September 11, 2013
Present: Jess Aptowitz; Chairman, Doug A itino; Vice Chairman, Kevin Moran; Clerk,
Georve Dentino, Olivier Kozlowski William Ross, Town Manaeer
Chairman Aptowitz called the meeting to order. Chairman Aptowitz reminded that the Board
previously met as Light Conunissioners and that this meeting is being broadcast live and taped for
future broadcast.
Mr. Ross reported that he has provided the Board with an updated version of the DRAFT BYOB
where the following changes were incorporated: added a sentence that defines that there will not be
any outdoor space included in BYOB and that space shall be defined on the permit application.
Mr. Kozlowski inquired as to allowing outdoor seating to which Chairman Aptowitz stated that it
was the feeling of the Board from the last discussion to not include outdoor seating and Mr. Ross
concurred. Mr. Kozlowski found it odd that conceivably part of an establishment could allow for
BYOB and part could not. Chairman Aptowitz felt that if BYOB was allowed outside it would
take on a whole separate issue of enforcement. Mr. Kozlowski challenged that regularly licensed
alcohol establishments have the capability to which the Chairman noted that those licensed
establishments already have a list of regulations to abide by.
Mr. Moran felt that licensed establishments have regulations as to where alcohol is purchased and
a chain of custody controlling the alcohol is in place, where in the case of BYOB, the customer is
bringing in their own alcohol. Mr. Moran felt the two were different and should not be equated.
Chairman Aptowitz noted that in a regularly licensed establislurient the purchase of alcohol is
known whereas in BYOB the type of alcohol — supposedly beer and wine — could be something
else as the establishment is not handling the containers and therefore would be easier to control if it
was limited to inside. Mr. Kozlowski noted that the Board, in their Draft Regulations, is expecting
the wait staff to not serve intoxicated persons and to be TIPS Trained. Chairman Aptowitz noted
that he is not in favor of this at all but the Board is charged with putting the regulations in place.
Mr. Ross went on to report additional changes that came from the Board's last discussion to be the
addition of beer and wine ONLY, wording that the establishment has to reseal the container prior
to the patron leaving and on the request of Chief Sellon a criminal penalties sentence. Mr. Ross
believed that the major issues that the Board addressed have been incorporated. He suggested that
the Board review the BYOB Draft Regulations and if they were ready the Town could schedule a
hearing.
Mr. Kozlowski noted that in regulation six, the wording should start "establishments shall not
permit alcoholic beverages to be ". Mr. Kozlowski noted in regulation nine, in regards to no
corkage fee, is it just the corkage fee or would there also be creative ways to generate revenue
through other fees (ie glass). The Chairman asked that the regulation be expanded to include no
charges related to the alcohol "no corkage or other fees shall be charged." Mr. Kozlowski noted in
regulation twelve could the Board insert "suspension ". Mr. Moran felt that if they violate the
by -law then it is revoked.
Motion: To publicize the proposed BYOB regulations and schedule a public hearing in two

Mr. Ross reported that the Electric Audit was completed today (September 111"). John Stanbrook,
Finance Director, report to Mr. Ross that the budget balanced cash within $.07. Mr. Ross noted
that the General Fund Audit is beginning soon. Mr. Ross spoke with Ed Vozzella who is ensuring
that the schools are ready. Mr. Ross noted this is the earliest the Town has been ready.
Mr. Ross reported that Finance and Administration Report that was done by Lynch Malloy did
comment on a lack of coordination between departments. Mr. Ross wanted to note that the report
was aimed primarily at the financial and administrative functions of the Town and specifically
looked at Treasury, Collector, Town Accountant and Assessing — the report did not go into all the
other departments of the Town. Mr. Ross felt that the report meant for the Town to have a leader
with a set of marching orders to which has been solved through the creation of the Finance
Director position. Chairman Aptowitz stated that the article in the paper did not reflect this. Mr.
Ross stated that he has been distressed about that since the Town has worked diligently at
coordinating activities to ensure everyone knows the tasks at hand.
Mr. Ross will be attending the ICMA Conference and will not be at the Board's meeting on
September 251". Nick Riccio will be standing in as Acting Town Manager. Mr. Ross stated he is
proud to represent the Town.
Mr. Moran also felt there was inefficiency in the report in the paper that Mr. Ross noted in his
report. Mr. Moran stated that the Town has worked hard to put good people in place to run the
Town and felt that the Town in moving in a positive direction. Chairman Aptowitz stated the
Town knew of the inefficiencies in the finance department and has corrected that with the hiring of
the Finance Director.
Mr. Moran noted he will be travelling for work and will possibly miss one of the next two
meetings.
Mr. Kozlowski noted that Jim Morrissey of the VFW brought to his attention that there is an
organization collecting, ostensibly, on behalf of veterans. Mr. Kozlowski stated the collection is
going towards the organization's overhead and not really for the Veterans. Mr. Kozlowski noted
that Heath Hobson, the Veterans Services Officer, will be doing a PSA for cable access regarding
this issue. Mr. Kozlowski noted to residents if they would like to donate to any organization please
ensure you are vetting them prior to donating.
Mr. Dentino noted that he is pleased with the way the mural is coming out but has done a poll
where residents feel the goose is too out of scale.
Mr. Annino noted that the Town should have brochures available for meetings such as the
conference Mr. Ross is attending to promote the Town.
Chairman Aptowitz congratulated Mr. Amrino on the birth of his first grand- child.
Chairman Aptowitz congratulated Lieutenant Jim Seekal, who is retiring after 33 years. The

Chairman Aptowitz noted that the Audit Committee will be meeting at the end of September.
The Chairman sat in on a phone consultant meeting here at Town Hall and noted it is a huge project
where there will be lots of integration. Mr. Ross noted that Doug Collette, Mike Ahern and Laurie
Letendre were spearheading the project. Mr. Ross stated that the Town is embarking on a single
system for the entire organization and it HAS to be right. Mr. Kozlowski asked if the consultant's
role is to find the right providers to which Mr. Ross stated it is to prepare the plans and
specifications under the procurement law and assist, review and implement the procurement.
Chairman Aptowitz asked if the expense for the flag pole has been encumbered to which Mr. Ross
stated that it has and that the plan is to have the flag pole in by winter. Mr. Ross noted there are a
few trees that need to be removed and Lee Azinheira, Tree Warden, will be conducting a hearing
which will also include a few trees on the South Common that are dying. Mr. Ross noted the NRT
has committed to replacing the trees on the South Common.
Chairman Aptowitz stated that in regards to the Triad Pasta Feast, Lieutenant Goyet does an
awesome job and should be thanked for his contributions.
The Chairman represented the Town last year for the vote of audits for Bristol County. He
received a notice in the mail for the next meeting, which is in October and asked if any members of
the Board would like to attend. It was agreed that Chairman Aptowitz would attend again on
behalf of the Town.
