Chairman Aptowitz asked Mr. Ross if there was any further information needed from Gary Babin.
This easement is in the paper right of way of Copeland that the Town discussed utilitzing for
underground electric connection from Bird Road substation over to the West Side substation. Mr.
Ross reported that this is the first of several easements approved through Town Meeting (last year)
and is a Board of Selectmen action due to the Town is accepting the easement. Lou Ross, Town
Counsel, asked that as the easements come in to have the Board act so there is no waiting. Mr.
Annino asked that the Board send a letter of thanks to the owner Ms. Gillooly for her generosity.
Mr. Ross gave credit to Mr. Babin and his staff for their work in explaining and contacting those
involved.
Motion: Accept and sign the easement agreement (Kozlowski /Moran) PASSES 5:0
Chairman Aptowitz first looked to Mr. Dentino for any comnients he may have concerning Mr.
Ross' evaluation considering that he was absent when the evaluations were originally scheduled.
Mr. Dentino noted that his rankings for Mr. Ross were very high and he is tremendously pleased to
work with him and the Board in the future. Mr. Dentine, also asked for copies of the contracts to
review prior to deciding on a salary increase. Chairman Aptowitz thought that was fair. Mr. Ross
noted that currently contracts for this July I" are in line for a 2% adjustment (that does not included
the two groups that will be discussed in Executive Session) and any changes in the original
contract, in regards to health insurance or stipends, was adjusted two years ago. Mr. Ross was
happy to share the contracts with Mr. Dentino and noted they are on the Town website. Chairman
Aptowitz asked if Mr. Dentino would like to hold off to which Mr. Dentino would like to proceed.
Mr. Annino felt considering the evaluations Mr. Ross received he is due a raise however he is
unsure how to gauge it. Mr. Kozlowski noted that Mr. Ross likes to lead by example and felt that
due to his evaluations an increase was merited but wanted to be sure it was in the Budget. Mr.
Moran felt that given the nature of the review Mr. Ross should be compensated and felt he merited
what was in line with the contracts, which was 2 %2 %, but felt that Mr. Ross may be uncomfortable
with that due to him wanting to lead by example. Mr. Dentino inquired as to what was in the
Budget to which Mr. Ross stated 2 %. Mr. Ross felt he should lead by example and suggested that
to do more than that puts him in a position when having further discussions with bargaining units.
Mr. Ross put forth a suggestion for consideration that since he did not attend ICMA this past year,
if he could attend, for personal and professional development, his SEI Alumni Program in August,
which would cost about $2,400. Chairman Aptowitz commented on how smoothly Town Meeting
was this year in terms of attendance and the professionalism and that is a testament to Mr. Ross and
Ms. Hodges, The Chairman felt that in itself merited something. Mr. Annino applauded Mr. Ross'
sense of professionalism and how rewarding he finds taking the time for professional
development. Mr. Moran did not have an issue with Mr. Ross attending and the 2% increase. Mr.
Dentino stated Mr. Ross is a true tribute to the people that want to be fair and felt his leadership
sets an example that the Board and others employed by the Town can look at and think in the same
direction. Mr. Dentino is thrilled that Mr. Ross would like to attend the conference.
Motion: To award Mr. Ross a 2% increase in his contract and the ability to attend the SEI Alumni
Program (Annino /Kozlowski) Discussion: Centered on the effective date of Mr. Ross' increase.

D. Correspondence
Letter fi•om Norton's town Manager, Michael Yunits, Regarding Formal Notice of
Withdrawal from the Crossroads Veterans District
Chairman Aptowitz noted that this is a formality due to Mansfield's vote to withdraw from
the district and there is no longer a contiguous border.
Mr. Ross, as a follow up to Town Meeting, met with staff and Shaun Burke is developing a
schedule of the Capital Items approved at the meeting in regards to time and assigning
responsibilities. Mr. Ross reported that it will be coordinated with the School Department due to
several of the projects crossing boundaries, particularly the phone system.
Mr. Ross has developed the preliminary job descriptions for both the Finance and Human
Resource positions. Mr. Ross will review the Human Resource description with Brenda Hodges
and will review the Finance description with John Stanbrook, Roxanne Donovan and Nancy
Hinote. Upon completion, the descriptions will come to the Board for approval.
Mr. Ross and the staff have met and begun work on the various financial policies recommended by
Standard and Poors and the financial report. Mr. Stanbrook suggested the Free Cash policy be the
starting point. Mr. Ross noted that the Town will work with the Finance Committee report to the
Board as well as the School Committee.
The telephone replacement system is a priority particularly because the schools are involved. Mr.
Ross would like to have this project as a priority so that switch overs can begin while the schools
are on break.
Mr. Ross expressed his frustration with the work on Route 106. Both he and Mr. Azinheira
continue to reach out to the State, since it is a Massachusetts Highway project. Mr. Ross wanted
Board Of Selectmen's Meeting May 15, 2013
Page,1 of 7
the residents to know that this is a Massachusetts Highway project, which lie felt was a 7 -8 month
project and has now turned into a 24 month project. Chairman Aptowitz asked where the Town's
State Reps are to which Mr. Ross stated that letters from the Town are forthcoming.
Mr. Ross noted there was a meeting this morning (May 15th) regarding leftover fiends from a
CDGB project a few years ago. There are two pieces of money left, one must be used for housing
activities /housing rehab and the other has to be used in the central business district. Mr. Ross
suggested improvement and replacement of some of the sidewalks, pedestrian ramps and to the
look at signage and beautification. There is approximately $50,000 available and Mr. Stanbrook is
looking into that. Chairman Aptowitz noted he had recently heard from a large business in Town
regarding this exact issue. Mr. Annino noted the sidewalks are bad in that area. Mr. Moran felt that
the area is not "walkable ". Mr. Ross and Mark Cook discussed in particular the cobblestone type
crosswalks around the common are broken up and perhaps they should be replaced with colored
stamped concrete. Mr. Annino suggested stamped asphalt, which is cheaper.
Mr. Ross reported that the Town continues to work with the State regarding the northbound traffic
signal at the 495 North interchange. When travelling north, all traffic is stopped on the red signal,
when the th a traffic does not have any conflict and should continue to travel through. The
response from the State has been to have their engineers review. Mr. Ross has heard from
residents and felt it was important to let everyone know where that stands. Also, Mr. Ross reported
the Town will change the traffic signal at Route 106 and East (corner of Flint Farm) to have a green
arrow when taking a right onto East Street so that traffic continues to flow, especially since there is
a designated lane.
Mr. Ross is working with Ron Sellon and Lee Azinheira concerning conflicting speed limit signs
around Town. For example, on West Street by the Police Station, one direction has 20 mph and the
opposite direction has 30 mph. Mr. Ross understands that this will be difficult but would like to
investigate and try to rationalize what is happening. He noted that again the State will need to be
involved.
Mr. Ross noted that the Town Meeting was the best he has attended in his four years here. The
Town is much better off when it works together collectively, setting priorities and using resources.
He gave a tremendous amount of credit to John Stanbrook.
Mr. Annino thought the open house at the Albertini Wells went well and that it was a great tribute
to the Town on how nicely it turned out.
Mr. Annino said he was glad to be back and thanked the Board for their support. He still has a list
of projects to tackle.
Mr. Annino asked that a chart or schedule/timeline be created on the status of the capital projects.
Mr. Annino also inquired as to the accounting of those projects. Mr. Ross explained it depended
on the departments involved, and noted primarily the DPW and Building Departments are
involved. Mr. Ross does sign off on any changes and noted there is a great deal of security.

Mr. Annino asked that there is an agenda item in the near future regarding the Keep Mansfield
Beautiful Committee and Neil Rheinn come before the Board concerning tree plantings and
payment given that the grant was declined.
Mr. Annino inquired as to Mr. Ross' discussions with Norton concerning the Crossroads Veterans
District. Mr. Ross reported that he spoke to Mike Yunits (Town Manager, Norton) and Dave
Coulton (Town Manager, Easton), who continue to employee a VSO and Mr. Ross spoke with Mr.
Hobson as to whether he would like to continue here in Mansfield. Chairman Aptowitz stated it is
prudent to move this along as the district ends at the end of June. Mr. Ross noted that the difficulty
lies with Foxboro and that Norton has no hard feelings toward Mansfield.
Mr. Dentino congratulated Mr. Kozlowski and Mr. Aimino and felt the Town has a strong Board
and looked forward to another year.
Mr. Dentino asked about Executive Session concerning the discussion of pending litigation to
which Mr. Ross noted that he would work with counsel to schedule that for next week.
Mr. Kozlowski thanked all who came out to Town Meeting and felt there were many to thank in
respect to having a Budget completed on time.
Mr. Kozlowski thanked the poll workers and those who came and voted. Mr. Kozlowski
appreciated the vote of confidence.
Mr. Kozlowski was approached by residents at the polls concerning picking up after your dog,
particularly around the South Common. Mr. Ross will be speaking to Mark Cook regarding that.
Mr. Kozlowski appreciated the efforts of the Town's EMS as he had to utilize them for his
daughter recently. He thanked them.
Mr. Kozlowski wanted to schedule timing of the structure for BYOB, which was approved at
Town Meeting. Mr. Ross noted that upon the Attorney General approval. The Chairman asked
what the turn - around time was for that to which Mr. Ross noted that in his discussions with the
Town Clerk, Marianne Staples, it was a few weeks.
Mr. Moran felt it would be a good idea to have the Planning Board present to the Board, prior to
Town Meeting, so that the residents can have a better understanding. He felt if the residents are
unsure they will vote no.
Mr. Moran asked for an Eagle Scout proclamation for Nicholas DeMassi, who has attained the
rank of Eagle Scout.

Chairman Aptowitz noted that this will be the Board's fourth year together and congratulated both
Mr. Aimino and Mr. Kozlowski.
Chairman Aptowitz attended the S.S.A.A.C. Auto Show and noted that it is indeed a flea market
and felt the Board needed to discuss this before next year's event. Mr. Annino asked about the
vendor behavior to which Mr. Ross and Chairman Aptowitz noted there was a 24 hour police
presence and fire watch. The Chairman noted that there is a clear exemption in the State law for an
event under 10 days and is a non - profit and that Mr. Riccio found that the event fell into a category
where the Town could issue a camping permit. The memo is on file if the public would like a copy.
Chairman Aptowitz asked about the Bird Road landscaping to which Mr. Ross reported that he and
Gary Babin viewed the area and it will happen.
Chairman Aptowitz asked the Board to submit summer plans due to scheduling of BOS meetings
over the summer.
Mr. Ross reminded the Board that the first Cornetist event is this Friday, May 17 °i and there was an
inspection by Mr. Riccio and the Fire Department to which there were improvements in the
electrical and the Command Trailer is set up. effective July 1, 2013 on the base only
None.
Clerk Kevin Moran moved for vote to enter into Executive Session Pursuant to Exception 43
Under M.G.L. Chapter 30A, Section 21, to discuss strategy with respect to collective bargaining
for the DPW and MMED AFSCME Units as open meeting may have detrimental effect on the
bargaining position of the town and to adjourn Selectmen's meeting thereafter
(Moran/Kozlowski). Chairman Aptowitz noted that Mr. Kozlowski was Chairman when the
Executive Session was schedule and noted he supported the decision to schedule the Executive
Session. The Chairman called for a vote: Kozlowski (AYE), Moran (AYE), Annino (AYE),
Dentine (AYE) and
