Executive Session
Minutes
Present: Chairman Madan and Selectmen Colella, Mahana, and Robinson
Acting Town Manager John D'Agostino
A. Pending Litigation Cases
Town Manager D'Agostino stated that suit has been initiated against the Town of
Foxboro for payment of sewer charges. Mr. D'Agostino updated the Selectmen
on the following pending litigation case, as referenced in his memorandum to the
Selectmen, dated December 3, 1997:
• Town of Mansfield v. Norton
• Town of Mansfield v. Consigh Construction
• Town of Mansfield v. Strekalovsky & Hoit
Town Manager D'Agostino requested the Selectmen's approval to hire an
independent consultant, SEA Consultants, to evaluate and provide
recommendations regarding the Town Hall drainage problem, and the humidity in
the Town Clerk's vault. SEA Consultants would also evaluate the heating and air
conditioning unit to determine the appropriateness of the compressor(s) and
whether or not the type of unit is conducive of this type of building mud location.
Mr. D'Agostino also requested approval to hire a second consultant, Cavanaugh
Tocci Associates, to evaluate the acoustical recommendations implemented by the
acoustical engineer hired by Strekalovsky
Both of the experts' testimony will be needed by Town Counsel in any future
litigation plans.
Motion: So moved.
(Colella - Mahana) All in favor. Passes.

B. Union Contracts
• Police Association
Selectman Colella requested Mr. D'Agostino review the status of the Police
Association contract.

B. Union Contracts
• Police Association
Selectman Colella requested Mr. D'Agostino review the status of the Police
Association contract.
Selectman Robinson asked why the Fire Association is going to arbitration.
• DPW Employees
Town Manager D'Agostino reported that the DPW union will exempt holidays
from the stipulation that employees are paid double time after working sixteen
hours.
• Non - Supervisory
Mr. D'Agostino reported on the Non - Supervisory Union Contract stating the
contact provides 3% increases each year for the life of the contract; step increases
would be granted every second year with a successful evaluation; and the Town
Manager made the Selectmen aware of the clause in the contract relative to
Reclassification of Positions.
Motion: To sign the contract as presented.
(Mahana- Robinson) All in favor. Passes. Selectman Robinson
requested he be notified should a reclassification issue arise.
C. Adjournment
