4. Old Business
A. Town Manager
Town Manager D'Agostino reported the following:
Assistant DPW Director, Robert Morrison, indicated that the water ban could be lifted
by mid September.
Attorney Vernon provided the Town Manager's office with a draft inter - municipal
agreement between Mansfield and Attleboro allowing the Smithfield Estates subdivision to
obtain its water from the City of Attleboro. Town Counsel will review the draft, and if it
is proper, it will be brought to Town Meeting for a vote. The Selectmen will be given a
copy of the agreement.
• Attorney Dalton informed the Town Manager this date that the jury awarded Mr.
Morse $289,500 for his small piece of property. Attorney Dalton believes the judge
erred in his instruction to the jury when he instructed them to look at that small parcel
as it can produce water and that they should make their judgement accordingly. In the
final analysis, the reason for the Town's purchase was solely to comply with the
Wellhead Protection Act. Attorney Dalton recommended the Selectmen appeal the
jury's decision.
Motion: To file the appeal.
(McCarter - Mahana) All in favor. Passes.
• According to an updated Mansfield Emergency Management Report, as a result of the
June/July heavy rains and flooding, one hundred twenty -eight Mansfield residents
received aid under the disaster relief fund totaling $178,520.60.
The Special Town Meeting warrant will open September 16 and close September 30.
The Town Manager requested a meeting of the Finance Team, i.e. the Accountant and
Treasurer, member of the Finance Committee, and Board of Selectmen, to discuss free
cash and the amount of money received in excess of what was anticipated when the
budget was established.
