The purpose of this executive session was to discuss the appeal of the jury's award of
$289,000 plus interest, approximately $500,000, to Mr. and Mrs. Morse for a land taking
by the Town in 1989, or a possible settlement.
Selectman Mahana suggested offering a settlement of $289,000 plus 10 %, totaling
$310,000- $320,000.
Mr. and Mrs. Morse and their attorney, Ernest DiSimone, entered the executive session.
Attorney DiSimone explained the case from his client's point of view and the possible
outcome if the Town's appeals the case.
Discussion among the Selectmen, Mr. and Mrs. Morse, and the attorneys followed
concerning the case and number of continuances affecting the interest due by the Town.
Mr. and Mrs. Morse and their attorney left the room.
A consensus of the Board of Selectmen was in favor of offering a settlement of $375,
000, which would be the principal due plus one -half of the interest due. Attorney Dalton
left the room, offered the settlement amount to Attorney DiSimone, who then refused and
requested to speak to the Board a second time. The Board refused.
The executive session adjourned to open session at 8:10 PM.
Motion: To go out of executive session and return to open session.
