MINUTES 4-29-1998Board of Selectmen Executive Session Minutes April 29, 1998 Present: Chairman Madan, Clerk McCarter, and Selectmen.Iv>ahana and Robinson John D'Agostino, Town Manager Robert Mangiaratti, Town Counsel Town Counsel updated the Board of Selectmen on the following: • Consigli v. Town of Mansfield The Town is presently holding back eighty -five thousand ($85,000) dollars for Consigli Construction. According to the Municipal Building Committee, assuming the punch lists are complete, forty -five to fifty thousand dollars ($45,000 - $50,000) is due Consigli. A consensus of the Board was in favor of offering fifty thousand ($50,000) dollars to Consigli. • Town Hall Connector Roof The connector roof is clearly covered by the warranties outside of the contract. • Air Conditioner Chiller A meeting was held about six weeks ago with all parties involved. At the meeting, the consensus was to keep the chiller but make it quieter. The architect was supposed to put together a proposal at his expense and get back to the town within two weeks, but never did. When contact was made with the architect, he stated he thought the town was supposed to give him information and was waiting for it. Presently, the DPW Director is working on a barrier design to reduce the noise emanating from the chiller and disturbing the residents. Town Counsel suggested not initiating a suite against the contractor at this time but doing the work and allowing the architect to pay for the work. If the architect does not pay for the work, suite should then be initiated. • John Larch, Light Department Manager, vs. Town of Mansfield Following the hearing for preliminary injunction, which was denied, Mr. Larch's lawyer filed an amended complaint involving damages. The Town's insurer received an opinion from Palmer & Dodge that the Light Commissioners will be covered and defended by the Town's insurance. • Town vs. Foxboro /SKANKO Foxboro joined the suite as the third party defendant with," the developer and condominium association. The Town will file for discovery once the pleadings are on track and Foxboro's answers are known. • Jordan Jackson School The Jordan Jackson roof continues to erode. There is a definite problem with the roof, but the cause is unknown. Motion: To go out of executive session. ( Mahana- McCarter) Selectman Mahana Aye. Selectman Robinson Aye. Clerk McCarter Aye.
