HomeMy WebLinkAboutBOS MINUTES 8-28-13Board of Selectmen Minutes August 28, 2013 Present: Jess Aptowitz; Chairman, Doug Armino; Vice Chairman, George Dentino, Olivier Kozlowski William Ross, Town Manager - Absent: Kevin Moran Chairman Aptowitz called the meeting to order. Chairman Aptowitz reminded that the meeting is being broadcast live and taped for future broadcast. The Chairman noted that during the broadcast of the past few BOS meetings there had been reports of trouble with sound and inquired as to if it has been fixed. Mr. Ross stated that the trouble was within the cable companies and to his knowledge the sound has been fixed. Chairman Aptowitz welcomed Ryan Maxwell, 149 Park Street and Vic Leemon, 20 Summer Street. Mr. Maxwell has a background in civil engineering and works for a civil engineering company in Bourne which does a lot of residential work. Mr. Maxwell's family are life -long residents. Mr. Leemon has served as the Town's SRPEDD agent for the past year and has been a resident since 1990. Chairman Aptowitz explained to the two candidates that this position is to fill an unexpired position which ends at the end of this year. The Chairman noted that this person will need to reapply at the end of the December. Mr. Dentino asked Mr. Maxwell what attributes he would bring to the table if appointed to which Mr. Maxwell explained that he is consistent and fair and is a great problem solver. Mr. Dentino then asked in Mr. Maxwell's current position did he primarily work in residential design to which Mr. Maxwell explained that lie primarily works on homes and subdivisions. Mr. Dentino asked Mr. Leemon ask what it is he is testing in his current occupation to which Mr. Leemon explained compressors, turbines and lately industrial valves. Mr. Dentino asked why Mr. Leemon chose to apply to which he stated that he saw that there was an opening and would like to do something more on a local level. Mr. Leemon felt that he would bring an open mind and a willingness to adhere to the law to the position. Mr. Dentino stated that all in all the Conservation Commission comes down to the protection of the water. Mr. Dentino asked Mr. Maxwell if he has ever had to survey /flag wetlands to which Mr. Maxwell explained he is very familiar with the Wetlands Act, in his current position he does not flag wetlands but directs contractors to the area to flag but understands the decisions that go in to determine that wetlands are present. Mr. Dentino asked the same question to Mr. Leemon who felt that GIS maps play a big role in marking where wetlands are located. Mr. Dentino thanked both candidates. Mr. Annino thanked both candidates for coming forward to assist in governing the Town. He noted that the Conservation Commission can be adversarial and that this position must assist in balancing decisions and to recognize both the client and the Town's needs. Mr. Kozlowski thanked both candidates for coming before the Board. He asked each candidate what their take was on the appropriate role of the Conservation Commission. Mr. Maxwell felt it is to protect the Town's ecosystems, particularly the wetlands and to work with the residents to ensure the process does waste their efforts and time. To the same question Mr. Leemon stated the Board Of Selectmen's Meeting August 28, 2013 Page 1 of 1 I role of the Commission is to follow the guidelines as outlined in the Town By -Laws and nothing beyond that. Chairman Aptowitz asked each candidate if they have attended a Conservation Commission meeting or have they met Caitlyn Merrill the Town's new Conservation Agent. Both responded no. Chairman Aptowitz asked if each candidate is comfortable with saying no. Mr. Maxwell felt that he was comfortable saying no if it was fair and the right thing to do. Mr. Leemon stated that if it can be backed up by chapter and verse of the Wetlands Protections Act and by -law that he absolutely can say no. Motion: To appoint Vic Leemon to fill the unexpired term of Colin Caldwell which expires January 1, 2014 (Kozlowski/) Mr. Dentino noted the Board should take a paper vote since there are two qualified candidates. Motion: To appoint Ryan Maxwell to fill the unexpired term of Colin Caldwell which expires January 1, 2014 (Dentino The Board then took a paper vote where Chairman Aptowitz read the results as follows: Selectmen Annino — Ryan Maxwell Selectmen Kozlowski - Vic Leemon Selectmen Aptowitz - Ryan Maxwell Selectmen Dentino — Ryan Maxwell Chairman Aptowitz declared Mr. Maxwell to the open position on the Conservation Commission by a vote of 3 to 1. The Chairman asked Mr. Leemon to please stay informed of open positions and thanked him for applying. Chairman Aptowitz congratulated Mr. Maxwell. Chairman Aptowitz read as follows: Public Hearing Regarding Possible Violation of Alcohol License, Arb Enterprises d /b /a Casey O'Conors, Licensee, Mr. Robert Burns — Manager, Licensed Premises Located at 219 — 221 North Main Street, Mansfield Motion: To open the public hearing for Casey O'Conors (Kozlowski /Dentirro) PASSES 4:0 Paul DeRensis, Town Counsel, is present before the Board. Mr. DeRensis asked that the Board postpone the public hearing, until further notice, due to the fact that Casey O'Conors is no longer in possession of the alcohol license as it has been seized by the Department of Revenue. Mr. DeRensis noted that the license, as well as the establishment, will be auctioned off and at that time the DOR will transfer the license to that bidder. The bidder must then navigate the Transfer of License application process by being approved by the Board of Selectmen then the ABCC. Mr. DeRensis then noted the reasoning in postponing the hearing is that the tax payer could reclaim the license if the debt is paid in full prior to auction. Mr. Kozlowski noted that the Board should vote to postpone until further notice OR until December 31, 2013 when the license expires. Chairman Aptowitz noted that the license becomes valueless after expiration but Mr. DeRensis stated that the DOR has a right to renew. Mr. Ross asked for clarification as to who would renew to which Mr. DeRensis stated that either the DOR or the DOR could ask the license holder to renew. Mr. Ross noted that in speaking to the Executive Director of the ABCC, once the license is sold that is the transfer that would come before the Board and it would be a transfer from the DOR to the winning bidder. Board Of Selectmen's Meeting August 28, 2013 Page 2 of 11 Motion: To close the evidentiary portion of the public hearing for Casey O'Conors (Kozlowski / Annino) PASSES 4:0 Motion: To postpone until further notice the hearing on Arb Enterprises d /b /a Casey O'Conors ['6 Motion: To open Public Hearing Regarding Possible Violation of Alcohol License, VFW Post No. 3264, Licensee, Mr. Robert Hopkins — Manager, Licensed Premises Located at 88 Chilson Avenue, Mansfield (Kozlowski/Dentino) PASSES 3:0 (Mr. Annino stepped out of the meeting briefly). Mr. DeRensis swore in for the record Chief of Police Ron Sellon and Detective Sergeant Lawrence Crossman. Mr. DeRensis stated that State Law provides that no person under the age of twenty -one should be served alcohol and that at tonight's meeting there will be evidence that the VFW Post No. 3264 has violated that law. Mr. DeRensis noted that important information was received an hour prior to this hearing where Town Counsel recommended a postponement. In speaking with the representatives from the VFW, Town Counsel reported that they have asked to proceed with the hearing. Chief Sellon stated that in acknowledgement of the significant underage drinking issues in the Town, the Police Department conducted an underage drinking sting of all the duly licensed alcohol establishments in the Town. Chief Sellon tasked Detective Sergeant Crossman with this and in the early portion of June sent a letter to all those establishments delineating what the sting would consist of, how the sting was to be conducted and that each establishment would have one. There was a three week period between the letter (Exhibit 1) and the sting. Mr. DeRensis then entered into the record a letter sent by Chairman Aptowitz informing the VFW Post No. 3264 of a violation and a scheduled date and time to appear before the Board (Exhibit 2). Detective Sergeant Crossman informed the Board of the process of the sting, which used two twenty year old males as undercover operatives. Each operative had no identification and who followed strict police guidelines where twenty questions were answered verbally. Detective Sergeant Crossman read for the record the detailed report (Exhibit 3) from Detective Zaccardi (Norton Police Department), who was assigned to one of the undercover operatives. Mr. DeRensis then gave a letter to Chief Sellon to review, which was from Selectmen Kevin Moran, to the Post Commander James Morrissey of VFW Post No. 3264, relating to a violation of the VFW from December 18, 2013 which falls within the three year time period (Exhibit 4). Mr. DeRensis explained that this is a second violation within tlrree years of the guidelines adopted by the Board of Selectmen. Mr. DeRensis swore James Morrissey, Post Commander and Robert Hopkins, Manager of the VFW Post No. 3264 into the record. Mr. Hopkins stated that the VFW was guilty of the violation and wanted to move forward. Mr. Morrissey noted that the staff has received additional TIPS training since the violation. Mr. Kozlowski noted that this is a second offense within a three year period and speaks quite loudly. He asked what is involved in the signing the Guest Book which Mr. Morrissey noted it is a Board Of Selectmen's Meeting August 28, 2013 Page 3 of I 1 VFW requirement. Chairman Aptowitz asked if there is no member present to sign in how could the operatives have signed in. Mr. Morrissey noted they were considered guests of the bartender. Chief Sellon noted that there are not a lot of calls from the VFW but it is a second offense in three years and is quite concerning. Mr. Annino, as he has stated in the previous hearings, was extremely disappointment that eight establishments were caught in the sting where, he felt, it is such a simple thing to check for identification. Mr. Annino stated that if the VFW is not going to be responsible and follow the law then they shouldn't have a license. It pained Mr. Annino to say this to the VFW as they are such a fixture in the Town. He felt that the VFW is really tying the Board's hand as this is a second offense and there is an immediate need to run a tighter ship. Mr. Dentino stated that this is a whole new ballgame having an establishment with a second violation. The Board cannot consider just a letter of reprimand. Mr. Dentino noted that there was a letter notifying of the sting and he has a big problem that the VFW was not prepared. He recognized that there has been a positive move with the VFW with the addition of the Women's Auxiliary but now there is this blemish. Chairman Aptowitz noted that the Board is the gatekeepers of the licenses. He was concerned given that 90% of the people going to the VFW are members and that it should have been a red light when two not familiar people came in. Chairman Aptowitz asked Chief Sellon and Detective Sergeant Crossman for their recommendation. Chief Sellon deferred to the Board given it is a second offense but stated there should be a distinction. Mr. DeRensis first stated that the Board needs to find a violation and to close the public hearing. Motion: To close the public hearing for VFW Post No. 3264 (Kozlowski /Annino) PASSES 4:0 Motion: To find that the evidence presented by the government in this case to be credible and that the Board finds the VFW Post No. 3264 did in fact commit a second violation and serve a person under the age of twenty -one (Kozlowski/Annino) PASSES 4:0 Motion: To levy a one week (7 consecutive days) suspension of the alcohol license due to a second offense (Kozlowski /Annino) Discussion: Mr. Dentine does not recall this magnitude of punishment on second violations previously. Mr. Kozlowski was referring to the guidelines in determining the punishment and how egregious it was. Mr. Dentino admits to it being egregious but that the first violation was over serving and this is a different violation. Mr. Kozlowski agreed that the two violations are different in nature. Chief Sellon noted that they are two separate violations but they are both in fact alcohol violations. Mr. Annino is not even considering the first violation but due to the seriousness of the second violation there has to be some substance. Mr. DeRensis explained that the first violation was over serving and the second violation was serving a minor and that both of these violations connect in that the server, who is supposed to use care and judgment, was involved, which shows weakness. Motion: To suspend discussion regarding an alcohol violation of VFW Post NO. 3264 (Kozlowski /Annino) 8:30pm Motion: To re -open discussion of an alcohol violation of VFW Post No. 3264 (Kozlowski /Annino) 8:31pin Board Of Selectmen's Meeting August 28, 2013 Page 4 of 1 I Chairman Aptowitz noted that in discussing the motion that the Board is in favor of a suspension but each are concerned about the time. The Chairman asked for Mr. Dentine's suggestion. Mr. Dentino was thinking more along the lines of a five day suspension, consecutive and the dates to be determined by the Board. Motion: To levy a one week (7 consecutive days) suspension of the alcohol license due to a second offense (Kozlowski/Annino) PASSES 4:0 Mr. Dentino would rather see five days but will support the Board The Board discussed and decided that the VFW would contact the Town Manager to discuss dates for the suspension. ME!- B1ii3 ®chlad! --: yxl Motion: To open Public Hearing Regarding Possible Violation of Alcohol License, Spiezio Enterprises, Inc. d/b /a Geno's Restaurant, Licensee, Mr. John Spiezio — Manager, Licensed Premises Located at 407 — 409 North Main Street Mansfield (Kozlowski /Annino) PASSES 4:0 8:30 Motion: To suspend the public hearing regarding possible alcohol violation of Spiezio Enterprises, Inc. d/b /a Gene's Restaurant (Kozlowski /Annino) 8:30pm PASSES 4:0 Motion: To re -open the public hearing regarding possible alcohol violation of Speizio Enterprises, Inc. d/b /a Geno's Restaurant (Kozlowski /Annino) 8:35pm PASSES 4:0 Mr. DeRensis swore in Mr. John Spiezio, Manager of Geno's Restaurant. Mr. DeRensis re- stated that this hearing is in regards to the possible violation of State law where persons under the age of twenty -one were served alcohol. Mr. DeRensis reminded the Board that a sting operation was conducted and that evidence will be presented that the law has been violated in regards to the above establishment. Mr. DeRensis reminded the Board that there are two witnesses to be called on behalf of the Town, Chief of Police Ron Sellon and Detective Sergeant Lawrence Crossman, who were sworn in earlier in the evening. Chief Sellon stated that he directed Detective Sergeant Crossman to conduct an underage sting operation. The Chief reported that a letter (Exhibit 1) was sent to all duly licensed alcohol establishments outlining what the sting would entail and how it would be conducted. Detective Sergeant Crossman stated that the sting was conducted with two teams and used two twenty year old undercover operatives, both male. Detective Sergeant Crossman reported that both operatives were given breathalizers and that their wallets were taken and held and therefore the operatives carried no identification. The operatives were given strict guidelines when purchasing alcohol. Detective Sergeant Crossman stated that one of the operatives were assigned to Detective Zaccardi from the Norton Police Department. Detective Sergeant Crossman then read into the record the report from Gene's Restaurant (Exhibit 2). Mr. DeRensis noted that a letter was sent to Spiezio Enterprises d/b /a Geno's Restaurant of the alleged violation by Chairman Aptowitz, which also scheduled a date for the hearing (Exhibit 3). Chief Sellon stated that the recommendation of a letter of reprimand, TIPS re- training and two compliance checks within the next six months came about from the outpouring of response by the violating establishments. Board Of Selectmen's Meeting August 28, 2013 Page 5 of I I Mr. Spiezio stated that he has been in Town and business for over thirty years and it is his life. He stated he takes great pride in his business and has never ever had an alcohol violation of this nature. He noted that he suspended the bartender who violated the law and had all employees as well as inviting other establishments to join him in TIPS retraining. Mr. Spiezio noted he has a good reputation in the Town and takes great pride in his establishment. Chief Sellon noted that Mr. Spiezio was the first business to reach out to him in wanting to correct the underage drinking issue and from that conversation the Chief came up with the plea agreements presented at the previous Board meeting of a letter of reprimand, TIPS re- training of all employees and two mandatory compliance checks within the next six months. The Chief noted that Mr. Spiezio reached out to the other violators to all have TIPS training together. Mr. Spiezio agreed to the findings as presented. Chairman Aptowitz appreciated Mr. Spiezio's candidness. Mr. Kozlowski explained that the first offense establishments accepted a plea agreement of letter of reprimand, TIPS re- training of all employees and two mandatory compliance checks within the next six months and asked if Mr. Spiezio was accepting of that to which he replied yes. Mr. Annino was glad to see that Mr. Spiezio understands the seriousness of this and that he reached out to the other violating establishments. Mr. Dentino noted that Geno's has gone thirty -two years without a violation and he is glad that Mr. Spiezio understands the seriousness. Mr. Dentino supports Chief Sellon's recommendation. Chairman Aptowitz noted that Mr. Spiezio has a lot of passion and believed that he cares about Mansfield. He thanked Mr. Spiezio for stepping up to the plate and doing the right thing. Motion: To close the public hearing regarding an alcohol violation at Speizio Enterprises Inc. d/b /a Geno's Restaurant (Kozlowski/Annino) PASSES 4:0 Motion: To find that a person under the age of twenty -one was served alcohol as presented by Town Counsel at Geno's Restaurant (Kozlowski /Annino) PASSES 4:0 Motion: To accept the agreement as presented by Chief Sellon of a letter of reprimand, two compliance checks within six months and mandatory TIPS re- training for all employees covering f ` a a f Motion: To open the Public Hearing Regarding Possible Violation of Alcohol License, Chipotle Mexican Grill of Colorado, Licensee, Ms. Emily Carr — Manager, Licensed Premises Located at 287 School Street, Mansfield (Kozlowski /Annino) PASSES 4:0 Mr. DeRensis stated that this is the last of the eight violation hearings. Mr. DeRensis reiterated that the Board is here to consider violations of State law where a person under the age of twenty -one is prohibited to be served or sold alcoholic beverages. Mr. DeRensis noted that the Town has conducted a sting operation and this hearing is to find if Chipotle Mexican Grill has violated that law. Mr. DeRensis stated there are two witnesses to be called, Chief Sellon and Detective Sergeant Crossman. Chief Sellon explained that he directed Detective Sergeant Crossman to organize and conduct an undercover sting of all the duly licensed alcohol establishments in the Town of Mansfield. Chief Board Of Selectmen's Meeting August 28, 2013 Page 6 of 1 I Sellon stated that as a result letters were sent to all establishments notifying them of the sting and outlining the process (Exhibit 1). Detective Sergeant Crossman described the execution of the sting in that it took place over two days in June ( the 20th and 25th) with two plain clothed teams each with a twenty year old undercover operative, both males. The undercover operatives were given portable breathalizers before and after the stings, removed of all identification and personal money was held by MPD and that the operatives were given extensive guidelines on how to conduct themselves and not consume any alcohol during the sting. Detective Sergeant Crossman noted that the operative was assigned to Detective Zaccardi (Norton Police Department) and read into the record the written report of the violation on the night in question, which was provided by Detective Zaccardi (Exhibit 2). Mr. DeRensis then acknowledged and submitted the letter sent by Chairman Aptowitz notifying Chipotle Mexican of the violation and a date to appear before the Board (Exhibit 3). Mr. DeRensis then submitted for the record a signed, hand - written plea agreement between the Town and Chipotle Mexican Grill as to the sufficient facts of the case (Exhibit 4). Mr. DeRensis then swore in Rebecca Erikson, who is filling in for Emily Carr, who recently quit the establishment. Ms. Erikson currently works in the North Dartmouth location and noted that the employee who committed the violation is no longer employed. Ms. Erikson also noted that she had contact the License Director, Devon Lambart, who is putting together a TIPS Certification class. Chairman Aptowitz asked Ms. Erikson to report back to her company that there is now no Manager of record for Chipotle, which is another issue. The Chairman noted that he understands that these chains have a lot of turnover but that they are required to come before the Board when there is a change, especially in the Manager of record for the alcohol license. Chief Sellon noted it is a license duly licensed by the Board so that it is the Board's decision as to whether it should be closed. Mr. Ross noted that Chipotle needed to contact Ms. Whalen immediately as to the license change. Mr. Kozlowski asked if Ms. Erikson was the "acting" manager to which she responded yes but noted that the company is in the process of finding a new General Manager. In reference to the plea agreement admitting to the violation, Mr. Kozlowkski asked if Ms. Erikson endorsed the plea agreement to which she stated yes and had signed it. Mr. Annino stated that Chipotle should take this violation seriously as the Board does. He stated that the violations cannot occur. Mr. Dentine, inquired if Ms. Erikson is TIPS trained to which she responded yes and works two ten hour days. Mr. Dentino asked if there were an TIPS trained employee when she is not there. Ms. Erikson explained that in speaking with the former manager, Emily Carr, there is no other employee who is TIPS trained. Mr. Dentino stated that Chipotle needs to begin immediately getting a manager of record and have all the employees TIPS trained and work with Mr. Ross and Ms. Whalen. Chairman Aptowitz is extremely concerned that there is no one TIPS trained on the premises when Ms. Erikson is not there and asked Ms. Erikson to relay that to her bosses. Motion: To close the public hearing for Chipotle Mexican Grill of Colorado, LLC (Kozlowski/Dentino) PASSES 4:0 Motion: To find that a violation of serving an underage person at Chipotle did occur on the date in question (Kozlowski/Annino) PASSES 4:0 Board Of Selectmen's Meeting August 28, 2013 Page 7 of 11 Motion: To accept the agreement as presented by Chief Sellon of a letter of reprimand, mandatory TIPS re- training/training for all employees and two compliance checks within six months and that no alcohol may be served unless all employees are TIPS certified for Chipotle Mexican Grill of Colorado, LLC (Kozlowski/Annino) Discussion: Mr. Annino asked if the Manager of record could be included in the motion. Mr. Dentino felt that the Board has gone months with Manager of records previously to which Chairman Aptowitz noted that the Board was unaware of those cases. Motion: To accept the agreement as presented by Chief Sellon of a letter of reprimand, mandatory TIPS re- training /training for all employees and two compliance checks within six months and that no alcohol may be served unless all employees are TIPS certified for Chipotle Mexican Grill of Colorado, LLC (Kozlowski/Annino) PASSES 4:0 Mr. Ross reminded the Board that he gave them a lengthy report on the various parking situations along Old Colony. One of the items that came from that was a lease between the Town and the Housing Commission for several parking spots on the north side of Park Street. Mr. Ross stated that the lease has expired and that the Housing Commission would like to renew that lease, which ties directly to the senior citizens housing in that location. Mr. Ross explained that these leases were approved at Town Meeting and expires every three years, therefore he is suggesting that if the Board would like to renew the lease it should be for a two year period of time (retroactive), which would get it through to the following Town Meeting. Mr. Ross noted the Housing Commission would like to renew as it has parking for some seniors. Mr. Dentino asked how many spaces are there to which Mr. Ross responded 8 — 10 spaces. Mr. Dentine, felt the Town really needs to find out how many residents have vehicles at that location. Chairman Aptowitz asked if the Town could postpone signing the lease and schedule the entire discussion of parking and leasing together. Mr. Ross stated he just wanted to get feedback as to if the lease should be renewed but it was not necessary to sign at this meeting. The Board decided to reschedule this topic to an agenda in September. The Chairman noted that there was a memo in the Board's packet from the Non - Profit Gift Fund Committee regarding recommendations for disbursement of funds received from the Tiger Woods Foundation. This discussion is in reference to last year's Deutsche Tournament due to a delay in the funding. The Chairman noted that the donation is in the amount of $30,000 and there was a balance of approximately $2,000 in the account. The Committee recommended approximately ten uses for the money. Mr. Annino asked if the descriptive key for the Mural Committee was for the two panels for the North Common which Mr. Ross responded yes. Nh•. Annino also asked if the new sign for the Council on Aging should be held until the Town's signage program is accepted. Mr. Ross stated that it will be held until the new standards are accepted. Mr. Dentino recognized most of the money was spent and that the Town should be more conservative given the fund's value and that it may not be there in the future. Mr. Kozlowski noted the Committee was established so there was an impartial group making the decisions. He presumed that their deliberative process included that members, with a conflict of interest, would step away from the process when the Committee was Board Of Selectmen's Meeting August 28, 2013 Page 8 of I 1 Motion: To approve Electric Department Vendor Warrant No. 14009E $48,167.37 (Annino/Dentino) PASSES 4:0 School Department Vendor Warrant No. 14009S $1,107.80 Motion: To approve School Department Vendor Warrant No. 14009S $1,107.80 (Annino/Kozlowski) PASSES 4:0 Town Payroll/Town Medicaid Payroll Warrant No. 14009PT $402,456.61 Motion: To approve Town Payroll/Town Medicaid Payroll Warrant No. 14009PT $402,456.61 (Annino/Kozlowski) PASSES 3:1 Dentine NAY, Aptowitz ABSTAINS Voucher #29687 payable to Laura Aptowitz Town Deductions - Vendor Payroll Warrant No. 14009TV $124,134.32 Motion: To approve Town Deductions — Vendor Payroll Warrant No. 14009TV $124,134.32 (Annino/Kozlowski) PASSES 4:0 School Payroll/School Medicaid Payroll Warrant No. 14009PS $985,849.72 Motion: To approve School Payroll /School Medicaid Payroll Warrant No. 14009PS $985,849.72 (Kozlowski /Dentin) PASSES 3:1 Annino NAY School Deductions Vendor Payroll Warrant No. 14009SV $288,658.25 Motion: To approve School Deductions Vendor Payroll Warrant No. 14009SV $288,658.25 (Kozlowski / Annino) PASSES 4:0 C. Motion: To waive the inspection fee for St. Mary's Catholic School (Kozlowski / Annino) PASSES 4:0 Mr. Ross reported that the overage check from the Comcast Center Eagles Concert on July 19' has been received and deposited. Mr. Ross reported that the Town has started quite a bit of street work. He noted that about 80% of the base course is in place for Bird Road which should be completed by the weekend. From there the work will move onto East Street towards Easton. Mr. Ross stated that the top coat should be in place prior to the start of school. There has been quite a bit of crack filling and seal coating going back and doing the circles on Pinto and Maverick. Mr. Ross noted he viewed the work and stated it did look better. Mr. Ross noted that the Town has received the first draft specifications of the telephone system. Mr. Ross stated that these are base specifications and that as more details are received he will keep the Board informed. Mr. Ross stated that new switches have been installed on the network within the municipal location and have been tied into the existing fiber work so that there is now the necessary speed to use the voice over IP on the system. Mr. Ross noted that Mansfield Cable made a donation to pay for the new switches, which was about $17,000 and thanked them. Board Of Selectmen's Meeting August 28, 2013 Page 10 of I I Mr. Ross explained that earlier there were reports that there were mosquitos found in one Town location that could carry EEE. Mr. Ross reported new analysis has been done and found mosquitos that could carry EEE were found. Mr. Ross reminded the Board that Town Hall will be closed on Monday due to Labor Day holiday. Mr. Ross reported that the Train Access Study Kickoff meeting is tomorrow, Thursday, August 28t" with the Planning Board and BETA Corp. The meeting has been posted as a joint meeting in order to meet the Open Meeting Law. Mr. Dentino inquired as to the credit card chargers which he felt were outrageous and if the Town found another bank that could do better. Mr. Ross stated he would follow up with Treasurer Roxanne Donovan after the holiday weekend. Chairman Aptowitz, on behalf of the Board, expressed condolences to the family of Jack Daszkiewicz, who expectantly passed away while on vacation, was a 27 year employee of the Waste Water Department. The Chairman also gave the Board's condolences to two staff members who also lost loved ones: Deb Herbert lost her step - father and Linda Darling lost her mother. The Board extends their deepest sympathies. Chairman Aptowitz felt that the liquor sting was a good process but the Town needs to find a way of dealing with the larger chains and the turnover of managers as evidenced by Chipotle's. His thought process was to include something into the renewal process. Mr. Dentino, in reviewing the drawings of the high school wall, had a few questions. Mr. Dentino wondered what the cost difference would be between the current plans of encapsulating the existing insulation (containing asbestos adhesive) as opposed to taking it all out. Mr. Ross was unsure but noted that the Building Committee had reviewed various options and chose the most expeditious and cost saving route. Mr. Ross noted the Building Committee also wanted to limit the removal of the material from the wall due to issues of having to do negative air pressure and delays. At this point the gym would be unavailable until the end of October. Chairman Aptowitz reminded that this week is the start of the TPC Golf Tournament and that there may be some traffic and for the residents to be patient. None.
