Executive Session
Minutes
May 20, 1998
Present: Chairman Madan, Clerk McCarter, Selectmen Robinson and Royle
John D'Agostino, Town Manager
Robert Mangiaratti, Town Counsel
A. Consigli Claim
Attorney Mangiaratti reported that Consigli is ready to settle on the Municipal projects
for $55,000.
Motion: We offer him a check immediately in the amount of $50,000, and anything
in addition to $50,000 would require a Town Meeting vote, which we
cannot guarantee will pass.

McCarter Aye; and Selectwoman Royle Aye.
B. Burke vs. Police Chief
Town Manager D'Agostino reported on the suit Burke vs. the Police Chief, concerning
non - issuance of a gun permit.
C. Larch vs. Municipal Light Commissioners
Lastly, Mr. D'Agostino presented each of the Selectmen with a certificate to be signed by
each, to be presented at the hearing for Larch vs. Mansfield Municipal Electric
Department, et al. The Certificate was forwarded the Selectmen from Brody, Hardoon,
Perkins & Kesten, appointed by the Town's insurance company to represent the
Selectmen, and confirms that the Selectmen (Light Commissioners) confer with a view to
establishing a budget for the costs of conducting the full course and various alternative
courses of the litigation; and to consider the resolution of the litigation through the use of
alternative dispute resolution programs.
Selectwoman Royle no that she should not be named as an individual on the
certificate, only as a member of the Light Commissioners, as is Selectman Robinson.

Chairman Madan took a roll call vote to adjourn.
