Motion: To open the public hearing on a new annual all alcohol common victualler license for Blazin Wings, Inc, d /b /a Buffalo Wild Wings (Aptowitz/Moran) PASSES 5:0 Board Of Selectmen's Meeting April 17, 2013 Page I of 10 Stephen Bennett, Manager is present. Mr. Bennet explained that the company is looking to open an location in Mansfield. Blazin Wings has 914 locations nationwide. 'they are currently in the process of opening in Brockton, Dartmouth and hopefillly Mansfield. Mr. Bennett noted that the Brockton location has added 155 jobs to that community. Mr. Bennett stated the company takes the service of alcohol extremely seriously and explained the process of TIPS training and the extent that Buffalo Wild Wings respects that law. Mr. Aptowitz inquired as to the status of the building plans for the Mansfield location. Mr. Bennett couldn't speak to that particular location but reported that it takes 66 days to build from scratch and the company is looking to open in November 2013. Mr. Moran had visited one of the establishments when travelling on business and noted that the company is very controlled when it came to LD.s and he was surprised at the family business they do. Mr. Moran noted that if Mr. Bennett was not going to be Manager of the alcohol license to ensure that the company comes back before the Board to have a new Manager of record approved. Mr. Annino noted that the Town takes alcohol licenses very seriously and inquired about the percentage of alcohol /food to which Mr. Bennett replied 25 % -30% is alcohol sales. Mr. Annino asked if the outside dining area is to be gated to which he could only comment that the Brockton facility is gated. Mr. Bennett gave a brief history of work experience in the field. Mr. Annino inquired about seating capacity to which Ms. Whalen noted 299 and Mr. Ross further noted that the license will not be delivered until a Occupancy Permit is granted. Mr. Armin inquired as to Live Entertainment to which Ms. Whalen responded that all information is listed within the packet which included juke box, games and televisions with cable. Mr. Dentine, wished the chain well. Chairman Kozlowski asked if Mr. Bennett would be the Manager and Mr. Ross again stated to keep the Board informed if there is a change. There were no comments from the public. As reported at last week's BOS meeting, the Town did take bids for 15 year bonds for several projects that were approved at Town Meeting the last two years. The Town received an interest rate of 1.71% average for that period of time. This is to finalize the actual issuance of the bonds and the memo outlined the action to take and signatures needed. Motion: The Board votes to approve the issuance of the bonds and have the Clerk of the Board of Selectmen sign four copies of the Vote of the Board of Selectmen, sign four copies of the Tax Certification, the Board sign four copies of the Continuing Disclosure Certification, sign four copies of the Signature No Litigation and Official Statement Certification and sign the Fifteen General Obligations Municipal Purpose Loan of 2013 Bonds (Morarn/Aptowitz) PASSES 5:0 The Board then signed the bond bid. eY 5 ngq _ ?'insQn Tn IrwseIN 'y'i } ter As. =e•s* tt x #"npioSxrz - t 'iT-;+ r5- tas xr t r.njam g t r;-y'a rlIrYyf 14xcs 013and ©mhg 9,2.Q13ff tr Board Of Selectmen's Meeting April 17, 2013 Page 2 of 10 Mr. Ross noted that this is issued from DPW each year. Mr. Moran reminded residents that this is part of the Town's permitting and is done each year. Motion: Imps lenient Phase I Water Restrictions effective Friday, May 24di and ending Monday, September 911 (Aptowitz/Annino) The Chairman asked if the restrictions are based on science/ substance or is this something passed on from the State. Mr. Ross explained that it is part of the permit requested by the State each year and asked that the Board implement. Mr. Ross further noted that if there is drought conditions the State will then issue Phase II. Mr. Aptowitz asked if signage will be placed around Town so residents are aware. Mr, Ross assured there would be and read the water restrictions into record. PASSES 4:1 Kozlowski NAY Mr. Ross noted that this is a reappointment and the Town did not feel Julie needed to appear before the Boad. Motion: To reappoint Julie Hunter to the Municipal Building Committee. (Moran/Dentino) PASSES 5:0. Mr. Aptowitz had asked to place this topic on the Agenda. Mr. Aptowitz was approached by a resident concerned at what point does the baimer policy issue go beyond to include signs on Town property with business names, ect. Mr. Aptowitz felt there should be a discussion regarding consistency of logos, postings and non - postings and the Town being fair and equitable to everyone. Mr. Ross was asked by another resident, who understands that the Town does not want banners advertising commercial activities, but is there a difference between a banner for a non - profit /charitable function that list major donors and gives them credit for that. Mr. Ross stated that it was seen as commercial activity and there has been no differentiation between the two. Mr. Annino noted to hang a banner on Town property and over a right of way is a privilege and the Town does that for them. Mr. Annino felt that as soon as businesses and logos are placed on those banners there should be an advertising charge or a charge to have the banner hung. He takes exception to having advertising hanging over our streets. He stated he is willing to examine the issue of signage on Town property and hadn't considered and felt the Town does in fact need to be consistent. If logos are displayed Mr. Annino felt that there should be a price attached. Mr. Aptowitz struggled with the fact of businesses that have been very supportive of the Town and its charities and the Town would like to encourage more of that. Mr. Annino noted that the banner is to promote the actual not for profit's event and to solely inform the Town of the event, not to recognize the donors. Mr. Dentino likes to think that there are other ways to promote and thank a business other than placement on the banner. Both Mr. Dentino and Mr. Annino felt the signage issue was different due to the fact that the business purchases the sign, maintains the sign and the area around the sign. Mr. Moran noted this is about building a brand, a community brand and in some cases running a charitable event can be difficult and sometime outside resources are needed, but if it is done tastefully he does not have a problem with it. Mr. Annino noted that if the Town allows the logos there will be no limit and it will be tying the Board's hands. Chairman Kozlowski noted tastefully and correctly in whose opinion? Ed Tartufo and Kara Griffin, members of the Tri -Town Chamber, are present to speak. Mr. Tartufo respects Mr. Annino's opinion and resonated with his position. Mr. Tartufo noted in respect to the signs in East/West Mansfield were paid by those small businesses that were off the beaten path so residents knew they were there. Mr. Tartufo gave a brief summary of examples of corporate names on score boards and Town property. Mr. Tartufo was upset at all the residents/businesses who made donations and spent time and effort to raise funds who have never been identified other than Mr. Tartufo coming to the Board to give a presentation and maybe they Board Of Selectmen's Meeting April 17, 2013 Page 3 of 10 received a letter of thanks. Mr. Tartufo does recognize this as an honor to represent the Town but not for profit cannot do it by themselves and require outside assistance and corporate sponsorship. Mr. Tartufo asked the Board to recognize this and respect that these companies just want to show that they are in support of the Town by sponsoring an event. Mr. Annino believed that donating a gazebo or scoreboard is different than what the banner discussion is about. Mr. Annino believed the barrier is to announce an event and he does not want to see Mansfield become "logoville ". Mr. Annino felt that there isn't always recognition to partake and help out and that is what makes Mansfield a community. Mr. Moran noted that those businesses are a part of the community and sponsors are not doing this to get their logo over 106, they are doing it for the community. Mr. Aptowitz used the example of the flag pole work by John Hogan. The Chairman's concern is that if you allow some of it then it opens the Board up to criticism and complaints. The Chairman suggested if there is a way to control the size of the logo on the banner, would that make a difference. Kara Griffith noted that non- profits, such as Rotary, the Chamber and Relay for Life, couldn't do well in the connnnity without the backing of the businesses. Ms. Griffith focused more on the fact that this is a "temporary banner ". Ms. Griffith stated that this is their fifth year for the Casino Night and as part of the sponsorship package that goes out there is a level where sponsors logo would be placed on the banner. She felt this is a new policy to have the Board approve banners, previously all barriers were approved through the Electric Department. Mr. Tartufo noted the banner has already been printed, they can tape if required, but would like to see the banner hung with the logos present. Mr. Annino stated the other answer is to just not have banners, where non- profits will suffer. Mr. Moran noted that there are some companies that sponsor events just to have placement and it is unfortunate. The reality here will need to be a series of compromise and finding a solution. Mr. Dentin does not mind the signs in East /West Mansfield, people named for memorial Park or sponsors for scoreboards. In the giant scheme of things the banner is miniscule. Mr. Dentino does not want to see the banner as an advertisement but does see the value and opportunity that businesses can lend to a non - profit event. Mr. Aptowitz cannot see a formalized policy at this meeting but felt the Board needed to be fair to the groups who have already printed the banners (Tri -Town and Rotary) given their events are imminent. Mr. Aptowitz felt the Board needed to come up with a date to formalize a policy. Mr. Ross stated the Board has a policy but does the Board want to change the policy to allow corporate logos. Mr. Annino felt this is a complex issue and that the Town should experiment by hanging the banners with the logos, factor the percentage of the space the logos have and see if it works. Mr. Dentin wants to see the banner go up but the Town needs to establish a policy so that in the future there are no more issues. He reminded the Board that there were organizations that came before the Board and sent away to change their banners due to corporate logos. The Chairman felt this issue is already on the radar screen due to Mr. Arnino's branding initiative and assured Mr. Dentino that this wouldn't be a "deal with it next year" issue. Motion: To allow the Tri -Town Chamber of Commerce to hang its original banner as presented for 2013 (Aptowitz/Moran) Discussion: Mr. Dentin felt this is the worst thing the Board can do. He is adamant of coming up with a policy for the Board to rely on. The Chairman felt a policy could not be attained at this meeting and that an agenda item to create a policy should be completed within the next month. Mr. Annino is not comfortable with creating a policy and felt it should be a workshop. The Chairman stated within 60 days to have policy in place. PASSES3:2 (Amnino /Dentin NAY) Mr. Tartufo and Kara Griffin both expressed thanks to the Board for listening to their concerns and will work with the Board in any way to move forward on their future policy. Mr. Aptowitz then brought to the Board's attention that the Town has the same issue involvin the Rotary Club's banner. Tracey Whalen noted that the Board approved the banner on March 13" but Board Of Selectmen's Meeting April 17, 2013 Page 4 of 10 at that time there were no logos. It had come to the Town Manager's attention that there are two business logos on the banner but Mr. Ross could not recall which businesses. Motion: To hang the Rotary Banner as presented for 2013 (Morarr/Aptowitz) Discussion: Mr. Deninto noted that the Board could have come up with something. Mr. Moran noted that banners historically have had sponsors until the Board began approval. Mr. Dentino is bothered that the Board put a stop to previous entities that had logo. 3:2 PASSES Armino/Dentino NAY. Carl Webber has managed the S.S.A.A.C.'s Trading Bee /Flea Market for over 30 years, which has been at the Comcast Center for over 20 years. Mr. Webber has never had to come before the Board previously and doesn't understand why he now needs to come before the Board for a permit. Mr. Ross explained there has been concerns raised by the Police and Fire Chiefs related to camping (which is not allowed), as well as the discharge of fireworks. Both Chief Sellon and Chief Boldrighini are present as well as Sergeant Crossman who worked the detail last year. Mr. Webber noted that in all the years there has only been six events where the police were called in and the fire department only once. Police Chief Sellon reported that in the first two hours of last year's event there were no issues, however as the event continued it became clear that there was drinking on to premises, open fires (makeshift fire pits), band playing (which attracted about 100 people), vendors on dirtbikes, and multiple incidents of fireworks and intoxicated parties. Chief Sellon reported that there were only two detail officers on scene which was abundantly clear was not enough and two additional officers were called to handle street detail for the traffic generated and noted that Mr. Webber was dissatisfied with that level of service. Mr. Webber was unhappy because he felt the officers were there to do what he coordinated. Chief Sellon explained to Mr. Webber that he is paying the officers to minimize the impact on the community, the officers are not his employees. By law the hiring of the officers is required. The Chief questioned the character of the event with rampant drinking, injuries and dealing with the event's vendors using unregistered dirtbikes. The Chairman asked Mr. Webber to explain the nature of his event and what it involves. Mr. Webber stated it is a flea market selling antique car parts with over 1500 spaces to sell. Mr. Webber rents the land from the Comcast Center and then sells the spaces to vendors. There are two people to manage the over 1500 vendor spaces (approximately 3,000 vendors). Mr. Aptowitz deferred to the public safety officers as to what is needed for the event. The main issue is hundreds of people camping overnight and the public drinking. The Chairman is aware of the public drinking By -Law but inquired as to the overnight camping. Mr. Ross reported that the Comcast Center is not zoned for overnight camping. Chief Boldrighini was not aware of the nature of the event but was informed by staff who reported on a medical call. He stated when the extent of the event was realized it is concerning due to, from his point of view, there are a lot of people and concentrated in one area that condenses people to small area. Chief Bolrighini reported there were concerns regarding fire lanes which were corrected and respected by Mr. Webber, The Chief did not realize there was camping and in such a tight area with open fires, which is not permitted, is a great concern. The Chief added that there were also reports of paper lanterns and fireworks, wlrich is very disconcerting to him. Chairman Kozlowski asked if this is a two -day event what happens to the wares overnight. Mr. Webber noted that is why the vendors camp out because the wares are typically large and also the vendors come from great distances, ie: Tennessee, Maine, New Jersey, New York — this is the oldest and largest flea market. Mr. Aptowitz inquired as to the price of admission? Mr. Webber reported there is a $10 charge but that the Comcast Center keeps it. Chief Sellon did not advise overnight camping and also that it isn't a good idea to have vendors leave their wares out overnight. Chairman Kozlowski stated that Board of selectmen's Meeting April 17, 2013 Page 5 of 10 the vendor's presence to protect their wares is in fact camping. Mr. Webber noted that camping is a common theme at flea markets. Mr. Moran stated this is troubling and embarrassing that this has been going on for years, which before now the Board had no idea and has licensed. Mr. Webber brought up the Elks Carnival, which is a week prior to his event and camping is allowed. Mr. Ross noted the Town is addressing the issue with the Elks as well. The Chairman's concern is the overnight camping. Mr. Ross furthered the point that the camping is what leads to the drinking, fireworks and other safety concerns to the public. Mr. Dentino felt it is the Board's responsibility to ask the two Chiefs to create a list of what is needed at the event in terms of public safety and to have discussions with Mr. Webber on adhering to their demands. Chief Sellon noted that in light of the conduct at last year's event he believed there would need to be an increase in the police detail to help handle that size and the fire departments presence as well. Mr. Annino noted there are two professionals before the Board concerned with this activity, he is not confident in what is going on there and a manger who cannot control the event therefore a permit should not be permitted. He defined this as organized chaos and is not impressed. Sergeant Crossman gave detail as to his experience over the last few years in regards to event with respect to the vendors' behavior and traffic concerns. The Chairman noted to Mr. Webber that there has been obvious growth over the years of the trading bee /flea market since its inception and because of that there is a need to upscale the detail. Mr. Webber agreed with the statement and said he would work with both Chiefs to ensure that all rules are followed. Mr. Webber is concerned about the cost. Mr. Ross noted an additional concern with money being charged at the door and is that permitted properly with the Comcast Center. Mr. Dentine asked both chiefs if they felt they could control this event with adequate personnel to which they both stated yes. Mr. Annino added as a caveat that there is no negotiation. Mr. Moran's concern was with all these vendors coming from around the country they probably have not made arrangements to stay elsewhere. Mr. Moran was confident that there will be camping but the Board has been doing this for years and with the event so close what is the Board to do but to monitor it closely and change the way this works going forward. The Chairman was concerned on the impact to local businesses to which Mr. Moran felt that many vendors do not leave the venue. Mr. Annino asked Mr. Ross what happens if there is camping to which Mr. Ross stated that Nick Riccio, Inspector of Buildings and Zoning Enforcement Officer, would have to issue a citation to the property owner and that would be the Town's only muscle along with no open fires, which is a violation of the fire code. Mr. Aptowitz stated emphatically if Mr. Webber cannot control the event then the Town should not issue a permit. Mr. Dentino questioned the value of the event but noted he is business friendly. The Chairman summarized by stating the applicant is willing to work with Chiefs and the Chiefs agreed they can handle the event. The two issues are a discussion with Mr. Montgomery and the storage of the wares if people cannot stay there. Mr. Dentino stated there is no reason why the Comcast Center cannot provide security. Mr. Webber stated that if camping is not allowed it will kill the event. Ms. Whalen noted that Mr. Webber did complete all paperwork and it was received and stamped November 30t". The Sunday License was forwarded to the State for approval but there was no record of the event coming before the Board for approval this year. Mr. Ross noted it was a mistake by a previous employee. Mr. Amlino noted that it doesn't matter if this was not process correctly but rather an issue with not being a controlled event. Mr. Aptowitz, to be fair to Mr. Webber, noted this should have been discussed in December. Board Of Selection's Meeting April 17, 2013 Page 6 of 10 The discussion went on to focus on the camping concern. Mr. Aptowitz explained to Mr. Webber that now that the Town knows about the camping and that both Mr. Riecio, Building and Zoning and Shaun Burke, Town Planner, has informed the Board that camping is not allowed, they cannot permit a license that allows the event to have camping. Chairman Kozlowski explained that the Board cannot waive the zoning requirements, therefore, the Board can only grant a permit based on no camping. Mr. Ross stated the possibility that the Town states no camping and if there is camping Mr. Riccio issues a citation. Mr. Ross stated it isn't the best solution but said there isn't a violation until there is a violation. Chief Sellon would like assurance that there will be an overnight detail. The Chairman asked how the company is structured and Mr. Webber responded that the S.S.A.A.C. is a for - profit organization but the S.S.A.A.C. (which runs the event) set up a foundation where the money is then given to the for -profit and various scholarships. Chairman Kozlowski reported he had just looked up both entities on the Secretary of State's website, and both appear to be non - profits. Motion: To approve a one day Entertainment License for Saturday, May 111" and a Sunday Entertainment License for May 12t11 for the S.S.A.A.C. PASSES 5:0 • Letter from Colin Cauldwell informing the Board of his resignation from the Mansfield Conservation Commission The Chairman noted that Mr. Cauldwell has been on the Board for a long time. Mr. Ross asked if the Board would like a Proclamation to which they responded yes. • Email from Mansfield resident, Pete Schuder, concerning speed of Route 106 near Easton border Addressed in Town Manager's Report • Email from Robert Rohauer, CSX Transportation, regarding track work Addressed in Town Manager's Report Mr. Ross received an email and telephone call from CSX Railroad informing that they are rebuilding a portion of the spur that goes into the industrial park along Oakland Street. The spur is in bad condition and Amtrak is requiring the spur be fixed and have the work completed at night so as not to disrupt train and high speed service. Hours of the repairs will be 11:00pm through 6:00am and beginning April 18t1'. The repairs will not be crossing Oakland but there will be lights and machinery by a private contractor. The information has been placed on the Town Website and Facebook. Mr. Moran asked how long to complete the work and Mr. Ross believed a few weeks. Mr. Annino inquired as to how close the nearest residents are to the work to which Mr. Ross said there are residents to the west of the tracks. Mr. Ross stated that unfortunately there is nothing the Town can really do since Amtrak owns the area and sets the schedule. The work/noise is on State and Federal land and there is no work being done on Town streets so there is nothing the Town can do. Mr. Ross had a visit from a resident who lives along Route 106 who is concerned about the speed limit being too high (Flint Farm out to Easton). Mr. Ross noted that the State has to approve speed limit changes and unfortunately if there is a traffic study done where the average speed is higher the State could actually increase the speed limit. Ivlr. Moran noted that years back the State wanted to install roundabouts in order to decrease speed, which was not well received. Mr. Ross reported that he is indeed researching who the oldest resident in Town is to receive the Cane. Mr. Ross stated that there will be a meeting May 1st at the Holiday Inn at 8:00am with the businesses in the Cabot Park to hear a presentation concerning zoning changes up at Town Meeting. There has been interest to have this meeting prior to Town Meeting, Mr. Ross emailed the proposed Comcast License Agreement and Public Safety Plan to the Board and would appreciate feedback. The major difference to the license is instead of listing the various staffing levels the Fire and Police Chiefs have worked together to create a Public Safety Plan that Board Of Selectmen's Meeting April 17, 2013 Page 8 of 10 integrates and coordinates their operations including communications, EMS, police and fire. A copy is attached as an Appendix. Hopefully that will be an agenda item for next week. Mr. Dentino asked to schedule a Light Commissioner's meeting. After discussion, it was decided to schedule for the beginning of May. Mr. Dentino asked previously to schedule an Executive Session on a few lawsuits. Mr. Ross spoke to both attorneys who will make themselves available whenever the Board decides. It was decided to try for the week after Town Meeting. Mr. Moran would like a schedule created for all licenses and permits. Ms. Whalen will work on that so there is more organization and information for the Board. Mr. Aptowitz wished his wife a Happy 2Ot1i Wedding Anniversary. Mr. Aptowitz noted the meeting he and Mr. Ross had with the Clenmeys regarding parking /Allen Street and their concerns. Mr. Ross stated there will be a memo and information at next week's meeting. Mr. Aptowitz reported that there was a Comcast Center License meeting with the Fire and Police Chiefs, Mr. Ross, Mr. Aptowitz, Chairman Kozlowski and Bruce Montgomery and Comcast personnel. It was a lengthy meeting and the Town was well prepared. Mr. Aptowitz asked the Chairman the status of the Town Manager's evaluation. The Chairman noted that it will be within the next few weeks. All five evaluations will be public record. Mr. Ross stated the evaluation can happen the week of May lst and the monetary portion can be scheduled later so that a full Board can be present. Chairman Kozlowski noted the Executive Session and then the public session for the Comcast Center License renewal and a draft license has been sent to all Board members. The Chairman thanked Mr. Ross for being able to have the second Press Release regarding the Budget Status submitted. Mr. Dentino asked if there is any way to condense the Board's packets when alcohol licenses are scheduled. He would love to work with Mr. Ross and Ms. Whalen on streamlining the process.
