 14, 2009, plan
dated April 21, 2010.
Carole Matthew seconded.
Motion passed 6-0.
Hearing ended at 9: 52 pm.
Dave Troilo, 167 Dean Street, Map 26, Parcel 105: Wetland Violation - Mr. Troilo cut several mature Red Maple
trees and removed wetland vegetation within bordering vegetated wetlands to a stream. An Enforcement Order
was issued April 13, 2010.
Mr. Troilo presented a restoration plan done by BSC Group. It is the first time Elizabeth and the board have seen
the restoration plan. She said BSC Group is an excelient company. She told the board no excavation will be
required and no grade changes are necessary. Dave Troilo said he will do the restoration as soon as possible; the
9
work will be done under the Enforcement Order. Restoration plantings will be checked within a year to make sure
the plants are healthy.
Colin Cauldwell made the motion to accept the planting schedule for the restoration of the wetland disturbance at
167 Dean Street, reference "Wetland Restoration Plan for 167 Dean Street", dated May 3, 2010.
Paul Boyden seconded.
Motion passed 6-0.
Elizabeth told Dave he has 30 days to complete the work under the Enforcement Order. She told him if he needed
to continue past the 30 days, he would need to contact Conservation.
Lou Andrews wants the Commission to know that all deeds for the Gilbert Street properties presented at the May
Town Meeting need to be updated and re-filed. The warrants need to be sent to Bob Mangiaratti, Town Council.
Paul Boyden made the motion to send to Town Council all the warrants presented at the May Town Meeting for
updating.
Carole Matthew seconded.
Motion passed 6-0.
Colin made the motion to adjourn at 10: 15 pm.
