A. Attorney Mangiaratti clarified the range of possibilities on a claim Consigli
has against the town for payments due them on the Municipal building projects.
The West Mansfield fire station project has been closed out. Consigli's claim against the
Town is just under $85,000, which includes a variety of items for which payment is
requested. After denial of several change orders, the amount due in the Town's opinion
is $45,000.
In the best case, the Town would have to pay $45,000; however if the claim is litigated,
the question remains whether or not the Town would only have to pay that amount. Legal
fees would also have to be taken into consideration. Presently, the balance of the
Municipal Projects' account is $45,000.
Motion: That we ask for a Reserve Fund Transfer for $5,000 to complete this
outstanding balance for Consigli for the Fire Station, Police Station, and
Town Hall, Projects and direct Town Counsel to bring a photocopy of the
checks totaling $45,000 to Consigli, which will be held in escrow until a
Release is presented by Consigli.

B. Lastly, Attorney Mangiaratti updated the Selectmen on the following cases:
• Burke vs. Police Chief
• Viola Holman & James Vadalla vs. Town
