M~eting called toorderat7:05pm. 12. Notice of Intent: Southbound Ramp- 495 ___MassHighway-#211 ~0836 Tom Maguire, District Environmental Engineer for Mass Highway District 5 in Taunton, Henry Barbaro, Mass DOT, Maryann Magner and Heather Fuller of Jacobs Engineering Group were present. Henry Barbaro said the applicant has met with the Airport Commission to explore the idea of using airport land for off-site mitigation for the Riverfront impact to the unnamed tributary. This was not feasible; however they are still willing to perform the following items but not as Riverfront mitigation. The 3 elements to the plan are: 1.) Restore the actively eroding stream bank on the airport parcel to the Back Bay Brook which has caused sediment to flow down stream. The plan called for the clearing of the stream culvert, presently filled will sediment. 2.) Restore a 3+/- acre parcel - the Clemmey property -contiguous to the unnamed brook, as well as other Conservation land - removing structures and impervious areas and restore with plantings. 3.) Control and manage invasive plants within the Riverfront area along the state highway layout, amounting to approximately 75,000 sq. ft. of Riverfront area that will be improved by removing and controlling invasive plant species. (7,000 sq. ft as the initial impact to the Riverfront area). Maryann Magner said there is 1,700 sq. ft. of degraded Riverfront on the Clemmey property and this will be the Riverfront mitigation. They will clean up the site and reseed. Invasive species control would require an environmental sub-contractor be hired to develop an Invasive Species Program and monitor the area for 3 years. The sub-contractor would be subject to Conservation approval. On the airport property the eroding bank would be proposed as additional environmental enhancement, not part of the Riverfront mitigation. Also the double-barrel culvert on the airport property would be cleared. Elizabeth thinks mitigating on the Clemmey property would be a better project but the board has not had time to review the proposal. She questioned if this would meet DEP guidelines? Henry Barbaro said DEP supports the concept. 1 Elizabeth asked how much of the restoration will be done on-site. Maryann Magner said approximately 3,800 sq. ft. will be restored on"site, a ratio of 1 :1. Elizabeth asked if Mr. Clemmey is aware of the plan. Maryann Magner said the state now owns the property and she said the state is proposing to deed the land to the town. Paul Boyden asked if the property is completely in the state's hands. Is Conservation going to be able to access the property for monitoring without problems? Henry Barbaro - DOT -said he would make sure of it. Elizabeth asked if the state was proposing to Elradicate the invasive species on the Clemmey property. Maryann Magner said a survey would be done first to see what is out there. Elizabeth asked if a three-year plan would be long enough to get rid of the invasive plants. Maryann said Mass Highway's plan is three years. Paul Boyden asked if the Invasive Species Plan is written in one of the programs. Maryann said it is not; It would be done the way the Erosion Control Plan is done; the contractor would hire an environmental sub-contractor. The sub-contractor and the plan would be subject for approval by the board. Tom Maguire said as soon as the permitting process Is complete, the project would go out for bid. He told the board Mass Highway might have to come back to the board for an extension of the Order of Conditions. He said when the work is completed, they will have to come back for the Certificate of Compliance (COC). Elizabeth was under the impression that a COC was not required for Mass Highway projects, that Mass Highway does not record the OC or come back for a COCo Tom Maguire said this is not correct; the cod gets recorded on Mass Highway projects. He said the contractor will outline all requirements discussed tonight along with the special conditions discussed at the December 14, 2009 meetin~. He said the contractor will hire an environmental monitor/consultant to do a planting plan, erosion plan, etc. He said the project engineer and over- sight people will be watching the project as closely as the board will. Joe Mulkern asked If the Environmental Monitor would be checking in with the board periodically. He said he would like the Environmental Monitor to come to every Conservation meeting while the work is being done. Maryann Magner said the monitor probably would not come to every meeting but would submit reports and coordinate field inspections with Elizabeth. She said "the monitor will be the commission's eyes on the job and will repbrt to you. You can say you want weekly reports during certain periods of construction; there will be other times during construction within the resource areas, when the board might want t6 check the erosion control". Elizabeth said this can be a special condition. Tom Maguire said Mass Highway would work with the board to decide the special conditions. Elizabeth said the special conditions were disoussed at the last meeting; she has additional conditions to be added, including that the project engineer will submit regular reports to the Commission. Are the conditions read at the .Iast meeting and the conditions mentioned tonight sufficient? Is there anything the board would like to add.? Elizabeth said she understood the board would be able to help choose who the contractor and the Environmental Monitor would be. Maryann Magner said the contractor would select someone: that person would present their qualifications for the board's approval. If that person is not acceptable, the board has the power to say he/she is not acceptable. This will be in the contract. 2 Colin Cauldwell asked how many Square feetthe. Clemmey property is; he said he is not aware it is contiguous with any Conservation land. Maryatil:l Magner said the property is approximately 3 acres. She said the parcel is bound by the highWay on one side, Route 140 on the other side. Lou Andrews said it is airport land. Colin thought the land might be own by the town, but not conservation. Colin Cauldwell: "Let's not pri;jtehd it is going to be contiguous with Conservation land." Derek House asked if the Invasive Species Plah covers the 9,000 sq. ft. of mitigation the board is looking for -is it mitigation of wetlahds or just colitrol of invasive species? If not, can we look at increasing the area down by the roadway tOOOrh$ up with the 9,000 sq. ft.- can the mitigation be continued up the slope to increase the wetlaHd? Heather Fuller said "to be clear, it is not wetland mitigation, it is Riverfront mitigation. So Increasing the wetland area will not mitigate the Riverfront." Henry Barbaro said DEP considers that an acceptable form of mitigation. Elizabeth asked if the board would like to g00ul and look at some of the areas discussed tonight and take photos. Elizabeth asked il any of these areas are marked in the field. Carole Matthew said the board might want to have something froth Derek Standish (DEP Boston). Elizabeth said she would check in with Derek StaNdish tomorroW, Paul Boyden asked who the contracting auth(jrity would be. Is it the state, Jacob? Tom Maguire said it is Mass Department of Transportatloh Highway Division. 'We (Mass DOT) will be overseeing construction of this project from oUr District 5 office in Taunton. We will have a resident engineer on the project." Paul Boyden said he would like to make sure tHEiland is free and clear. Henry Barbaro said he would contact Mass Highway's Ri~ht-of-Way division to make sure the land is state owned. Paul Boyden said there should be a deed and thi;l deed should have been recorded at the Registry of Deeds. Heather Fuller said it was recorded In July 2009; Mr. Clemmey vacated the property in November. Joe Mulkern asked if there were any questions Irom the Airport Commission. Lou Andrews said no, the Airport Commission will meet separately to discuss if they want to go forward. He asked Maryann Magner if she would be filing separatelY for the airport work or would it be part of the Mass Highway project. Maryann said if it is approved, it will all be part of the highway project. Joe Mulkern said he thought any airport work would be a separate issue, requiring a new filing. Elizabeth said the board was permitting the airport work as part of the mitigation. Maryann Magner said the airport work is not Riverfroht mitigation but considered an enhancement. Colin Cauldwell said the airport work is not countirig toward the required mitigation. Joe Mulkern asked if all the work will be done by the same contractor. Maryahn said yes. Elizabeth: "Do we have any details as to what yoU are proposing at the airport? Can we see what you are proposing? This was not ih your ori~lhai Notice of Intent." Paul Boyden suggested that the Notice of Intent be amended to include the airport work. Tom Maguire said this has been done in 3 the letter from the Airport Commission to the Conservation Commission. Paul Boyden said the board would consider the letter an amendment to the Notice of Intent. Elizabeth said she would like to sM evidence that DEP has seen the proposed airport work. Paul Boyden said if the letter is used, it should be riOted somewhere for future reference. Derek House asked what happens if the board approves the project to go forward and the Airport Commission says we don't want you touching the Back Bay Brook. Colin Cauldwell said they have 3 years to do the work then they wduld have to re.file if they want to do it. Derek House made the motion t6. continue to the January 25th meeting to allow Elizabeth to contact DEP, do a field visit and come up with additional conditions for final assessment. Colin Cauldwell asked Tom Mag~ire what the continuation would do to the schedule. Tom Maguire said it would put the project back another 2 weeks. Colin Cauldwell seconded the motion. Joe Mulkern asked Elizabeth if she would have enough time to work on the special conditions for the next meeting. Elizabeth said the conditions are going to stay the same. She would like more details about how Mass Highway is going to clear out the drainage facilities. Tom Maguire said Mass Highway generally sets up a silt boom down stream to prevent any more sediment from going down stream during the cle$ning of the culvert and the removal of materials from the site. Then they clean up down stream. He said this coulCl be added to the letter. Henry Barbaro said this work should be done In low flow periods so the impact would be minimal. Motion to continue to 1/25/2010 passed 7-0. I 3. Notice of Jntent:Johnand POnDa Moran,1.5StQrbridgeDrive,Map 41, Parcel 194-#211-0838 Donna Moran, the homeowner, and Dave Hobaica; Easton Pool and Spa were present. The hearing was continued from December 14, 2009. The Notice of Intent was filed for the installation of an in-ground pool with concrete decking. A 4 ft. 6 inch chain-link fence will surroLlnd the pooL T~e area is within an Estimated Habitat of Rare Wildlife and an ACEC, the CanoEi River. A MESA review was submitted. A letter was received from Division of Fisheries & Wildlife, dated NoVember 13, 2009. At the last meeting the board asked that the pool be moved further away from the wetlands. They asked that a revised plan be submitted with the 50 ft. line and elevations added to the plan. The location of the dewatering well also needed to be added to the plan. The board asked that the concrete apron be wider toward tHe house and the pool be moved to the left, 6-7 ft., toward the property line. Dave Hobalca was also asked to provide a cross-section of a Froglog for the board 4 to see. A revised plan was to be submitted showing the new position of the pool, the fence location, the elevations, the 50 ft. line and the location of the dewatering well. Dave told the board the pool has been moved 8-1 () fl. toward the side of the property, moving the pool further from the wetlands. He told the board there will not be a patio on the back side of the pool. Derek House asked if the board could ask for the replanting of the area between the existing shed and the property line, in the 25 fl. no touch area, as an extra buffer to prevent any runoff from the pool. Carole Matthew said the project is ~xisting so 2.6 of the b-Iaw does not apply to the project and the plan is meeting option 1 and 2 of the NHESP recommendations/requirements. Dave Hobaica told the board the grade on the back side of the pool will be dropped approximately 16" to serve as a barrier for frogs and salamanders. He also said that the homeowner plans to put stepping stones in the area at the back side of the pool where there is no patio. The homeowner may also put some plantings in this area. Dave H()baica asked if grass could be replanted in this area (in the area outside the 25 fl. buffer) between the pool and the fence. The board said yes. Because the pool was moved frotii the original J:lbsition, Dave Hobaica said two (2) trees, 1 oak and 1 pine, will have to be removed. Dave said he Would note on the plan the trees to be removed and add the stepping stones and the grass area. Carole Matthew made the motion to accept the plan for an in-ground pool at 15 Sturbridge Drive, revised plan dated January 5, 2010, noting that It does meet the by-law because it was existing before the by-law; the project meets the Fish and Wildlife recommendations, both options 1 and 2, concerning rare species requirements, as outlined In a letter dated November 13, 2009 - received December 2, 2009. An up-dated drawing with Up-dated landscaping and the removal of two (2) trees, the addition of stepping stones and the grassed area will be submitted for the files. The drawing will also show the location of the dewatering well. Jack Smith seconded. Passed 7-0. 4. Notice of Intent: 19 South White Pine Lane, DaVid & Kathryn Lund, Map 3/330, Lot 13 - #211- 0840 The Notice of Intent was filed for the installation of an in-ground pool within 30 fl. of bordering vegetated wetlands. The hearing was postponed as per e-mail (1/11/2010) sent by David Hobaica, Easton Pool & Spa, because the representative did not send out the abutters notices as required. Mr. Hobaica will let Elizabeth knoW when the notices have been sent and will then request a new hearing date. 5 I 5. Notice of Intent: New England Power COrhpahV, Bird Road #211-0841 Andrea Kendall, Environmental SCientist with Mason & Associates, Andrea Desilet, Environmental Engineer with National Grid, Brian Butler of Oxbow Associates, Marc Bristol, National Grid project manager and Bob Moran, the account manager 16f National Grid were present. Andrea Kendall told the board the proposed pr6JElct involves the extension of a new 115 kilovolt electrical transmission line, the E1 line, through existing steel towers within the existing 300 ft. wide Right-of-Way (ROW) from the Easton Town line,. westerly/northwesterly across Patty's Road, Elyse Road and ending at the proposed East Mansfield substation on Bird Road. The E1 line will be attached to the empty "arm" of the existing steel tower to serve as the power source to the sub- station. The site is comprised of an approximately 0.7 mile linear electrical transmission line ROW. . A second component of the project is the addition of one new steel electrical pole structure within the existing transmission line ROW in .the vicinity of the proposed East Mansfield Substation; this work will be just outside the 50 ft. area. The hew structure will require a concrete foundation, 8 ft. in diameter, Resource areas of concern within the ROW are. bordering vegetated wetlands, one vernal pool located within the wetland area, .Riverfront area, an unnamed perennial stream (river) with a tributary to Whiteville Pond, Bordering Land Subject to Flooding (BLSF), Land Under Waterways and the 100 ft. buffer zone. There will also be limited vegetation maintenahCEi in the upland areas of the ROW, to include tree trimming, pruning, cutting or clearing. None of this activity will take place within the 100 ft. buffer. The project is located within the Canoe River Aquifer. The entire project is within a Natural Heritage and Endangered Species Program (NHESP) area of Estimated Habitat of Rare Wildlife. The state-listed species are the Eastern box turtle, marbled salamander and data sensitive vertebrate, undisclosed. Andrea Kendall said a MESA review was submi\led October 13, 2009. Elizabeth read the letter, dated December 11, 2009 from The Division 01 Fisheries and Wildlife, NHESP Tracking No. 09- 26283. Based on a review of information provided by the applicant and information in NHESP database, this project, as currently proposed, will hot result in a prohibited "take" of state-listed rare species provided that "Mortality Avoidance Protocol" (prepared by Oxbow Associates, Inc. dated 11/30/2009) is fully implemented under the supetvision of a qualified biologist pre-approved by NHESP and holding a valid Sciehtific Collecting Permit. The use of swamp mats and erosion control best management practices shall be fully Implemented in accordance with the submitted plans and documents. Upon completion of the project, the applicant shall provide the NHESP with documentation that either the work was avoided within the areas subject to the Mortality Avoidance Protocol during April 15-0ctober 16 or that the additional seasonal species protection measures were implemented in accordance With the Protocol. Additional reporting may be required subject to the Scientific Collecting Permit. 6 Any changes to the proposed project or any additional work beyond that shown on the site plans may require an additional filing :with the NHESP pursuant to MESA. If no physical work is commenced on the proposed project within three (3) years from the date of issuance of this letter or there is a material change to the plans submitlEld, the project may be subject to further review by the NHEP. Andrea Kendall told the board when a new line is being installed, wire pull areas have to be established. The wire pull areas are partially looated in the wetlands. Swamp mats will be placed to protect the area and provide a stable wotk area and provide access to the wetlands. Approximately 3,700 sq. ft. will be disturbed within the wetland areas. All impacts to the wetlands are temporary; following the removal of the sWamp mats, the vegetation will re-generate and grow back. . Carole Matthew asked if any of fhe vernal pools (there are four potential vernal pools within or adjacent to the ROW but none within the project area) on site have been certified. Andrea Kendall said the vernal pools have not been certified but are certifiable. She said Oxbow Associates did all their field work and research in the spring of 2609. Andrea Kendall pointed out that access to the Wire pull area will be made from Elyse Road, the upland portion. Access to the other proposed struciure will be made by Bird Road. She said there will be no crossing of the wetlandS in this area to gain access to the work area; pre-existing upland routes will be used for access to ir'lstall the proposed E1 line. Colin Cauldwell asked how long the temporary matting will be in place. Brian Butler of Oxbow Associates said the mats will remain in place Uhtll Work is complete. The placement and removal of the mats will be associated with the migration and breeding periods so as to minimize any impact. . Colin Cauldwell asked when the work will start. Andrea Desilet said the current work schedule is from November 2010 to March 2011. She said If work needs to be done outside this window of time, there are contingency plans approved I:JY Natural Heritage for the placement of the swamp mats. She said a wildlife biologist would monitor the work during those timeframes. No vegetation management/maintenance is proposed in the wetland areas in Mansfield. The plan references #211-0829; Elizabeth said this is the DEP number for the substation filing that was withdrawn. Andrea Desilet asked if Elizabeth Would like the reference removed from the plan. Elizabeth asked that the notation be removed, Elizabeth said the only time she has been able t6 review the wetland delineation is with heavy snow cover. She said the delineation has to be. approved. Andrea Kendall said when the area was delineated in April 2009, there were pre-existihg flags; flags were from the delineation for the substation. She said both lines were pretty consistent. She said the delineation for the substation was approved. If approval of the wetland delineation is needed, Elizabeth suggested waiting until conditions improve enough to look at the line. 7 A separate Notice of Intent will be Wed for the substation. Colin Cauldwell made the motionto approve the plan as drawn, referencing DEP #211-0841, as per the Notice of Intent received December 21, 2009 and associated drawings, for the installation of the above ground line on the existing National Grid Right-of-Way from the Mansfield line to the proposed sub-station; the plan will include the installation of hay bales to protect the wetland resources and are to be inspected by the CohseMltion Agent; the wetland line is to be determined in the field by the Conservation Agent in conJunotlon with consultants; hay bales/siltation control to be placed around borings, looatedoutside the 50 ft. but within the 100 ft.; approval pending the wetland delineation finalization whi3n field conditions have improved. Michele White seconded. Passed 7-0. Allan Rogers, 5 Hartford Road, questioned the board's approval of the line. He said the line will be less than 45 ft. from his home, that the line will be going over his pool. He said he is conoerned for his children. He said the abutters were not notified about the meeting tonight. He said if they had been notified the neighbors would have come to the meeting. Colin Cauldwell told Mr. Rogers that the board is only approving the wetland impacts. The approval has nothing to do with thi3 electrical line. Andrea Kendall showed Elizabeth the returned green cards. All neighbors abutting the projeot were notified. 16. Notioe of Intent:>Maple Leaf H~altyTrust,Map~8,Parcel 46 -#211-0842 Hearing postponed until January 25, 2010. Notice of Intent filed for a proposed driveway to service two (2) single-family dwellings. The driveway will require the crossing of an intermittent stream and bordering vegetated wetlands. Replication will be required. Elizabeth tried to review the delineation on December 29, 2009. She found flags were missing and was unable to verify the line because of snow cover. She asked that Michael Trowbridge re-flag the wetlands. 7. Certificate of Compliance: Medline, 560 West 8ireet, Map 44, Parcels 904, 401 & 402 - #211- 706. Mark Beaudry, professional engineer with Meridian Associates, Inc., was present. A final as built, dated December 21, 2009, has been submitted. Plan of record dated August 18, 2004. Elizabeth told the board there Is a substantial difference from what is out in the field and what is on the plan. 8 Mark Beaudry said in July 2008, Michele Grenier, the former agent, met with representatives of the former owners, AMB, the architect and the design contractor. After reviewing the approved plan and the new plan, Michele decided the applicant did not need to file an Amended Order of Conditions; the changes would be considered field changes during construction; she determined the changes were not significant enough to Warrant coming back for an Amended Order. She told them to go through the process of requesting a Certificate of Compliance (COC) and submit an as built with the changes. The changes in the buffer area were to the roadway; the roadway width was reduced and straightened out. The other change was to a 50-car parking lot, with an increased to 75-80 spaces. Mark Beaudry said there were multiple submitials to Nick Riccio, the Building Inspector. Mark said Nick distributed them to the various boards, so Conservation must have seen the changes. Someone must have signed off on the changes for Nick Riccio to issue a building permit. Elizabeth said there is nothing in the file that ther~ was an amended plan approved by the board. Paul Boyden said if there were changes, the departments should have been made aware of them. Derek House recommended that the board get Mpies of the new plan along with the original plan and after reviewing the plans, a site walk be done. He said the board should first amend the Order of Conditions before issuing a Certificate of Compliance (COC). He said the paperwork should be done right and the board should get the chance to look at how the project was supposed to be and how it is to make sure it is not going to impact the Wetland areas. Elizabeth read Special Condition #13 - Any change to the plans identified in Condition #12 - the work shall conform to the plans and special dbndlti.ons referenced in this order - shall require the applicant to inquire of the Conservation CommiSsion in writing whether the change is significant enough to require the filing of a new Notice of Intent. Carole said this puts the burden on the applicant to make sure any changes are reviewed by the board. Joe Mulkern told Mark Beaudry he should file for an amendment to the Order, as per the plan dated December 21, 2009. It was also suggested that Elizabeth get a letter from Rick Alves, Town Engineer, stating everything has been done properly. Colin Cauldwell made the motion that the request for a COC, reference DEP #211-706, be continued until January 25, 2010 in order to alloW a site walk and to process all changes to the plan. Jack Smith seconded. Motion Passed 7-0. Mark Beaudry asked if a letter requesting the amendment would suffice or if there was a required form. Elizabeth told him there was a form to fill out Hearing ended at 9:09 pm. 9 1.....8.ipis()\J~$iQnwithJ;~.'I/~i~nzOla,AttQrn$yf(lrismltl1&.."N~PI1~w. Smith & Nephew, 130 Forbes Blvd: Attorney Ed Valanzola has been retained by Smith & Nephew. A hearing was held October 19, 2009 for an ADA. The RDA was filed to discuss the feasibility of expanding the existing parking area. Work would be done in the 25 ft. area. A Positive Determination was made by the board. Attorney Valanzola was told to file a Notice of InteHt I 9.\ Old Business: Hunting in Corporal Robert Francis Hardy Conservation Area, formerly known as Maple Street Park: Michele White told the board the area incorporates 7 parcels of land: Map 30, lots 32, 38, 66 and 67; Map 38, lot 4; Map 31, lots 37 and 72. She made the following motion: All of these lots are north of Maple Street and have been classified as Conservation Land under the care and management of the Mansfield Conservation Commission. We've found records from the 1980's regarding discussion of adopting a policy of no hunting on this parcel, but we were unable to unearth minutes of a vote that had been taken by the Commission. Since no self-help or land and water grants were used to acquire any of these parcels, it is within the authority of the Mansfield Conservation Commission to set policy for this land. Therefore I make a motion that the Mansfield Conservation Commission adopt a policy of "no hunting" on these particular parcels. Colin Cauldwell seconded. Passed 7-0. Colin Cauldwell suggested that the area be posted with "No Hunting" signs and that a notice be put in the Mansfield News and the Sun Chronicle stating there is no hunting allowed in this area. Elizabeth told the board she and Michele White haVe talked about calling the Council on Aging for volunteers to go through the files for information on other properties in Mansfield. Lou Andrews and Lenny Flynn have volunteered their time also. Vickery donation of land off South Main Street: Town Council is drawing up a deed. Elizabeth said Bob Mangiaratti, Town Council, does not think a Conservation Restriction is necessary. Lou Andrews and Lenny Flynn would like the restriction. Colin Cauldwell said the restriction would be one more level of protection. The board voted 7-0 in favor of having the restriction placed on this land. Mariner Cell Tower - #211-0835 - Order of Conditions issued 8/31/2009: Chris Ciolfi, Chief Development Officer for Mariner Tower, was present. Mariner Tower is starting construction of the cell tower on 615 School Street. The approved project called for the placement of a new utility pole on the west side of the property adjacent to an existing driveway and connecting to pole #64, 10 on the south side of School Street. When Mariner Tower representatives met with the Electric Department, because there were already 3 transformers on the pole, the Electric Department asked that the new pole connect with existing ulliity pole #65 on the south side of School Street. The new pole will be further west - approximately 8 ft. - but will still be outside of the 50 ft. wetland buffer zone. Mansfield Electric has asked that a couple of trees be cut within the 50 ft. buffer so overhead wires can be run from the existing pole to the new pole, Only the trees will be removed - the stumps will not be removed. Elizabeth said she asked Chris Ciolfi to come back before the board because of these changes because there have been instances in the past where you go back and the plan of reference doesn't reflect what has occurred on site. She said if the board approves the changes, she would like the board to sign a statement saying the changes have been approved. Derek House made the motion to approve the amElndment, per the January 11, 2010 meeting, for Mariner Tower to tie the new pole into #65 instead of #64 and to remove any necessary trees to run the overhead wires without interference, Oonservation is to be notified before any cutting takes place. The board is to be notified of any other proposed changes. Passed 7-0. Snow Removal Plan for Mansfield Crossing Mall: Jack Smith was concerned about the snow storage at the mall and the use of salt. Elizabeth said there is no Snow Removal Plan in the file. Jack Smith and Paul Boyden remember this bein\j an issue when the project was before the board. They both said the roadway was to be sanded and lightly salted. Elizabeth will call the management company for a copy of the Snow Removal Plan. National Grid Vegetation Management Plan: In a: letter dated December 11, 2009, National Grid informed Conservation they intend to selectively apply herbicides along power line rights-of-way that pass through the Town of Mansfield. Mechanical and natural control techni~ues will be utilized. The vegetation management will be done, between January 25th and June i ,2010 and June ih thru October 15th, 2010. This is part of National Grid's Five Year Vegetation Management Plan for 2009-2013. Reorganization: Paul suggested that the board table the reorganization until some of the on-going hearings are finalized. Carole Matthew asked if the vernal pool discussed earlier in the National Grid hearing is the same one Mark Grgurovic of Swampwalkers Wetland Ecosystem Specialists said was not certifiable. Andrea Kendall had said it is in fact a certifiable pool. Derek House suggested that the vernal pool be looked at in the spring of 2010. Paul Boyden made the motion to accept the December 14, 2009 minutes as written Passed 5-0. Colin Cauldwell and Derek House abstained. 11 110. Adjournment Colin made the motion to adjourn at 10:15 pm.
