Chairman Pasquale referred to a letter from Secretary Kerasiotes of the Ex- ecutive Office of Transportation & Construction, copy of which both Repre- sentative Hyland and Senator Keating had forwarded to the Town Manager. Chairman Pasquale read the letter which was to advise the decision "reached by the Administration with respect to the request of the Town of Mansfield for the transfer of land adjacent to Rt. 495 for conservation pur- poses". Chairman Pasquale said it has taken us twenty years and the fact that Mans- field was excluded from discussions concerning this land is unacceptable. He then read a letter he had prepared to go to Governor Weld which expressed his dismay, on behalf of the entire Board, over handling of this matter. He asked Bill Williams to set up a meeting with the Board of Selectmen, the Conservation Commission, the Natural Resources Trust of Mansfield, Inc. and Town Counsel. * MOTION: To respond to Secretary Kerasiotes' letter as proposed by Chairman Pasquale. Royle /Ronald VOTED: 5 -0 Selectman Penney said he feels it is clear that Bay Bank has had a hand in this decision, then suggested that residents who have accounts with that bank express their feelings concerning the issue to bank officials. 7. Emergency Service Personnel Recognition The following personnel were present to represent the many who participated in the July 14th Conlon & Donnelly fire.in Mansfield: Acting Police Chief Arthur O'Neill, Fire Chief Ed Sliney and Deputy Chief Dick Bellavance, Pa- trolman Stephen Saulnier, Police Lt. Figueredo, Sandy Jackson, Police Sec- retary, Detective Sgt. Robert Martin, Bob Button, Civil Defense Director. The Acting Police Chief and Fire Chief each gave a brief report; Chief Sliney stated that the Bristol County Task Force was put into operation - the regionalization system was put into action with one phone call. The Emergency Management System personnel from Norwood Hospital and HazMat per- sonnel were on the scene; it shows the quality of all the personnel. Act- ing Police Chief O'Neill spoke of the evacuation within a half mile radius; his off -duty officers were called in; School Department buses were provided. He thanked all residents of the area for their cooperation and the per- formance of his officers. He said everybody did the Town proud. Bob Button thanked the local businesses who released their employees and spoke of the good community spirit. Chief Sliney said air quality samples came back with report potential elements were inactive; this was a posi- tive for a job which KNd could have released hazardous fumes. Selectman Robinson expressed appreciation for the displayed team work, and voiced a desire for the Board to send each town involved a plaque in BOARD OF SELECTMEN MINUTES OF MEETING JULY 21, 1993 PAGE 5 recognition. Lawrence Carpenter received the majority of votes. 9. David Martin /Housing Partnership Request Chairman Pasquale opened the meeting to anyone wishing to make comments. Two West Street residents stated they were not in favor of the proposal. Chairman Pasquale summarized the proposal is to construct three townhouses for affordable housing. Selectman Robinson mentioned the petition the Board had received in opposition to the proposal, but said he feels it is not proper for the Board of Selectmen to approve it rather than the Plan- ning Board. Selectman Royle said she cannot support this proposal; she feels the area is a quiet single - family home area. Selectman Penney said he agreed that it should be a Planning Board issue, and does not feel a three - family issue is appropriate. Selectman Ronald agreed also. David Martin assured the Board that the Planning Board and Zoning Board of Appeals will have their in -put, but the first step is to go to the local Housing Partnership Board. Chairman Pasquale said he cannot support the project because of the resi- dents concerns. * MOTION: To not support Mr. Martin's application under the Local Housing Partnership. Royle /Robinson VOTED: 5 -0 BOARD OF SELECTMEN MINUTES OF MEETING JULY 21, 1993 PAGE 6 10. Public Hearing /Williams Street Bridge The Town has received a grant from the Federal and State governments to pay for the cost of a new bridge (Federal will pay 80 %, State 20 %). The bridge has been closed for a year after being declared unsafe by the State DPW. Paul Patneaude, Supervising Project Manager for the Mass. Highway Department, said he was at the hearing to listen; the State is ready to ap- point a design team and are waiting for the Selectmen's vote to replace the bridge where it is or to move it downstream so the road may be straightened out. The hearing was opened to the public; consensus of opinions showed for and against moving the bridge, or even re- opening it. Town Engineer, Bob Swanson, who was present, said if the bridge is relocated, it would be approximately 100 feet further downstream. One resident mentioned that if the road is straightened, the speed needs to be addressed. It was also suggested that the road be widened. David Sarro, a resident, asked if it isn't a Scenic Way. Selectman Royle said any proposed changes require that it go before the Planning Board. Lenny Flynn brought up the e he would like it left where dent asked for another road walk. Paul Patneaude said t strated and the request put Bested that if the bridge is footbridge with the land on xpense which needs to be considered and said it is, but modernize and widen it. One resi- and another bridge; another asked for a side - he need for a sidewalk would have to be demon - in writing to the State. Selectman Penney sug= moved the current bridge could be used as a either side as a public park area. The hearing was closed. Selectman Penney questioned controlling speed, but straightening the road would be a plus. When Chairman Pasquale asked for a show of hands for re- opening or keeping bridge closed, it was about 50/50. The Planning Board's vote was 5 -1 to rebuild it where it is now. MOTION: That we send a letter to the Mass. Highway Department to recon- struct the bridge downstream with the winding character preserved. Acquisition of the Cleveland Twist property was mentioned, congregate housing for the elderly, a YMCA in Mansfield, and a planning study. The maximum EOCD funding is $30,000. Selectman Royle said she prefers the YMCA, not Cleveland Twist property; Chairman Pasquale would like to pursue the YMCA because the Town has the "grass roots" from the Together We Can program. Penney /Robinson Selectman Royle questioned whether it would be possible for the Roses to keep the dog inside until 7:00 A.M. and back in by 9:00 - 9:30 P.M. It was decided to try that for another two weeks and report back to the Board's August 4th meeting. Selectman Penney withdrew his motion. 13. Questions & Comments a) Andrea Bond, 578 Maple Street, asked that she receive an answer to a letter she sent the Board several months ago concerning speed traps and no through trucking on Maple Street. - The Town Manager will look into it. b) Lenny Flynn commented on the letter received from Secretary Kerasiotes saying he was glad the Town received ten acres but disappointed that it did not receive the entire 88 acres it has been pushing for. He went on to say it is disappointing after both Representative Hyland and Senator Keating had also contacted Kerasiotes about the issue. He feels the main interest focuses on Bay Bank. Mansfield and Norton own a total of 550 acres which should have been considered. Lenny Flynn said the Natural Resources Trust has decided to pursue this legally; he does not think we should give.up and hopes the Board will support them. BOARD OF SELECTMEN MINUTES OF MEETING ' JULY 21, 1993 PAGE 8 Chairman Pasquale suggested a meeting first of the Selectmen, Conser- vation Commission Chairman and Dick Lewis, with the NRT and Town Counsel. c) Peter DeTrolio, 428 Elm Street, wanted to know what is being done to prevent a situation such as the Police Chief's from happening again. Chairman Pasquale told him any time there is a concern it should be brought to the Town Manager or a Selectman as Peter wanted to pursue the discussion. The Town Manager said he was astonished by this dis- cussion and the lack of protocal known by the public. He added, this should be included when policies are worked on.
