July 10, 2013
Present: Jess Aptowitz; Chairman, Doug Annino; Vice Chairman, Kevin Moran; Clerk, George
Dentino, Olivier Kozlowski William Ross, Town Manager
Chairman Aptowitz called the meeting to order. The Chairman stated that the meeting is being
Broadcast live and will be taaed for future broadcast.
Mr. Moran read the public hearing notice into record.
Motion: To open the public hearing concerning the application of Community Care Pharmacy,
Inc. (Kozlowski/Dentino) PASSES 4:0
Ms. Lauretta Okoye, 32 Hill Street, Foxboro, is present before the Board. Ms. Okoye is planning
to rent a 2,000 square foot space at 214 Rumford where she will dedicate 1,000 square feet towards
a pharmacy and the other 1,000 square feet towards a retail package store (wine and beer only).
Ms. Okoye has been a registered pharmacist for approximately 17 years and would like to bring a
local pharmacy to the coimnunity where all insurances would be accepted, prescriptions could be
delivered to the elderly and employee Mansfield residents. Ms. Okoye felt that having the wine
and beer would assist in establishing the pharmacy.
Mr. Moran asked Ms. Okoye her background regarding her pharmaceutical license. She stated that
she has been a registered pharmacist for 17 years but has worked in the industry for 20 years in
such businesses as CVS and Walgreens. She has her own pharmacies, already established, both in
Boston and has an agreement with the Bureau of Prisons where she provides prescriptions to
residents of half -way homes. Although she has never sold alcohol she stated she understands the
restrictions and strictness involved with that license given her pharmaceutical background.
Mr. Annino stated he will abstain from voting as Ms. Okoye is looking to rent at a location which
he had designed.
Mr. Kozlowski asked if Community Care is a chain. Ms. Okoye stated this is the first Community
Care but she hopes to have additional "Community Care" pharmacies in the future to go along with
her two existing pharmacies in Boston. Mr. Kozlowski explained that he had Tracey Whalen
research the "standard of review" in regards to what is paired with a retail alcohol license. Ms.
Whalen reported that according to the ABCC there is no set "standard ". Mr. Kozlowski stated that
although this concept is new to him he didn't feel it was government's place to judge the business
model. Mr. Kozlowski asked Ms. Okoye if she knew of other pharmacies selling alcohol in
Massachusetts. Ms. Okoye had noted Walgreens and Wal -Mart as having pharmacies with a
alcohol license but Mr. Kozlowski noted that those are all rather large chain businesses. Ms.
Okoye stated that it is not a new business model and mentioned that the Board of Pharmacy also
has to inspect and approve Ms. Okoye's plan/business model prior to opening.
Mr. Dentino can't fathom that there is no restriction on what kinds of businesses can apply for a
retail alcohol licenses. Mr. Dentino noted that in the past pharmacies could apply for a liquor
license for medicinal purposes but this business model is new to him and questioned how many are
in existence in Massachusetts. Mr. Dentino did not consider a business such as Walgreens as a
Board Of selectmen's Meeting July 10, 2013
Page I of 10
pharmacy due to the size and variety of products sold. Ms. Okoye can provide the Board with list
pharmacies within Massachusetts that also sell alcohol. Ms. Okoye further explained that there
will be two separate entrances, one dedicated to the pharmacy and the other to the retail package
store.
Chairman Aptowitz felt it is the Board's job to question if there is a public need for a retail package
store in that location. He noted that there are seven retail package stores currently within a half
mile radius of the location where Ms. Okoye would like to open her business (The Store,
Tedeschi's, Cork's ect.). Chairman Aptowitz asked Tracey Whalen what the status of retail
licenses are in the Town. Ms. Whalen reported that Ms. Okoye is applying for the last retail
alcohol license for the Town and noted that there was an applicant interested but has not submitted
any paperwork. Chairman Aptowitz noted that Ms. Okoye had stated she has no experience selling
beer and wine. Ms. Okoye stated she has experience in selling other products such as cigarettes
and prescriptions which have legal restrictions. Chairman Aptowitz inquired about the store
layout. Ms. Okoye noted that there has been no layout established but that a customer will be able
to enter the pharmacy to get to the retail alcohol without having to go back outside and vice versa.
Ms. Okoye stated that in all her years in business she has not had a break in or theft of any kind.
Chairman Aptowitz asked Mr. Annino if this facility was able to handle large delivery trucks to
which Mr. Annino stated that it could.
Mr. Dentino noted that in reviewing the floor plan that there is far less space dedicated to the
pharmacy than to the alcohol portion of the space. Ms. Okoye stated that according to the
pharmaceutical board the requirement is a minimum of 300 square feet. Mr. Dentino remarked
that the space for the retail alcohol space far exceeds the pharmacy space. Ms. Okoye noted that
the model for her pharmacies is a "community pharmacy" where a customer can come in and wait
in a relaxed environment with a magazine or watch television, it is not filled with shelves and
aisles. Mr. Dentino felt that this is more a retail alcohol space and that the pharmacy is just a part
of it. Mr. Dentino was unsure if there was a need for another retail alcohol space in that location.
Mr. Kozlowski stated the Board should be looking at whether or not there is a need for the retail
alcohol license and asked if there was a way to grant the license on the condition of approval
through the pharmaceutical board. Chairman Aptowitz stated that, per the ABCC, the Board
cannot deny the license based on what it is being paired with and that a condition of that nature
would be contradictory. The Chairman stated the Board needs to decide what is best for
Mansfield. Mr. Kozlowski noted that there is the Produce Barn on Route 140 in Norton which has
a retail package store, produce store and hardware store all under one roof which is probably the
closest example.
Chairman Aptowitz asked for questions from the public.
Jill Colella of 266 North Main Street in Mansfield noted that a Walgreens in Boston just opened a
new location where it is one stop shopping for basic needs, pharmaceutical needs and also beer and
wine. Ms. Colella felt that Ms. Okoye's model targets one stop shopping, which she personally
would rather have. Mr. Dentino appreciated Ms. Colella's opinion but did not consider Walgreens
a pharmacy because the pharmacy is not the primary use but a secondary use.
Chairman Aptowitz asked what Ms. Okoye's plans were on being on the premises given she has
other locations. Ms. Okoye was hoping to be functional by October and that she planned on being
Board Of selectmen's Meeting kdy 10, 2013

onsite for the pharmacy 40 hours a week and hiring an additional person for the retail alcohol. The
Chairman noted the Board takes the sale of alcohol very seriously and need to ensure that trained
personnel will be on site. Ms. Okoye stated that she will be the manager of record for the
Pharmacy and then she will hire a manager of record for the alcohol but that she will be oil site for
60 hours a week to oversee the entire business.
The Board and Ms. Okoye discussed the importance of ensuring that anyone working on the retail
alcohol side of this business will need to be properly trained in accordance with the ABCC law.
Motion: To close the public hearing regarding the application of Community Care Pharmacy, Inc.
(Moran/Kozlowski) 4:0:1 (Annino ABSTAINS)
Mr. Moran likes the business model put forth before the Board but questioned if there is a public
need being served. Mr. Moran is struggling with allocating the license due to a need having to be
satisfied.
Motion: To grant the license for a retail package facility at 214 Rumford, Community Care
Pharmacy, Inc. (Kozlowski /Moran)
Discussion: Mr. Dentin stated he basis his opinions on competition and the freedom to do that.
He feels Mansfield is well populated with establishments and has never stopped anyone from
having a business and succeed in the Town. Mr. Dentino would still like to know the number of
these establishments in Massachusetts. Mr. Kozlowski stated this is an odd combination for him
but just because he hadn't necessarily seen this type of business doesn't mean it won't work. He
felt that the Board has given out licenses to establishments within close proximity of each other
previously, creating competition.
Chairman Aptowitz asked Mr. Dentino if he would like to table the vote until a later date until he
received the information on the number of these types of licenses. Mr. Dentino stated that the
information would not factor in his decision. He felt that the need will be satisfied by the success
or the demise of the operation and that will prove if there is a need.

Chairman Antnwit7. noted that it came to the Board's attention that there were snonsorshin levels
attached to the fund raising campaign for the Mansfield Mural. The Chairman understood that
depending on the level of sponsorship there would be recognition of logo or name on the mural.
The Board invited the Committee to clarify what these sponsorships include. Scott Brigante and
Ken Butler are present from the Mansfield Mural Committee.
Mr. Brigante explained to the Board that the underlying painting (outlining), which is the first step
to the mural, has begun and to date the Committee has raised $31,156 in monetary donations, in
kind donations of paint and material but the majority is in monetary donations. Mr. Brigante
explained that the funding that will allow for the completion of the mural possible is a
collaboration between the citizens of the Town and area and the business community. Mr. Brigante
believed that corporate sponsors will be responsible for at least half of the money raised for the
Board Of Selectmen's Meeting July 10, 2013
Page 3 of 10
project. Mr. Brigante stated that the Committee is aware of both the importance of the corporate
sponsors and also the concerns that the Committee not take the sponsorship and turn it into an
inadvertent advertising campaign. The Committee wants to acknowledge the donors and find a
way for them to add value to their investments but to honor the purpose of the mural, which is to
showcase the unique characteristics of the history of the Town. Mr. Brigante explained that the
Committee created a level of sponsorship where the top level is a $5,000 donation (where there are
currently 3 with a maximum of 8 donors) which includes a 24" x 36" space where the designer will
create a faux engraving of the business name and logo on the mural. Mr. Brigante explained that it
is an indication of being carved into the mural but in fact it is just the way the artist uses shading
that it appears to be carved. Mr. Brigante stated that 90% of the project will be completed by the
end of August with 100% completion sometime in September, but stated that it is all weather
related.
Chairman Aptowitz noted that the Board's first concern was that the Mural was started prior to the
entirety of the funds being raised and secondly that corporate sponsorship issue was never
addressed in the Committee's presentation at Town Meeting when they went for approval for the
mural from the residents. The Chairman and the Board are concerned that the residents did not
have all the information before they voted their approval.
Mr. Brigante stated that the Committee took a calculated risk to start the mural so that the residents
and potential investors could visualize the mural in hopes of creating more enthusiasm and to
solidify more investors. Mr. Brigante reported that since the mural has been started they have
received additional sponsors. Mr. Brigante explained that failure is not an option but there is a
safety valve, in the form of IF something goes wrong, of money set aside to return the wall to its
original state. The fundraising goal is $50,000 and currently they are a little over $30,000. Mr.
Brigante did admit that there was no mention of sponsorships within the presentation given at
Town Meeting but the thought was that it was mentioned verbally in terms of the residents and
business supporting the mural. Mr. Butler added that the money received in donations also
includes upkeep to the mural and the kiosk that is to be placed on the North Common.
Mr. Annino stated that there is no kiosk for the North Common. There are current plans for the
North Common already in place that will not give way for a kiosk. There was a discussion about an
informational panel and that was all. Mr. Annino will reserve judgment on the mural however is
stated he is very concerned about the amount of advertising on the mural. He noted Mansfield is
not for sale and he does not feel this right or fair to the residents of Mansfield who voted. Mr.
Annino is quite upset as he feels these are not sponsorships but rather advertisements. Mr. Armin
realizes that monies need to be raised to sponsor the mural but that the Board goes to great lengths
when reviewing banners to ensure no corporate sponsors are on them for the purpose that no
corporation receives advertising on the Town's dime. This all came to a surprise to Mr. Annino
and he felt it degrades the Town and the Mural. Mr. Butler stated that he has done numerous
functions which required sponsorships through his MMAS work and he has always done
something to recognize donors. Mr. Butler noted that if you look around Town there are
sponsorships on Town property such as the athletic fields, commons, benches, trash barrels, ect.
Mr. Annino noted that in no way is this situation the same as what Mr. Butler is referring to and
stated this is not the bill of goods the Town was sold. Mr. Butler respectfully disagreed.
Chairman Aptowitz discussed that the renderings did not show the sponsorship section to which
Mr. Butler disagreed. Chairman Aptowitz stated that it was the Board's decision to let the
residents decide as to the creation of the mural and that the sponsorship issue was not brought to
Board Of Selectmen's Meeting July 10, 2013
Page 4 of 10
their attention at Town Meeting. Mr. Brigante stated that if they could spin back time and do over
again they would be more implicit in regards to the sponsorship. Mr. Brigante asked what the
Board would like to do going forward to honor the sponsors. Chairman Aptowitz noted that in the
Corie Shea fundraising it wasn't about "Business X" getting mentioned on the memorial as a
sponsor. The Chairman noted a tasteful booklet was created listing all those who took part in
aiding the memorial. The Chairman noted a model along those lines and have the sponsorships
kept off the wall. Chairman Aptowitz wished that this was made clearer at the Town Meeting and
felt that the Committee should not have started before all the funds were raised. Mr. Brigante
stated it was important to take all of the Board's concerns back to the Committee to look at the best
way to provide acknowledgement and address the Board's concerns. Mr. Annino would like to see
tasteful ways for the recognition of the donors by the Committee other than having it on the mural.
Mr. Moran understood the issue with beginning the mural before having all the funds and also
understands the need for sponsorships. Mr. Moran's concern is that due to the size of the mural
you really want it to be iconic and sponsorships on such a large space doesn't lend the right tone of
the mural. Mr. Brigante noted the positive feedback from the residents at last night's Family Fun
Night sponsored by the DBA. Chairman Aptowitz did congratulate the Committee on their efforts
and hard work. Mr. Kozlowski inquired as to the levels of sponsorships to which Mr. Brigante
stated there was the $5,000 level where the name /logo would be faux etched and a $2,500 level
where the name /logo would be smaller and even have a likeness of you in the crowd at the trotting
park section. Mr. Dentino is not excited about the sponsorship on the mural. He would like to see
something along the lines of a temporary banner. He felt that space is a premium and that if the
Committee started with 8 donors, soon it would be 88 because how can you limit it and decide who
gets it. Mr. Dentino also felt that the word "Mansfield" was too large and ate up most of the wall.
Mr. Dentino is excited for its completion.
The Board, Mr. Brigante and Mr. Butler agreed to meet again at the next Board of Selectmen
meeting on July 24 ". _
Chairman Aptowitz noted that this appointment was discussed previously and the Board stated that
the position needed to be posted. Ms. Whalen noted that the opening was posted and no other
applicants applied.
Motion: To appoint James Ragazzo to the Audit Committee (Armino/Kozlowski)
Mr. Dentino asked that the Board follow a procedure of receiving a written resignation from a
member who is not seeking reappointment prior to filling that seat. All Board members were in
favor of that suggestion.
Motion: To appoint James Ragazzo to the Audit Committee (Annino/Kozlowski)
PASSES 5:0
Chairman Aptowitz asked Ms. Whalen to inform Mr. Raggazzo and for Mr. Ross to schedule a
meetine of the Audit Committee to discuss Year end and annoint a chairman.
Chairman Aptowitz noted that Paul DesRensis was unable to attend tonight but did reach out to the
Chairman concerning the discussion of renewing the Town Counsel contract. The Chairman noted
that previous Town Counsel served the Town for over 20 years and the Town decided to bid out in
Board Of Selectmen's Meeting July 10, 2013
Page 5 of 10
favor of a new counsel with different rates. The Chairman noted that it does take about a year for
counsel to get up to speed and he is in favor of extending Deutsche Williams for another term. He
noted that in his discussion with Mr. DeRRensis the retainer would remain at the same price but any
other matters, ie specialty cases, would increase by $5 per hour. Chairman Aptowitz noted that he
had asked Mr. Ross as invoices were received to ensure the Town was being properly billed. Mr.
Ross noted that he does go through each invoice and in over three years any questions were met
with professionalism and changed to the retainer rate if found to be in error. Mr. Dentino inquired
what the specialty rate was to which Mr. Ross noted it is $180 and they are asking for a $5 an hour
increase to $185. Mr. Aptowitz asked Mr. Ross to speak about Mr. Colomb's services from
Murphy Hess regarding the Town's contract negotiations. Mr. Ross noted Mr. Colomb has been
working with him for all contract negotiations and he is very comfortable with his knowledge and
finds him to be successful with situations that needed to be wrapped up from the previous
administration. Mr. Ross noted how helpful it is to have Deb Herbert in his office as she is an
expert with contract language and saves the Town money. Mr. Ross would like to continue using
Murphy Hess for contract negotiations only.
Mr. Annino inquired as to how much the Town has paid Deutsche Williams and Mr. Ross stated lie
would get the exact figure as of year -end and report back to him. Mr. Armin also inquired if the
fee included secretarial services to which Mr. Ross reported no.
Mr. Dentino felt that normally the party, who would like their contract renewed, would be present
before the Board. Chairman Aptowitz stated that Mr. DeRensis reached out to him to express his
desire to continue working with the Town but unfortunately he could not be present due to illness.
Mr. Dentine stated that the Board typically does not work this way and lie does not want this to
become a precedent. Mr. Dentine felt that, when renewing contracts, the party should be present to
address any questions or concerns. Chairman Aptowitz explained that he made an executive
decision to keep the topic on the agenda due to the fact that the contract has already expired and
that the Board is working on a summer schedule and noted that Mr. DeRensis sent an email to the
entire Board. Mr. Annino agreed with Mr. Dentino that this is a $200,000 contract and when the
Board is discussing something of this importance the party should be present. Mr. Moran felt that
the only reason for Mr. DeRensis to be present was if there was a discrepancy over the $5 an hour
increase or if the Town decided to bid out. Mr. Annino and Mr. Dentino are only asking that the
Board be consistent with the process. Mr. Kozlowski noted that in the email from Mr. DeRensis
there was no request for a delay and that Mr. DeRensis gave a contact number if there were
questions during the discussion.
