MINUTES 8-26-1998- i Board of Selectmen Executive Session t_ Minutes I;L, 5 (n 2:.3 August 26,1998 7:30 PM Present: Chairman Madan, Selectmen Mahana, Robinson, and Royle John D'Agostino, Town Manager Police Chief Arthur O'Neill A. Ozzfest Incident The purpose of this executive session was to discuss a criminal investigation involving an incident at the July 9, 1998, Ozzfest'98 concert at Great Woods Center for the Performing Arts. Police Chief O'Neill reviewed the investigation report with the Board of Selectmen regarding Lynn Strait II, a performer of the band SNOT, appearing on stage naked during the concert. Discussion: Discussion among the Board of Selectmen, Police Chief, and Town Manager followed concerning whether or not the incident involved a simulated sex act, if the band had prior knowledge of the incident, that the focus should remain on the individual not the band, and scheduling a discussion with the Great Woods General Manager to see if he has taken any actions relative to this incident. When asked by Chairman Madan for his recommendation, Police Chief O'Neill suggested taking possible actions against the individuals involved and stated that he does not believe Great Woods had prior knowledge of this incident. Town Manager D'Agostino agreed that actions should be taken against the individuals involved only. A consensus of the Board was in favor of inviting Bruce Montgomery, General Manager, Great Woods, into a Selectmen's meeting to discuss his plans as a result of this incident. Police Chief O'Neill left the meeting at 8 :05 PM. B. Great Woods Detail Pay Town Manager D'Agostino stated that he met with Police Chief O'Neill this date concerning Great Woods paying the Chief directly for detail work at the Center. In 1992, the Town accepted Chapter 40, Section 22f, which allows the Town, through license agreements, to collect police administrative fees for services. This would result in the Executive Session Minutes Page -1- August 26, 1998 Police Chief receiving an increase in his base pay from the Town rather than receiving an j hourly rate from Great Woods. Mr. D'Agostino stated that this would satisfy a couple of issues: the Police Chief would be established as a salaried employee of the Town of Mansfield and a level of compensation would be established for his added duties Discussion: Chairman Madan stated that Clerk McCarter feels the Chief is already paid his salary and should not receive any additional compensation. Selectwoman Royle noted that she would like the Police Chief's presence at Great Woods; Chairman Madan stated that he does not want to go forward with the idea that Great Woods thinks the Chief will be present at every concert; and Selectman Mahana stated that he would support the issue in concept but that he would like to know all the details. Motion: To go out of executive session. ( Mahana- Royle) Selectman Mahana Aye. Selectwoman Royle Aye. Selectman Robinson Aye. Chairman Madan Aye. 4. Cletk'sSignature Date f pproval Dath qf Release
