It will be rebroadcast later this week. Street acceptanCe. hearing Clerk Annino read the public hearing notice into record. This purpose of this hearing is to accept public comment on the acceptance of DiMascio Drive and Shea Circle as public ways. Motion: To open public hearing. (Moran/Kozlowski) 5:0 passes Developer Perry DiMascio is present for hearing and described the few items on the punch list that still needs addressing. 7 Shay Circle resident asked about the street trees that line the street. She is unsure if the trees are still alive and healthy. The town is holding bond money for this purpose. The turtle bridge area has one side that has grass and one side that no longer does. Mr. DiMascio stated that side is in constant sun so it will be hard to keep the grass green there. The roses that were planted along the bridge are also not right. Mr. DiMascio is aware of the issue and will be monitored. 6 DiMascio Drive resident has the house right at the front of the development. The rock wall in front of their house is not correctly installed. The middle is smooth but the ends are all rough and rocky. Mr. DiMascio stated that Essex St. is a scenic road and as such the stone wall is of a rustic nature. Selectman Annino stated that the wall as pictured is not what he remembered the Planning Board requiring. 11 Shay Circle resident has a concern about water flooding his basement and yard. Board of Selectmen Minutes of April 11, 2012 9 DiMascio Drive resident also believes that the front stone wall is not done well. He also has an issue with the size of some of the trees in the common areas. Shaun Burke, Town Planner, has joined the meeting to help clarify some of the issues the residents have brought up. Selectman Annino asked Mr. Burke why the wall wasn't finished as he thought it would be. Mr. Burke stated that the back of the wall wasn't required to be finished and flat like the front. The plan called for a dry stacked rustic wall like the ones along the rest of the street. Mr. Burke stated that they are aware that some of the trees may be undersized and are holding funds in a bond still. Selectman Dentino asked more questions about how the Planning Board evaluates these issues. To him the wall looked like a rustic wall with finished flair in the middle. However Selectman Annino disagreed. There are still many items left on the punch lists that need to be completed prior to acceptance at town meeting. Some are structural such as curbing and water boxes and others are not (trees and grass). Mr. Burke and Selectman Annino will go out and look at sub division next week. Motion: To accept DiMascio Drive and Shay Circle as public ways pending the tree and wall work that needs to be done. (Moran/Kozlowski) 5:0 passes Mansfield Education Foundation Marybeth Cragan, Nancy Breef-Pilz, Erika Reynolds and Linda Fernando are the members of this organization. Mansfield Education Foundation (MEF) is an independent 501c3 charity dedicated to financially supporting Mansfield schools. They provide private funding via a grant process to the teachers in Mansfield. They are the only non-profit foundation in Mansfield with this mission and your donations are tax deductible as they are a registered charity. They have recently partnered with the Comcast Center to sponsor a Teacher Recognition program where Comcast will match dollar for dollar through June 30th Last year $10,000 was awarded to seven Mansfield educators in September 2011. Board of Selectmen Minutes of April 11, 2012 2 Each board member thanked the ladies for coming in and working so work for the community. QdobaMexican Grill Mauriode De Gortari, Regional Manager for Qdoba and proposed Manager of Record Jay Reid are present for meeting. Mr. Reid had withdrawn his application due to health concerns but is better now and would like to stay the Manager of Record at Qdoba. Motion: To resubmit application to ABCC naming Mr. Reid manager of record. (Moran/Kozlowski) 5:0 passes Conservation Commission discussion Conservation Commission members Colin Cauldwell, Paul Boyden and volunteer Attorney Whittaker, Board of MA Assoc. of Conservation Commissioners are present for meeting. They are concerned with the fact that there is a citizen's petition on the warrant to repeal the town's wetlands bylaws. Attorney Whittaker provided a brief overview of how and why wetlands bylaws are challenged. He has reviewed Mansfield's bylaws and found them to be quite reasonable. Selectman Annino asked if Mansfield did not have its own bylaws, it would revert to the state regulations? Attorney Whittaker stated that is correct. MA regulations are at a minimum protection level. The Mansfield Conservation Commission has made the regulations stronger yet still flexible in order to protect the town's water sources. Traffic control agreement Ag reement covers the Eastman Street project from the traffic signal in front of Flint Farms east to the Easton town line. The project is being funded entirely with Federal funds. The Traffic Control Agreement establishes the signage that will be required as part of the project. The Town is required to institute the appropriate traffic controls and maintain those controls. Board of Selectmen Minutes of April!!. 20!2 3 The Department of Transportation can approve changes to the traffic controls in the future but only upon written application by the Town. The Agreement also controls any additional curb cuts or widening of any of the existing curb cuts. Once again, the approval of the Massachusetts Department of Transportation in writing is required before any additional curb cuts or modification of existing curb cuts is undertaken. These are standard agreements that go with the Federal participation in the project. The requirements are actually Federal in nature but are enforced by the Massachusetts Department of Transportation. Mr. Ross has had public safety review the process as well and do not have issue with it. As such, the project is out for bid and should be ready for summer construction. In response to a question from Selectman Kozlowski, Mr. Ross confirmed that because federal funds were being used, abutting landowners would now have to obtain permission from the state as well as the town for any new curb cuts or changes to existing curb cuts. Mr. Ross also confirmed that despite the addition of turn-only lanes, no reduction to the speed limit was anticipated. Mr. Ross stated the town developed the plans to minimiZe traffic disruption. The additional turn lanes should eliminate the traffic from bogging down in that area. Motion: To approve and sign. (Moran/Kozlowski) 5:0 passes Q&C Sandra Levine, Walnut St. She is upset with the newly formatted town warrant. It does not have warrant figures on it and it tells the residents nothing. If a resident wants to be educated for town meeting they need figures. The citizen articles were also changed and lead the residents to believe that articles have more sponsors than they really do. (the article now reads Joe Smith and 16 others when Joe Smith in the sponsor.) Mr. Ross explained how the motions will have all the financial information needed. This was done in order to eliminate confusion at town meeting with all the different versions and colored paper. Mrs. Levine thought the blank warrant posting was a waste of time, money and paper. However, Selectman Moran and Mr. Ross explained how the law dictated that the warrant be printed and distributed, even without numbers.
