PRESENT: Joe Mulkern, Chairman; Paul Boyden, Vice Chairman; Derek House; Colin
Cauldwell; Michele White; Jack Smith; Elizabeth Leidhold, Conservation and
Environmental Planner.
Meeting called to order at 7:00 pm
Colin Cauldwell made the motion that the board send a letter of apology to the residents
of 900 Maple Street. Michele White seconded the motion. Motion passed 6-0.
11.ANRAD:Stan Feck,Ware Street,#211-0844.
Verification of wetland flags.
Applicant has asked for a continuance to April 12, 2010.
Colin Cauldwell made the motion to continue to April 12, 2010.
Paul Boyden seconded.
Motion passed 6-0.
2. Request for Determination of Applicability: Christopher and Julie Spillane, 6
Riverwood Drive - Map 5 Parcel 153.
Michael Trowbridge of hutchins-Trowbridge Associates, representing the Spillanes.
Michael told the board the septic system is in failure. The existing trenches will be
abandoned and a new "D" box will be installed along with 2 new trenches. The new
system will be under new Title 5 regulations.
The new system will be placed just to the right of the old system and will be
approximately 61 ft. from the wetland line. The grade will stay the same. Silt fencing is
indicated on the plan to the east side of the work, on the septic side of the driveway.
Elizabeth said the new system will be at least 25 ft. from the wetland. She questioned
the depression to the left of the house; a swale has been created in this area. Michael
said the area was never a wetland area. It is the result of the houses on either side
being built up.
Elizabeth said it is a good project and is improving the existing conditions. She wanted
the board to know she did not look at the delineation but did ask Michael to put more
flags in the area. She asked that the board approve the proposed work but not the
delineation.
The area will be loamed and seeded when work is finished.
1
Colin Cauldwell made the motion to accept the plan as drawn for the repair of the septic
system at 6 Riverwood Drive, plan dated 3/2/2010 - no revisions - and to issue a
Negative 3 Determination. Approval only for the proposed work; Wetland delineation
not approved under this filing.
Paul Boyden seconded.
Motion passed 6-0.
Hearing ended at 7:06 pm.
3. Request for Determination of Applicability: Sturdy Memorial Hospital, Mansfield
Health Center, 200 Copeland Drive - Map 44, Parcel 2024.
Shane Rioux of Hayward, Boynton & Williams was present.
RDA was filed for the maintenance of vegetation per Order of Conditions issued July 27,
2004, #211- 705.
Work will include the topping of trees and pruning to achieve visibility of the sign from
Rte.140.
Elizabeth told the board the original permit was for the removal/pruning of trees and
shrubs and for yearly maintenance of tree tops and shrubs to approximately 6 ft. in
height; there is no grubbing involved.
Shane Rioux said the soil would not be disturbed; every1hing would be removed by
hand. He said the last time the area was pruned was 2004-2005.
Colin Cauldwell asked if the brush would be left on site or removed. Shane Rioux said it
will be removed by hand.
Paul Boyden made the motion to accept the plan as delineated for maintenance of
vegetation, plan dated June 30, 2004, and to issue a Negative 3 Determination.
Jack Smith seconded.
Motion passed 6-0.
Hearing ended at 7:10 pm.
4. Request for Determination of Applicability: Appaloosa Realty Trust, 3 Buckskin Drive,
Lot 5, Map 6, Parcel 152.
Michael Trowbridge of hutchins-Trowbridge Associates was present.
2
RDA filed for the construction of a single-family 4-bedroom house and septic system
within the 100 ft. buffer of bordering vegetated wetlands. Any grading will be entirely
out of the 50 ft. buffer. Silt fence is proposed at the 50 ft. line.
Dry wells are proposed for the infiltration of the roof drains.
Septic system will be installed more than 150 ft. from the wetlands.
There is an intermittent stream on site; stream is shown on the US GIS and was shown
on the original sub-division plan as existing.
Derek House would like signage along the 50 ft. line.
Elizabeth asked where the "limit of work" Is and asked if the applicant was proposing a
lawn, landscaping. Michael said every1hing is outside the 50 ft. "no touch" - nothing is
proposed beyond the 50 ft.
Elizabeth recommended silt fence with double-staked hay bales.
Elizabeth asked if the board wanted the down slope by the river to be stabilized with an
herbaceous cover. Jack Smith asked if the piles of fill in this area would be removed.
Elizabeth said if the piles were removed, the area would have to be stabilized with rye
grass or an herbaceous cover.
Colin Cauldwell made the motion to accept the plan as drawn for 3 Buckskin Drive, plan
dated March 1, 2010, and to issue a Negative 3 Determination with the following
conditions: agent is to be called to inspect erosion controls - silt fence with double-
staked hay bales - before any work begins; no landscaping, no activity beyond the 50 ft.
"no touch"; old and new silt fencing to be removed when project is done and area is
stabilized; signage on the 50 ft. line, every 50 ft on posts, for a total of 3 signs, to read
"Environmentally Sensitive Area - Do Not Disturb"; if the piles of fill are removed from
the down slope by the river, the area is to be stabilized with either a rye grass or
herbaceous cover.
Michele White seconded.
Motion passed 6-0.
Hearing ended at 7:21 pm.
5. Notice of Intent: Mansfield Athletic Complex, Plymouth Street Soccer Fields, Map
10, Parcel 21. #211-0847.
Kelly Kemp, Vice President of Mansfield Youth Soccer, Robert Weidknecht, Senior
Associate of Beals & Thomas, Inc. and John Amato of JJA Sports were present,
An ANRAD was filed with an ORAD issued October 20. 2009, confirming the BVW,
bank, Riverfront area and buffer zone.
3
The site of the project is the Plymouth street Soccer Fields, with Plymouth Street to the
north, a wooded area on the south side, a perennial stream to the east and Hodges
Brook to the westerly side.
The site is not within a Natural Heritage area or an ACEC.
Resource areaS include bank associated with the perennial stream, Hodges Brook; 3
wetland areas with one containing a potential vernal pool, bordering Hodges Brook and
1 wetland area considered a man-made $torltlwater basin containing an outlet pipe and
rip-rap swale connecting the basin to Hodges Brook; Riverfront area.
Alteration in the Riverfront area from the expansion of the detention basin and
stormwater discharge will be approximately 17,000 sq. ft.
Robert Weidknecht explained the proposed project which includes the removal of the
existing athletic fields and replacing them with a synthetic turf field and to mitigate for
any changes to the run-off from the fields; the expansion of the existing detention basin
(increasing the basin size to accommodate the additional run-off from the new field) and
modification to the outlet control structure of the basin to better control the flow. The
project would provide sub-surface infiltratioli trenches under the fields, providing better
drainage for the fields, an improvement to the stormwater management. In addition, 2
handicapped parking spaces would be constructed adjacent to the existing concession
stand as well as a paved parking area and palled walkway for better access to the fields.
Asphalt would be used for the paved areas.
The project will increase the use of the fields and allow for a longer playing season,
reduce field maintenance and improve the drainage system.
Work within the outer 50 ft. buffer will conSist of the 2 handicapped parking spaces and
the expansion of the existing detention basin. No work will be necessary within the 25 ft.
no touch area.
Erosion control will be staked straw waddles instead of hay bales. Stockpile areas will
have silt fencing. The detention areas will be protected during construction.
John Amato of JJA Sports showed the bOard samples of the synthetic turf. The turf is
made from rubber products and oil and is a safe product. He explained the construction
and cost of the fields, and told the board the required maintenance is less than for
natural grass fields. He said the turf is warranted for 8 years but depending on the
usage and maintenance, the fields could last longer. He explained how the fields would
be repaired and if necessary, replaced. Precautions would be used to prevent damage
to the resource areas during the repair or replacement process.
Some of the concerns the board has with the project are the cleaning and maintenance
of the synthetic turf fields - what cleaning products would be used on the fields? How
4
would static on the fields be handled - hOw Would the rubber and oil, materials the turf
is made from, be prevented from entering tM resource areas? Are there plans to paint
the fields; will the fields be permanently painted for soccer or would other sports be
played on the fields, requiring additionalpalhting of lines on the fields? What kind of
paint would be used and how would it be removed from the fields?
Robert Weidknecht of Beals and Thomas Inc. said an O&M plan would be developed for
the maintenance of the fields. Mansfield's DPW would be responsible for the
maintenance of the drainage systems, etc. Mansfield Youth Soccer would be
responsible for the grooming of the fields. A Stormwater Pollution Plan has been
drafted.
John Amato of JJA Sports in Westford, MA told the board the cleaning of the fields
would require very small amounts of cleaning products. The static on the fields would
be handled by ordinary fabric softener sLiCh as Downey - again in a much diluted form.
No solvents will be used on the fields.
John told the board the field would probably be permanently line for soccer. Kelly Kemp
told the board at this time the plan is to Lise the field exclusively for soccer. She said it
would be up to the Parks and Recreatioh Department to issue any permits for further
use of the field as far as other sporting venues. She said Mansfield Youth Soccer is not
opposed to others using the fields.
John said if other sports venues such as hockey were to use the fields; the fields would
have to be re-lIned on a temporary basiS, He said there is special paint to use, to be
diluted and then cleaned with a small amount of cleaning solution. Derek House said
he was concerned about any chemicals to be used on the fields either for cleaning or to
remove paint. Again John said no solvents would or should be used on the fields.
Elizabeth asked if he would recommend products to be use on the fields. She
suggested this be put into the Order of Conditions to address this issue.
As far as materials from the synthetic fields migrating into the wetlands or other
resource areas, John said the walkway, grass and the sub-surface infiltration trenches
would serve as a barrier. He said the rUn-off of the rubber and oil from the fields is
minimal. Elizabeth asked that the basins be inspected periodically and if rubber or oil is
found, the materials will be removed. She suggested this could be added to the Order
of Conditions.
Derek House asked if there were plans to put a fence around the detention basin. John
Amato said a fence is not planned but can be discussed. He said it would be another
expense for Mansfield Youth Soccer.
Rick Alves, Interim Town Engineer, asked that the board hold off on final approval so he
can meet with the engineer and review the project. He is concerned about ground
water elevations.
5
Lenny Flynn told the board he is concerned about the drainage plan; the area is wet;
this has always been a problem with the fields. He asked if there is an increase in the
flow rate off the property and will any of the run-off enter Hodges Brook? Robert
Weidknecht said peak run-off is controlled by the outlet control structure. Lenny said the
board should wait until the town engineer has had a chance to evaluate the drainage
system. He also expressed his concerned about pieces of material from the field and
the cleaning products used to clean and maintain the fields entering the drainage
system or Hodges Brook. John Amato told him the amounts of cleaning materials used
are minimal - maintenance calls for much diluted cleaning solutions. The amount of
material leaving the field would be small.
Johanna Barry of AMB, an abutter to the fields, also was present. She said AMB
originally donated some of the land for the fields and also owns land on the other side of
the property.
Joe Mulkern asked if the board wanted to approve pending a report on the drainage or
continue the hearing. Colin would like to have the drainage report before approval.
Derek House made the motion to continue the hearing for the Plymouth Street Soccer
Fields until April 12, 2010.
Colin Cauldwell seconded.
Motion passed 6-0.
6. Request for Certificate of Compliance: Rosewood Realty Trust (Copeland Crossing)
#211-686 and #211-687,
Colin Cauldwell made the motion to open the hearings for #211-686 and #2110687 and
to continue to April 26, 2010.
Paul Boyden seconded.
Motion passed 6-0.
Derek House asked if the applicant would need to re-file because the Order of
Conditions has expired. Elizabeth said the applicant has not finished the wetland
restoration.
Colin Cauldwell said the applicant would need to file a new Notice of Intent with plans;
he can't do any more work because the NOI Is no longer valid. He does not have a
permit to do the restoration. Elizabeth said the restoration can be done under an
Enforcement Order. Colin would prefer a new NOI be filed because then the board has
more control over the work being done.
Elizabeth told the board they can issue an Enforcement Order to make him do the
restoration as per the Order of Conditions that was already issued or make him re-fiIe.
6
The board would like Elizabeth to call or send a letter letting the applicant know he can
not do anymore work without a new filing or an Enforcement Order being issued.
17.QldBusiness:
Paul asked about 130 Forbes Boulevard - the water table issue. The Order of
Conditions will be issued pending approval by Rick Alves.
Michele White made the motion to approve the minutes of March 8, 2010.
Derek House seconded.
Motion did not pass. 3-0 with 3 abstentions.
The board will wait to approve the minutes until all board members have had a chance
to read the minutes.
I 8. Adjournment:
Colin Cauldwell made the motion to adjourn at 8:45 pm.
Derek House seconded.
Motion passed 6-0.
