Ms. Baynes gave a brief summary of her background where she stated she recently moved back to Massachusetts from Tuscon, Arizona. Ms. Baynes reported she has a background in property management (commercial and residential, both in Massachusetts and Arizona) and her education included a Master's Degree in Counseling. Ms. Baynes felt she has strong communication and interpersonal skills. Mr. Kozlowski appreciated Ms. Baynes willingness to step up and contribute to the community and felt Ms. Baynes had a solid background for this Board. Mr. Moran thanked Ms. Baynes for expressing an interest and noted that the Housing Corporation offers a great opportunity to make real substantial forward progress. Mr. Annino stated Mansfield is a wonderful community and noted how important it is to have the citizens involved. Mr. Annino asked Ms. Baynes to please be sure to attend Town Meeting. Mr. Dentino noted how important the Housing Corporation is and felt Ms. Baynes had the qualifications needed. Motion: To open the public hearing on the application of Bertucci's Restaurant for a change of officer and director and stock transfer and issuance (Dentino/Kozlowski) PASSES 5:0 Board Of Selectmen's Meeting July 24, 2013 Page 1 of 10 Tracey Whalen explained to the Board that in their packets for this week's BOS meeting was a letter fiom the ABCC explaining that Bertucci's Restaurant has filed an application to make a change at its corporate level, where the President is stepping down and a new President has been appointed. Given the magnitude of the transaction, with multiple locations throughout the Country and State, Bertucci's has submitted one application to the ABCC with all corresponding documents for review and has received approval at the State level. The ABCC asked all local licensing authorities to follow procedure to advertise the change and hold a public hearing and to issue a new Form 43 as a formality. Mr. Moran noted that all routing slips have been received from Town Hall Departments with no issues on the change. Chairman Aptowitz asked if there were any public comments, to which there were none. Motion: To close the public hearing on the application of Bertucci's Restaurant for a change of officer and director and stock transfer and issuance (Annino/Dentino) PASSES 5:0 Motion: To approve the change of officer and director and stock transfer and issuance for Bertucci's Restaurant (Moran/Dentino) Discussion: Mr. Dentino stated he is hard pressed to vote on this without a representative of Bertucci's present. He felt that it was setting a precedent that each time the Board is approving a license that the party does not have to be present. Ms. Whalen explained that Bertucci's did offer to send a representative. Ms. Whalen stated she had followed up with the ABCC and with the attorneys for Bertucci's and felt that since the State had reviewed all documentation and approved the license, and given there were no changes to the local license, there was no need to have a representative present. Mr. Dentino noted that State approval usually follows local level approval and felt this is not a precedent he wants to see. Mr. Moran noted he had no issue given that this is a corporate change only. Chairman Aptowitz stated that a representative should be present but that it isn't an instance of Bertucci's having done something wrong and therefore will not sway his vote. Mr. Annino agreed with Mr. Dentino but stated that the Town told them they did not need to be present. Motion: To approve the change of officer and director and stock transfer and issuance for Bertucci's Restaurant (Moran/Dentino) PASSES 4:0:1 ( Dentino ABSTAINS) x' tig z a g c ishatnionsrx}a vexegests for YI i e . i "' ` .Q e s. m e t a h - " o =t Granter xut Oi►e>Ime Pei_: Mr. Moran reviewed the changes between last year's Parking Plan and this year's plan with the Board, provided by Tracey Whalen. One of the changes was in the police detail coverage at the Comcast Center Main Gate on the Sunday and Monday of the event. The 2012 plan had three officers scheduled at the location and the 2013 plan was scaled back to two officers. Per Police Chief Ron Sellon's feedback, the police detail numbers must remain the same as the previous year's plan. Motion: To approve the Deutsche Championship Parking Plan on the condition that all police details remain the same as the 2012 plan, specifically having three police detail officers at the Comcast Center's Main Gate on the Sunday and Monday of the event (Annino/Moran) PASSES 5:0 Board Of Selectmen's Meeting July 24, 2013 Page 2 of 10 Motion: To approve the waiver of the one -time per vehicle parking charge (Annino /Kozlowski) PASSES 5:0 Motion: To approve the building permit fee waiver, Town portion, for the tents (Aimino /Moran) PASSES 5:0 Chairman Aptowitz noted to Town Manager, Bill Ross, that if Eric Baldwin, VP Championships, nas any questions or concerns, Be snouia contact umet or ronce ion 6eiton. Chief of Police Ron Sellon and Fire Chief Neal Boldrighini are present before the Board. Selectmen Dentino had asked for a mid - season report from the chiefs concerning their experience at this year's Comcast season. Chief Sellon and Chief Boldrighini's presentation has been made a part of public record. Chief Sellon began the presentation with a backdrop on the Comcast facility itself. The presentation moved to the issues and concerns both chiefs identified during their review of the facility and previous procedures, ie communication, staffing, public safety improvements. Chief Boldrighini explained that the solution to their concerns was to run the facility as they would run their departments every single day. Chief Boldrighini explained that the Fire Department is a strong proponent of an Incident Command System (ICS), a nationally ranked system which MEMA endorses. Chief Boldrighini explained that ICS is a based model to maximize public safety efficiency and is flexible. Chief Sellon reported that the ICS for Comcast is a unified command center that houses representative from Police, Fire, Event EMS and Security. Additional measures added included, the incorporation of the Metropolitan Law Enforcement Counsel (regionalize SWAT team model — how to move through and react to a crowd) and Explosive Ordinance Device Detection Dog (dog sweeps interior of the venue 1 hour prior to gates opening and stands down for first two hours of event, in case of issue), Prisoner Diversion Agreement with Norton and Attleboro and Utilization of an Un Encrypted Channel. Thus far, there has been an issue with communication, a learning curve associated with such a large scale change and radio antenna to channel 3 was painted over at Comcast by accident. Chief Boldrighini noted that in 21 shows there have been 500+ custodies, 536 medicals with 123 transports and 240 fire related incidents. The Chief noted that the departments have been very busy. Chief Sellon noted that alcohol related incidents dominate his department's time. Chief Boldrighini reported that they have taken a proactive approach in the parking lots where many deficiencies were noted in previous years and has seen a substantial reduction. Chief Boldrighini noted that fire related issues when the venue began was in the 800 range by season's end and to date have been decreased to 200 for the current season. The Chiefs recommended that a complete review of the activities will be conducted when the season is complete and more detailed recommendations will develop. The chiefs do see progress. Board Of Selectmen's Meeting July 24, 2013 Page 3 of 10 Mr. Moran asked if the chiefs felt the command center is working. Chief Boldrighini responded that the ICS has eliminated a lot communication issues. Mr. Moran asked if the crowd's overall behavior is adjusting to the new system or if generally each night is starting at ground zero. Chief Sellon responded that each night is starting at ground zero as each event brings a different type of crowd and attendance varies. Mr. Kozlowski asked for the status as far as getting channel 3 up and running. Chief Sellon noted that it probably will not happen this season but a work order has been placed. Mr. Annino was impressed that with all of these events happening at the venue that the Chiefs are keeping it all in control. Mr. Atmino felt over 500 arrests in 21 shows seemed to be a lot to which Chief Sellon noted that in his analysis they are on pace with same number of people taken into custody as last year. Chief Sellon stated that his analysis did show that the custodies are happening earlier in the event which he attributed to having a dedicated interior team, which knows its way around a crowd, to be extremely beneficial. Both chiefs feel confident with the systems in place and have received positive feedback from EMS events and security. Mr. Aimino asked if they have received any patron feedback where Chief Boldrighini noted there have been comments concerning the comfort level in seeing the increased presence. Mr. Dentin noted it is good to hear about the camaraderie and cooperation between the departments and the Comcast Center. Mr. Dentino asked about the Comcast Center security numbers and if they have decreased. Chief Sellon did not have the numbers. Mr. Dentino felt that both chiefs have done a tremendous job as far as making a presence but in fairness to Comcast he felt there was no fluctuation between the staffing levels in regards to the attendance numbers (ie between 19,500 and 5,600). He understands that there is leg work involved in reviewing past history but would like the chiefs to look harder at the numbers as he does not feel it looks good. Mr. Dentine asked specifically about the events on the lawn and the staffing levels. Mr. Dentino felt that the staffing level needs to be reviewed and that lighting is atrocious and a giant concern. Chief Sellon noted that one of the mandates that the Metro Unit has is that each member wears reflective vests for visibility. Mr. Dentine would like to see seats in that area and felt that there would be more control. Mr. Dentine is seeing progress and liked everything that the chiefs are dong. Mr. Dentine asked about the medical doctor on the premises and Chief Boldrighini noted it is extremely helpful and very efficient especially regarding minors given that their hands are tied and the doctor has more flexibility and reflects well on them there. Chief Sellon noted that having the medical professional on site is a huge help. Mr. Dentino asked if the CHINS law is hurting the police in terms of holding minors. Chief Sellon does not believe the CHINS statute change has been an issue. Chairman Aptowitz stated he has attended a third of the shows and reported both chiefs do not only act as administrators but jump into action when needed. He noted that weather related issues where heat was taxing play a role in staffing levels. In regards to patron comments concerning the ICS, the Chairman has spoken to parents of children who were in protective custody where they were so extremely appreciative and thankful to public safety. Chairman Aptowitz commented that the departments work as team. Mr. Ross complimented both chiefs for the cooperative attitude on addressing the issues, the Town cannot really be effective without that and he is appreciative of that moving forward. He understands that it will take a time and understands that there are concerns about the way things are changing but the Town is responsible to ensure safety. Board Of selectmen's Meeting July 24, 2013 Page 4 of 10 Chairman Aptowitz moved on to the alleged curfew violation at the Eagles Concert at the Comcast Center on July 19`1'. Chairman Aptowitz confirmed with Chief Sellon that the overage was officially clocked by Lt Thompson, Shift Commander, as three minutes, to which Chief Sellon stated yes. Chairman Aptowitz noted that in previous years the Town has waived the fine but noted in the past few years that the Board has begun enforcing. The Chairman stated it is the Board's discretion as to how they would like to move forward. Mr. Ross noted that the action in the past was to direct the Town Manager to obtain an official attendance count for the show and then to apply the appropriate penalty from the license. The Chairman agreed with that. Mr. Moran felt the Board has discretion on this issue and he did not have an issue with a three minute overage. Chairman Aptowitz called for a motion. Motion: Ask that the Town Manager send a letter to the Comcast Center inquiring as to the exact attendance count and calculation of possible fine (Kozlowski /Annino) Discussion: Mr. Dentino never believed in the gift of a first time offense and felt the system works better when it is upheld. Mr. Dentino noted that the curfew is in place for a reason and that violators must suffer the consequences. Mr. Moran felt that the violation comes before the Board first in order for the Board to use discretion on whether to levy a fine. Mr. Moran felt that if that wasn't the case then the violation would just be submitted to the Town Manager who would then just send the letter to levy the fine. Motion: Ask that the Town Manager send a letter to the Comcast Center inquiring as to the exact attendance count and calculation of possible fine (Kozlowski /Annino) PASSES 4:1 Moran NAY Police Chief Ron Sellon is nresent before the Board and renorted that at the beginning of June letters were sent to all duly licensed alcohol establishments in the Town advising of upcoming compliance checks. Chief Sellon reported that on June 20t" and June 25`1' members of the Mansfield Police Detective Unit, Officer David Kerr and Norton Detective Jeffrey Zaccardi performed compliance checks of the licensed liquor establishments in the Town of Mansfield. These checks were done with the assistance of two undercover operatives, twenty years of age. Chief Sellon reported that each undercover operative was searched prior to the compliance checks and found to have no identification on their persons. Each undercover operative was also administered a portable breath test before and after the compliance checks which registered a 0.0 each time. Chief Sellon reported that there were five violating establislunents on June 201" and an additional three violating establishments on June 25t". He stated that all eight alleged violators have been advised that the results of the compliance checks were being brought before the Board. Chairman Aptowitz would like to discuss the process of handling the violations. Chief Sellon stated that before the process is discussed the Mansfield Police Department felt it was appropriate under the circumstances to not file criminal charges and leave it to the Board's discretion to deal with administratively as they see fit. Board Of Selectmen's Meeting July 24, 2013 Page 5 of 10 Mr. Ross noted that, at his directive, Tracey Whalen contacted the ABCC and received information regarding the process a local licensing authority take when dealing with alcohol violations. These steps include: law enforcement informing the local licensing authority of the compliance checks, nature of the violations and establishments involved. The ABCC stated a certified letter of the violation is to be sent to the violating establishments with a date to appear before the local licensing authority and that Town Counsel should be present. The information from the ABCC states that the local licensing authority has four options: written warning, suspension of the license for a time to be determined by the local licensing authority, modification of the license or to revoke the license. All decisions must be in writing to both the violating establishment and the ABCC and accompanied by reasons for the decision. Any violating establishment has five days to appeal to the ABCC. Chairman Aptowitz confirmed with Chief Sellon that this is a combination of restaurants and package stores. Mr. Kozlowski clarified that there are two separate issues Chief Sellon spoke to which are that the police department is not pursuing any criminal actions of the eight establishments at this time and that is separate and distinct on whether the Board chooses to have hearings. Mr. Kozlowski believed it should be either eight hearings or nothing. Chairman Aptowitz noted that each establishment has its own history to be considered. Mr. Dentino stated that the Board can only consider violations within the past three years. Mr. Annino stated how disappointing it is that there are eight violations. Mr. Kozlowski noted even more disappointing given that a letter was sent previous to the compliance checks. Mr. Ross noted that Town Counsel, Paul DeRensis, has been notified and will appear with the Board at the hearings. Mr. Annino inquired as to the fee and if this would be covered in the retainer. Mr. Ross felt it was outside of the retainer but would further review. Chairman Aptowitz stated it is the consensus of the Board to hold hearings. It is his thought that the Board move quickly in order to be fair to the establishments. The discussion moved as to how to schedule the hearings. It was determined by the Board to schedule the violations at the next available Board of Selectmen meeting, Wednesday, August 14d' and follow with the next available meeting on Wednesday, August 28t11 with four establishments appearing each session. The Board then discussed who should appear at the hearings as far as enforcement officials. Mr. rtozrowsrcr noted mat 1 own Counset would determine who should appear. 8. d nafleW, .I Pr jOw ;. Nancy Wall and Scott Brigante are present from the Mural Committee. Mr. Brigante read from a statement on behalf of the Mural Committee. The statement has been made part of the record. The Committee presented a handout to the Board which described a panel to be placed on the North Common in accordance with the North Common master plan. The panel would describe the mural and the Committee would like to dedicate a portion of the panel to the Gold Sponsors, allowing for recognition of their sponsorship with their name and logo. Mr. Dentin felt that this is a worthwhile approach but is concerned with limiting to eight sponsors and how that is decided. The Committee is more concerned with getting to the eight sponsors. Mr. Dentino noted that in reviewing the mural process he did find references to sponsorships but stated it is unfortunate that the verbiage did not hit the target audience at Town Meeting. Board Of Selectmen's Meeting July 24, 2013 Page 6 of 10 Mr. Brigante felt it is important that the process of creating the mural be an evolutionary one, that as feedback comes to their attention it is addressed. Mr. Brigante felt that most projects are successful due to feedback during the progress. The Committee is convinced that it will be able to find the remainder of the fiords to complete the mural. Mr. Briagante stated that since the mural was started there has been nothing but positive support and feedback. Mr. Dentino inquired as to the feedback to his suggestion of scaling back the size of the Town's name. Mr. Brigante stated there have been various thoughts on the sizing in the public, which the Committee would speak to the designer about. Mr. Moran felt that the Committee's new approach to recognizing sponsorships added more gravitas to the mural. He felt it made the mural more interactive and felt badly about the mural losing a sponsor. Ms. Wall noted that the panel approach offers an educational piece to the mural as well, where classrooms could visit. Mr. Kozlowski was appreciative of the new design. He too was sorry it cost the mural a sponsor. Mr. Kozlowski inquired as to the $100 donation allowing for your name to be represented on the mural, specifically looking at the design and how these sponsor names run through the word "Mansfield ". Mr. Brigante explained that the artist will add these names as a design illusion, meaning the names would not be visible unless within close proximity of the wall. Mr. Almino thanked the Committee for working with Board and apologized for his passion at the previous Board's meeting and stated it was out of concern for the community. He felt the new idea of the panels on the North Common was a fabulous one. He stated that the panel will add interest to the North Common and was truly classy. It is Mr. Annino's thought that this panel adds more value to the sponsors. Chairman Aptowitz stated that the panel adds a learning lesson for the community. Also, the Committee will need to work with the master plan of the North Common concerning placement of the panels. Ms. Wall reiterated that there are two panels to be placed. Motion: To support the placement of two information panels for the Mansfield Conumurity Mural on the North Common with location to be determined by Town Engineer (Annino /Moran) PASSES 5:0 Mr. Ross noted there are two projects, fully funded by the State, that relate to improving intersections at Hope, Park and East Streets and also in front of the Jordan/Jackson School. In both cases it would involve reconstructing the intersections and provide safety areas. Mr. Ross stated the intersection at Hope, Park and East Streets is especially interesting because it would cut down the traffic on Park Street and improve safety. Mr. Ross stated that the Federal Government and the State would fund these 100% and the Town's only obligation is to require right of way where Mr. Ross noted none is needed. Mr. Ross also noted that as a normal part of any project the Town would need to notify residents in the area via meetings. The consultant for the State is looking for the Board to support the project via the Town Manager who will coordinate. Correspondence Mr. Ross began his report by noting that the Fales Oil Building has been removed, including the wall. He noted that there is still some clean -up to do, which should be completed within the week. Mr. Ross reported that he has signed a contract for the rubberized seal coating for Town streets, which includes cul -de -sacs and turn areas for vehicles. It had been reported that bleeding was still occurring after previous seal coating, believed to be due to hot weather. After investigating, the Town found the rubberized material does not bleed. An example of the use of the rubberized material can be viewed on Balcolm Street. Mr. Dentino asked for a price comparison between the chip sealing and rubberized material to which Mr. Ross noted he would provide to the Board. It was Mr. Ross' understanding that the Land Court has made its decision regarding the Montessori School. Mr. Ross noted that the Town has not received a letter as of yet nor has the decision been posted but will make that available to the Board as soon as it is received. Mr. Ross will be distributing to the Board a Draft Policy to go with the BYOB By -Law for their review and noted it will be a future agenda item. Mr. Ross is working on a memo regarding the parking along the Old Colony Trail, which runs from Shawmut down to East Street. Mr. Ross has been researching who has easements and agreements and found it to be an interesting exercise. This issue came to be due to citizens questioning the access point of the new condominiums (Mr. Cunningham's development). Mr. Annino questioned if they are taking away parking to which Mr. Ross responded that he did not believe so. He noted that they do have the right to access the driveway at the rear of the property, which is Town property (Town right of way). Mr. Ross reported that he received an email from MMA noting that the Legislature unanimously overrode the Governor's veto on the budget and restored all state aid. Mr. Ross stated the budget is in good shape. Mr. Ross then reported that the Legislature, by a large margin, then overrode the veto on Transportation Bill, which addresses the issue of Chapter 90. Mr. Ross hoped that this was the end. Mr. Dentine commented that he is unsure as to why the cost of CPR training for the Electric Department was subbed out, costing thousands of dollars, when training is offered through the Fire Department for free to Mansfield residents. Mr. Dentino believed it would make sense to have the training available to Mansfield employees, especially Light Department, Public Works and Highway. Mr. Dentino did not find that the Light Department or any public employees should cost any more than a citizen. Mr. Ross recalled that the Fire Department's concern was that the CPR training for the Light Department required a different level of training in order to meet standards and is at a higher level than what they would administer to the average citizen. Mr. Ross further Board Of Selectmen's Meeting July 24, 2013 Page 9 of 10 stated that the Fire Department would have to purchase additional equipment in order to conduct that training. Mr. Moran agreed that, per Chief's Boldrighini's memo, it was the level of CPR certification required to administer the training as well. Mr. Dentino then asked if the Emergency Management division of the Town is capable of providing the CPR training required, to which Mr. Ross stated he would follow up and get the information back to the Board. Mr. Annino attended a walkable communities conference and learned a great deal on making communities safer and enhancing the public perception of walking. Mr. Annino was pleased to see that there is an established rating system of "walkability" in the US and that Mansfield is 73 out of 100 (Boston being 79) and rated highest in regards to the surrounding communities. Mr. Ross has spoken with the new conservation agent and noted her interest in enhancing trails in the Town and remarked that there is so much potential. Mr. Kozlowski commended the Mansfield Police Department for their sponsored of the Special Olympics with their first 5k "Run From The Cops ". Chairman Aptowitz would like Mr. Ross to schedule an Audit Committee meeting. There is a need to nominate a Chairman for that Board. Chairman Aptowitz asked if the Clerk's office is handling the codification. Mr. Ross reported that the Town has led a contract to general code for codification. The Clerk's office is currently researching bylaws due to conflicting issues and will then work with general code to have them worked out and put in proper codes. Mr. Ross noted it had just been assigned but should be completed in time for Spring Town Meeting Chairman Aptowitz asked that Mike Ahern please check the steps at the side entrance of Town Hall. Chairman Aptowitz asked that Board to please remember to sign warrants on Wednesdays. None.
