Marilyn Edge of Western Bristol County & Foxboro Tobacco & Alcohol Prevention is
present to update the Board of Selectmen on what the program is doing in Mansfield.
Ms. Edge provided the board with a brief overview of the tobacco control program and how
the store checks and compliance checks are done. The program has recently expanded to
included an alcohol check component. This check is done with the police dept.
New tobacco products are hitting the market that is enticing to teenagers and adults
alike. School and health group presentations have been being made around the area to
alert health and school professionals of these products.
Chairman Kozlowski asked Ms. Edge if she would come back and give the presentation to
the board.
He has further questions regarding her capacity as a health agent for the town and the
new smoking regulations the Board of Health recently promulgated regarding smoking in
public places.
The clerk read the hearing into public record.
Motion: Open public hearing. (Moran/ Aptowitz) 4:0 passes
Motion: Suspend public hearing for 5 minutes. (Aptowitz/Moran) 4:0 passes
Motion: To reopen public hearing. (Aptowitz/Moran) 4:0 passes
Attorney Daniel Clark is present at the hearing and is representing Rum Runner.
Chairman Kozlowski asked if they need to determine the need for the license or just the
location. Mr. Ross and Atty. Clark agreed the hearing is just to approve/deny the location.
Board of Selectmen Minutes of July 25, 2012
Mr. DeTrolio is applying for change of location in respect to their liquor license. They
recently closed the store at the Stop & Shop location and would like to reopen at the old
Elm St. store.
Selectman Dentino asked if there was a store there after them and Mr. DeTrolio replied
yes.
Selectman Moran asked if the new location will be a package store or a convenience store
as well. Mr. DeTrolio stated that as there is nothing in the area they do plan on having a
convenience store component to serve the area neighborhoods.
Selectman Aptowitz asked Mr. DeTrolio how long the construction will last. Unfortunately
Mr. DeTrolio did not know the time frame yet.
Mike Ray, 430 Elm St. He opposes relocation of the license as he and another neighbor
had issues with the owner when the store was previously occupied. He is concerned with
the traffic that the store will generate and the hours that it will be open.
Chairman Kozlowski disclosed that he served on the ZBA when it issued the decision giving
rise to the appeal Mr. Ray was talking about. Chairman Kozlowski stated - and Mr. Ray
confirmed - that the ZBA approved the tearing down of the building and the construction
of a new building with a larger footprint. Chairman Kozlowski pointed out that the current
proposed license transfer would utilize the existing building and footprint.
Motion: To close hearing. (Aptowitz/Moran) 4:0 passes
Motion: To approve transfer. (Aptowitz/Moran) 4:0 passes
Selectman Moran stated that while the store has been vacant for many years the
De Trolios run a clean business and he feels that it would serve the public need for a
convenience store in that area. Selectmen Dentino and Aptowitz concur.
Comcast Center overage fine discussion
The June 17th Drake concert went over by 15 minutes. The certified number of attendees
was 13,779 and the fine for 15 minutes is up to .50 per attendee. The fine schedule says
less than 5 minutes is up to .05 per attendee, less than 15 minutes is up to .25 per
attendee and up to .50 per attendee for less than 30 minutes over. Thus if the amount of
.50 per attendee is applied the fine would be $6,889.50.
Motion: To fine Comcast Center $5000.00 for the Drake overage. (Aptowitz/Dentino) 3:1
passes (Moran nay)

Lincoln Place is a new subdivision that comprises ten lots. The subdivision is at the
intersection of Branch St. with the hiking and biking trail. The issue at hand is the final
location of the entrance road, known as Lincoln Rd.
Mr. Ross and Mr. Burke have done some research on old "stub" streets in town. Branch
St. has been a public way since it's layout. As such the developer has the right to use
those stubs or elbows in the street.
Chairman Kozlowski would like to see the developer in to discuss traffic mitigation
crossing the bike path. Selectman Aptowitz knows the developer has the right to use
the street but is very concerned about public safety at the proposed intersection.
Mr. Maloon came to the meeting and gave the Board of Selectmen a revised plan. The
board members then discussed several ways to alert both pedestrians and motorists
alike of the intersection between the street and the bike path.
Chairman Kozlowski stated that before the next meeting they could meet at 6pm to
review the actual site.

this option for some areas of town.
