Present: Chairman Madan, Clerk Royle, Selectmen Colella, Mahana, and
Robinson
Richard Boucher, Acting Town Manager
Robert Mangiaratti, Town Counsel
Town Counsel Mangiaratti summarized a pending land court case. A landowner in
Norton owns property on both sides of the old railroad bed and claims a right to
cross the bed. The property owner would like to install a roadway across the bed
to access his lot.
The landowner's attorney, Attorney Funk, filed a motion for summary judgment to
claim his client's right to cross the bed. Should the case go to court and the Town
lose, a precedent may be set for future cases involving landowners adjacent to the
hacks.
Attorney Mangiaratti suggested a meeting be held with the property owner's
attorney, Town Engineer, Sewer Manager, Recreation Director, and himself to
reach a non - binding settlement agreement.
MOTION: So moved to explore negotiating a settlement.
(Colella - Royle) All in favor. PASSES.
MOTION: To go out of executive session.
