Olivier Kozlowski and William Ross: Town Mana¢er to order. Chairman Aptowitz reminded that this meeting is being broadcast live by Mansfield Cable Access and taped for future broadcast. I ! Boards and Committees: Consideration of Application of Bryan'Young for,the Municipal Building Committee Present before the Board is Bryan Young, 1785 West Street in Mansfield who is an architectural designer working currently in Boston. Mr. Young is driven by always trying to improve, whether through obtaining his Master's Degree, completing his architectural registration or fine tuning his hobby of photography. He stated he would like to give back to the community. Mr. Annino knows Mr. Young very well and spoke to the commitment of his family to the Town. Mr. Annino was excited to have an additional architect to the group and liked the thought of having younger adults participating on Boards and Committees. Mr. Dentino thanked Mr. Young for coming out and appreciated the youth in Mansfield coming forward and volunteering their time. Mr. Dentino found Mr. Young's resume impeccable and asked that Mr. Young be sure to attend Town Meeting. Mr. Moran stated that through the years the Municipal Building Committee has a well - earned reputation for delivering very good quality products at a very reasonable price especially given the constraints and rules they need to abide by. Mr. Moran liked that Mr. Young is creative at thinking outside the box as it will be needed. He stated that this Committee has served the Town well. Mr. Kozlowski echoed the Board's thoughts and appreciated Mr. Young stepping forward. He felt Mr. Young would serve the committee well. Chairman Aptowitz appreciated Mr. Young stepping up to serve and felt Mr. Young was a qualified young man. Motion: To approve Bryan Young to the Municipal Building Committee for the unexpired five year term, expiring on January 1, 2017 (Annino /Kozlowski) PASSES 5:0 Mr. Ross informed Mr. Young that he would receive information regarding the term as well as Ethics information from the Town Clerk. Lee Azinheira, Director of the DPW is present along with Jeff Alberti and David Steeves from Weston and Sampson. Mr. Alberti presented a slide presentation to the Board. The presentation encompassed the project history, DPW responsibilities, why the Town needed a new facility, programming and the proposed plan and benefits of the new facility. Board Of Selectmen's Meeting December 4, 2013 Page r of 14 In terms of history Mr. Alberti noted the original facility was constructed in 1957 with +/- 10,700 square feet. The Town identified a need for a new facility in 2001 and in 2011 the Town issued a Request for Qualifications for the preliminary design of a new public works facility. A Feasibility Study and Conceptual Design for a New Public Works Facility was completed in 2012. Mr. Albertini noted that the proposed facility will house the Departments of Public Works, Highway Division, Public Buildings and Special Projects Division. Mr. Albertini then reviewed the responsibilities and the operations of DPW which included maintenance of Town roadways, street sweeping, snow plowing and de- icing, sewer service repairs drainage system maintenance, repair and replacement, maintenance of Town vehicles and more. He explained that in terms of needing a new facility some reasons include that since its conception in 1957 the responsibilities of the DPW have increased significantly along with the number of vehicles and pieces of equipment and that the facility has not kept pace with that. He noted that the size of equipment has also changed. Mr. Albertini noted that the maintenance bays are undersized to safely maintain DPW equipment and that storage facilities are undersized and require storage offsite. In terms of storing equipment outside it contributes to a decrease in the life expectancy of the equipment. Having equipment indoors allows for employee safety, public safety, protection of the equipment, efficient and cost effective operations, stormwater pollution control and noise and air. In terms of programming Mr. Albertini explained that the process included interviewing the DPW staff, comparing interview data to industry standards and the preparation of programming sketches for each operating area. A space analysis was also reviewed where Weston & Sampson felt initial space needs was 41,541 square feet. Mr. Azinheira stepped in and explained that the proposed site for the facility, located on Fruit Street, has been in municipal use since the 1940s, which included composting, location of the salt shed and storage of materials. He explained that traffic studies have been conducted and found that there are approximately 2,800 to 2,900 vehicle trips a day on Fruit Street. Weston & Sampson's report found that in proposing this site for a new facility would add approximately 80 additional vehicle trips with the morning peak before 7:00am and the afternoon peak around 3:00pm, which is a minimal impact to the area. In regards to the site Weston &Sampson identified building block plans and identified 15 alternatives for the site to maximize the space. In terms of cost, the total projected cost would be $13,600,000 with a breakdown as follows: Building for $6,445,000, Industrial Support Equipment for $$610,000, Site Development Costs for $1,000,000, Salt Storage Structure for $273,000, Design Contingencies for $420,000, Escalation for $2,542,000 and Soft Costs & Construction Contingencies for $2,310,000. Chairman Aptowitz stated that a new DPW facility has been talked about for years but that this is the first time a presentation has been made to the Board. Mr. Azinheira stated that this presentation is to get everyone up to speed on the plan and is looking for support at the next Town Meeting to keep the project moving. Mr. Moran noted that this would be a major investment the Town would be making and asked what the life expectancy for a building with 38,000 square feet would be considering the community and what the growth would be. Mark Cook, the Highway Operations Manager, stated that one of the Board Of selectmen's Meeting December 4, 2013 Page 2 of 14 benefits to this site is that there is an additional 17,000 square feet of buildings currently existing for cold storage and felt this proposal was fine for the future. Mr. Kozlowski stated the height of the ceilings in the facility looked substantially taller than the vehicles and what was the reasoning for that to which Mr. Albertini noted that there are step roofs where office /employee areas will have lower roofs, a mid -level step is needed for the shop area to allow for mezzanine space and overhead doors and then finally a maintenance area typically is driven by a lift area of six feet. Mr. Albertini explained that radiant heating is used where objects are heated and not the air. Mr. Kozlowski inquired as to the life expectancy of the building to which Mr. Azinheira stated 50 years. Mr. Annino inquired about the architecture. Mr. Albertini explained that Dave Sleeves worked with Weston & Sampson to create 3D models to help understand the massing of the facility. Ultimately, as the process continues there will be a 3D model developed on the computer. Mr. Annino noted the importance of creating a structure that the Town can be proud of and not building a pre -fab metal building. Mr. Annino asked about sustainability to which Mr. Albertini explained they consider sustainability to be good engineering practice and have identified rain water harvesting, natural day lighting, and to super insulate the building itself as just a few elements. Mr. Annino inquired as to the current square footage of the existing facility to which Mr. Albertini noted roughly 10,000 sq ft footprint. In terms of project delivery, Mr. Annino asked if the Town has considered Design Build. Mr. Azinheira stated that they have and that the Town cannot based on advice of Town Counsel. Mr. Annino will push to move in that direction. Mr. Azinheira stated that special legislation is needed for Design Build. Mr. Ross further explained that the Town as well as the representatives of the Municipal Building Committee have explored Design Build and found that it is not recommended and that the State doesn't approve it so it would take Town Meeting action to allow for special legislation in order to do it. Mr. Annino will look further into this as he is aware that the Town of Hingham utilized Design Build. Mr. Dentino asked for further clarification as to the 50 year life expectancy to which Mr. Albertini stated that the building would require updates to the mechanical systems and roof over time but that it would not need replacement before that time. Mr. Dentino asked if any thought had been placed into the structural design to enable the ability to expand both horizontally and vertically to which Mr. Albertini noted that horizontally Weston & Sampson design all of the end walls as rigid frames so that they have the ability to be easily expanded but vertically it is more difficult. He did state if asked to task that they could accommodate that request. Mr. Dentino stated he would like to see some type of drying capability added to the car wash area. Chairman Aptowitz stated that the public needs to understand that something needs to be done due to the workers working in terrible conditions and in an uninsulated building. Mr. Moran furthered the point by stating it is a building that has lived beyond its useful life and if the Town doesn't do something it is a building that will require considerable investment to bring it back to standards which in his opinion is pouring good money after bad to rehab. Mr. Kozlowski asked if the Board could speak about funding and the process going forward. Mr. Ross explained that the major portion of the bonds that were issued a number of years ago when the last school facilities were built come off in another year and a half and what the Town is looking for is timing this for a Town Meeting vote to authorize a debt exclusion as early as this Spring. He went on to explain from there the Town would look to structure a bond issue so that the Board Of Selectmen's Meeting December 4, 2013 Page 3 of 14 debt exclusion levy would be virtually the same as it is now, therefore, there would be no increase in taxes to finance the building. Mr. Ross has been in discussions with the Finance Committee. Mr. Ross felt that this presentation was important to bring the Board and the community up to date with this process. He emphasized that he felt a good job has been done and appreciated the Municipal Building Committee's participation and expertise. He echoed Chairman Aptowitz's statement that there is a human factor to consider here and that they are doing yeoman's work in a difficult environment. He noted that it is important to protect the investment in the equipment and that during the public meeting the residents felt they got their monies worth in the current facility. The presentation will be made available to the public on the Town's website. Chairman Aptowitz noted that Maureen Doherty has been on the Municipal Building Committee for over 20 years and is stepping down. She has been dedicated and led the Town through numerous projects. 4. Discussion of Train Station . area Access Evaluation with - BETA Group, the; Mansfield Planning Board and Area Businesses and Residents Present from the BETA Group is Ken Petraglia - Project Manager, Don Leighton — Landscape Architect/Urban Design, Bill McGrath- Senior Civil Engineer, and Mike Wesleski- Senior Traffic Engineer. Mr. Petraglia noted the most important topic to discuss, as it sets the tone for the whole area, are the potential development schemes and would also touch on Chauncy Street and access schemes. Mr. Leighton explained that BETA has been tasked to look forward into the future thirty to forty years in regards to traffic solutions taking into account the growth of the TOD (transit oriented development). He noted that parking is a priority and the access to and from that parking is generally what is driving the considerations for the traffic configurations. He stated the demand for housing, especially near a transportation link is a driving factor as well as retail that can service that housing. Mr. Leighton then presented a slide presentation to the Board. BETA's first approach was to pay attention to the property lines and look at the type of development that could possibly be here with the idea that the property lines would remain the same. His first point was in regards to parking structures and using a combination of structures with surface parking areas. He used a template of a three to four story parking structure that could hold between 500 -675 cars with cleaning up the surface lots. This scenario would utilize an up and over system for access ways. He presented that the parking structures could also encompass retail units (liner buildings) on the ground floor lining street and walkway access areas. Finally, a transition between parking structures and residential units, where there could be two or three stories with an average of 1,300 sq ft per unit. These structures would be located closest to the existing neighborhood. He noted that all of this is an exercise to drive numbers for parking (dividing between commuter and residential parking spaces). Mr. Leighton presented a slight variation with even more housing density and using a model similar to the housing across from the Providence Place Mall (903 Apartments), a tiered building. Mr. Leighton noted that in all of the schemes BETA is trying to keep as much green space and stated they would not cover more than 65% of the ground surface mainly due to storm water. Board Of Selectmen's Meeting December 4, 2013 Page 4 of 14 BETA's next approach was in reference to blurring, meaning bluffing the existing property lines. For the presentation Mr. Leighton assumed there was an agreement in place where the Town had decided to relinquish its property and that the MBTA sees the larger picture and the ability to bring even more cars in a more efficient fashion and closer to the track. This would then grow the parking facility leading to housing and retail growth. Finally, the last approach added a thru road connection. This roadway would give access to parking structures as well as to housing and is the exact same footprint as the 903 Apartments mentioned earlier. Mr. Leighton then reviewed 3D models of the area and approaches previously discussed. Regarding the conceptual road way layout and preliminary traffic analysis, Mr. Wesleski discussed vehicle queuing and referenced Route 106 and the intersection of Chauncy Street. Mr. Petraglia interjected and explained that this is an exercise to determine whether or not Route 106 should be widened from two to four lanes. Mr. Wesleski then explained the results were generated from both computer analysis as well as field observation. The results showed queuing which brought vehicles back through Highland Avenue during the PM peak. He stated that during the afternoon commute there is a long queue at Chauncy Street from North Main Street. He also noted that there is a queue approaching Copeland Drive through to Route 140. These same patterns were studied during the morning commute and essentially it is BETA's belief that four lanes (instead of the existing two) are required from North Main/Highland Avenue to Route 140. Mr. McGrath then reviewed a map of Copeland Drive /Central Street area where they are proposing creating a left turn pocket at Copeland Drive which would allow a designated lane to turn left. BETA felt that this would be a simple, short -term solution for easing traffic in that area. Mr. Wesleski spoke regarding traffic analysis reports and that they are measured in terms of level of service which is based on the average seconds of delay a vehicle experiences over the course of a peak hour. This is a report card system with A being the highest and F as failing. Mr. McGrath then spoke regarding an option of crossing along the tracks (used for the Patriots Game Day train) which would involve a fairly long access road to get from Main and King Streets to station parking and would utilize a historic grade crossing across the tracks. The challenge here would be getting across the tracks at grade and would require a reconfiguration intersection at King Street and due to its narrowness would need to be widened. Mr. McGrath presented another option going out the north side of the station and across the tracks and would connect with North Main Street and Angel Street. This would require a shorter access roadway to get into the station and North Main Street, being a wider roadway would be a more suitable solution. The challenge once again is crossing the tracks at grade. Summarizing was Mr. Petraglia, who noted there were numerous options presented this evening and some not shown, due to timing, but were presented to the Planning Board at a previous meeting. Mr. McGrath stated they involved scenarios which included intersection at Highland Avenue /Chaucy Street/Allen Street, an Allen Street extension using Draper Avenue, creating a new extension parallel to Draper Avenue isolating commuter traffic from the neighborhoods. Mr. Kozlowski commented that he is intrigued at the southerly option at North Main Street and Angel Street. Mr. Ross stated the problem with that option is crossing the yard tracks and noted Board Of Selectmen's Meeting December 4, 2013 Page 5 of 14 there is a business in that area that receives cars on those tracks. Mr. Ross felt that there would be an issue with CSX as well. Mr. Petraglia noted that BETA was asked to look at that option to see operationally how they would work. Mr. Kozlowski presumes that the development diagrams were "what if' scenarios and that no one was bound to do anything approaching that but rather to determine the maximum that could go in there to which Mr. Leighton agreed. Mr. Moran noted that the Town has grown and the reality is that the infrastructure that currently exists will not support the demands on the area. Mr. Moran felt something needs to be done and that this is an early step in that process to see where the Town can go. Mr. Dentino agreed with Mr. Moran in that this is a preliminary investigation and that there would be many further discussions. He was concerned about the placement of the roundabouts and was taken aback by the amount of residences that was being proposed and that residency and housing seemed to be a second priority. Mr. Dentino noted that any parking garage crossing over the tracks couldn't be any less than four stories in order to clear the catenaries. Mr. Dentino is willing to see more and noted that BETA has come a long way since their first presentation. Mr. Annino asked if BETA Group remembered his comments from its previous meeting with the Board in terms of keeping with the character and integrity of the community and stated that multi story parking garages on Route 106 leading into Mansfield is not it. He explained that it isn't all about numbers and traffic but about the quality of life, the image and history. He felt that BETA really needed to look at things ascetically. Chairman Aptowitz noted the amount of potential residential housing complexes but noted there was a definite lack of business potential and he is concerned about that and with the impact on the schools. The Chairman did note there was much progress made from the last time BETA met with the Board. Representative Barrows, who was present, agreed with Mr. Annino that 2300 cars parking in Mansfield is rather overwhelming and questioned if Foxboro or Sharon would do that. He stated that one of the complaints he hears frequently from residents is not being able to find parking, which is a result of out of town commuters taking those spaces. Representative Barrows felt that the number one priority was to the residents of the Town and how to accommodate them. He also stated that he would work with the Town to negotiate a solution in respect to CSX and the tracks and how to create an outlet there. Chairman Aptowitz agreed with Representative Barrows in that the number one thing is helping the Town's residents and that it is not the Town's job to assist commuters from other Towns. Doug Anderson, 72 Highland Avenue, is concerned with traffic and felt that the presentation was rather confusing in terms of the depiction of the intersections in the Highland Avenue area. Basically it is a traffic control situation, he understands that commuters want to get home but he is trying to get home as well. Beth Ashman Collins a member of the Planning Board wanted to remind everyone that the Planning Board asked BETA to review all of the presented options to envision how they would work. Rich Golemme, owner of the building at 457 North Main Street, was glad to hear Chairman Aptowitz mention retail businesses. He recently found out that lie has lost 70% of the parking Board Of Selectmen's Meeting December 4, 2013 Page 6 of 14 Rich Golemme, owner of the building at 457 North Main Street, was glad to hear Chairman Aptowitz mention retail businesses. He recently found out that he has lost 70% of the parking spaces to train parking. He noted it is a significant loss and will affect the growth of his business. Mr. Golemme stated he was not informed of the Town's decision to change these spaces. Susan Berthelette, 549 North Main Sheet, informed the Board that commuters are parking on North Main Street in front of her residence and walking to the train. Chairman Aptowitz stated that the Town would look into that situation immediately. In terms of the Angel Street portion of the presentation she asked that the area really be looked at in terms of the narrowness of the street. Scott Feely, 49 Fruit Street, noted that in terms of business development and the strategic plan, there has been more of a focus on business development in the industrial park and retail in that area. He noted that in focusing on business, retail or other solutions in that area, which would have different traffic patterns, than adding residential, it would be worthwhile to pursue. Tom French, Chairman of the Planning Board, noted they did ask BETA to review different options (such as roundabouts) to be considered in order to show they could be eliminated. He felt it is important to work more with BETA and to have BETA work closely with Shaun Burke to look at the different options for access to the area with potential development. The whole idea was to understand the traffic in that area. Now the focus will be different options for access to the area, understand the level of service and what that means through the corridor He felt it was a great update. Chairman Aptowitz asked for an extra effort to notify the residents and businesses in the area in regards to any meetings or updates. 5. Discussion with Chipotle Mexican Grill Regarding Status,Update On Application For Change of manager of All Alcohol License "and 2014 Alcohol License Rene'w' al' " Present before the Board are Regina Dvorak. new General Manager of Chipotle as well as Michael Young, new Northeast Area Manager and employee Rebecca Erikson. Tracey Whalen explained to the Board the issue with Chipotle stems from a lack of response by Chipotle in regards to their liquor violation hearing on August 28, 2013. From that hearing it was learned that Chipotle did not have a manager of record for their alcohol license and that employees at the establishment were not TIPS trained. Through numerous follow -ups with Michael McGinley, Regional Manager, store employees and Devin Lambert, Licensing Coordinator there has still been no movement to resolve the issue. Ms. Whalen did state that all alcohol was removed from the shelves and has not been sold since the August 28`11 hearing, which begs the question does Chipotle actually need an alcohol license. Mr. Young noted that the store did not have the appropriate management in place but feels they now do. He stated that they have brought with them the Change of Manager application as well as certification of those employees that have completed TIPS training. Ms. Whalen's concern is the disconnect not only at store level but between the store and the corporate office. Ms. Dvorak agreed with the statement but felt that with her in charge — it would change. Mr. Ross noted that there needs to be an understanding that holding a liquor license is a privilege and that a corporation as large as Chipotle should act in a professional fashion and the Town has not found that. Mr. Ross stated it makes the Town wonder if Chipotle should really have the license. Board Of Selectmen's Meeting December 4, 2013 Page 7 of 14 is paying attention to detail and not the company. He noted that alcohol is a serious business and that it is his impression that Chipotle does not feel the same. Mr. Annino felt that if this is the attitude at the corporate level he has serious reservations about renewing the license. Chairman Aptowitz explained that the Board is extremely pro business but stated there are rules and regulations that must be maintained in order to operate. There needs to be a system notifying local Boards of changes. .Mr. Kozlowski stated that Chipotle needs to leave the meeting tonight knowing where they are in the process where they have the Change of Manager application, which needs to be handed in, reviewed and scheduled before the Board. Secondly, Chipotle also needs to complete the renewal process. Ms. Whalen explained that the renewal application has been received but is incomplete in regards to TIPS certification and their inspection. She stated that corporate scheduled the annual inspection but failed to inform the employees, therefore when Nick Riccio, Building Inspector, came to the appointment the establishment was not prepared and at this point has still not rescheduled. Mr. Moran noted that Chipotle's all alcohol license is a privilege and stated that there are other establishments that are looking for a license in the Town. He explained that if Chipotle does not have all their paperwork completed on -time that the license will then revert to a new license and open to other establishments to submit applications. Mr. Moran noted he would look favorably on these other establishments given what he has heard this evening as the license is an asset to the Town and Chipotle has been operating without it for some time. Mr. Kozlowski asked if Ms. Whalen had time to both renew the license and schedule the Change of Manager hearing. Mr. Ross stated the critical points here are getting the application to have a resident manager, TIPS training and the annual inspection completed all at the busiest time for the Town. Mr. Annino stated that an application should not be accepted and stamped in if it is not complete. Mr. Ross explained that there is a difference between receiving, stamping and reviewing and THEN scheduling applications before the Board for action. Mr. Dentino noted that the Board cannot let Chipotle move forward at this time as they still have yet to fix their original problems of concern. Mr. Dentin asked if Chipotle has satisfied the penalties from the August 28t" hearing to which Ms. Whalen reported no. Mr. Dentino has not seen anything this bad professionally since the Keystone Cops and this is a problem. Mr. Dentino stated the Board should let Chipotle move forward to fix the situation but should not guarantee a license. Mr. Young stated this is embarrassing for him as well as for the Chipotle Corporation. Mr. Kozlowski wondered if the Town has some type of compliance check regarding managers of record. Ms. Whalen explained that she "cold calls" the licensees to ensure accuracy. He would like to see more structure in place. Board Of Selectmen's Meeting December 4, 2013 Page 8 of 14 At that point Chipotle turned in the Change of Manager application for review to Ms. Whalen and was informed by the Board to follow up with Nick Riccio immediately to satisfy their renewal None 7. He noted a lot of equipment has been moved off the property as well as off of the Town's insurance. Mr. Ross noted that the resident commuter parking spaces have been numbered on Old Colony and Oakland Street. Mr. Ross reported that the audit is about 80% complete and that field work should be completed this week. A promotional piece was distributed by Mr. Ross to the Board for Cabot Park. Instead of printing names onto the cover, a slot for business cards was created on the inside pocket. Board Of Selectmen's Meeting December 4, 2013 Page 13 of 14 Mr. Ross attended, at the request of Mass Economic Development, a training session and a seminar, to speak on the process of zoning changes in the Cabot Park and were especially interested in the Town's strategic planning process and how it is being implemented. Mr. Ross informed the Board that the lights at Memorial Park have been repaired but that he is concerned with the entire parking lot. Mr. Kozlowski attended the meeting regarding the Open Space Plan and noted that Caitlyn Merrill is spearheading the project and is doing a great job. It is still ongoing and the point is for residents to convey as to what they would like to see with the open space in Town. Any suggestions should be submitted to Caitlyn in the Conservation office. Mr. Kozlowski was up at Beacon Hill testifying before the Joint Committee on Election Laws in favor of legislation that was filed on his behalf by Representative Barrows. Mr. Annino asked if Mr. Riccio had re- inspected TGI Fridays to which Mr. Ross noted he would follow up. Mr. Annino also reported that the light at the intersection of Williams and Tremont is smashed out. Mr. Dentino noted that the Mural Committee is selling mugs to raise funds for the Mural for $10.00.
