BOARD OF SELECTMEN MINUTES OF MEETING FEBRUARY 17, 1993 PAGE 3 6. Questions & Comments a) Bill Morton, 560 East Street, wanted to review his complaints and scheduled meetings and requested a meeting with the Board on March 2nd. Chairman Tartufo stated there has been numerous meetings and discus- sions, and Town Counsel has not changed his opinion over the past two years. At the Workshop on February 11th requests were made to the Fish and Game Club and the Board is awaiting answers from them at this time. Bill Morton said his complaint is against the Building Inspector which has not been answered. Chairman Tartufo said it is out of place to dis- cuss a Town official. Selectman Penney said maybe it is not within the jurisdiction to hear a complaint about the Building Inspector, and sug- gested court action. Mr. Morton said he is asking for a public hearing; is he going to get it? Chairman Tartufo said he is not interested in a hearing; he has heard enough and is satisfied with the report of Town Counsel, and the mentioned violation was taken to court. Selectman Colella said in courtesy to Bill Morton he should be put on the March 3rd agenda. MOTION: That we allow Mr. Morton to come in March 3rd. Colella/no 2nd Selectman Pasquale said he feels ample time has been given Mr. Morton. He referred to the meeting with Town Counsel and Mr. Morton wherein no evidence was found. The decision at last week's workshop was made to not proceed further with this, and to request two things from the Fish & Game Club. Selectman Penney said he felt the Board has bent over backwards for Mr. Morton, and each time he comes in with another issue. Selectman Pasquale urged Mr. Morton to write his complaint against a Town official to the Town Manager. Chairman Tartufo summed up that the court has agreed there has been no wrong doing, Town Counsel has offered his opinion, and Mr. Morton should put his further request in writing to the Town Manager. Mr. Morton is reposturing himself. MOTION: That the Town Manager write a letter from the Board of Select- men to Mr. Morton advising him that if he has a complaint of a wrong action to please put it in writing to the Town Manager. Pasquale /Penney VOTED: 5 -0 Public Hearing /Quality Inn The hearing was for a Change of Manager, from Allan W. Kronberg to James P. Wingardner. Mr. Wingardner and attorney for the Quality Inn, Maria Rota, were both present. The Selectmen asked a few questions of Mr. Wingardner. BOARD OF SELECTMEN MINUTES OF MEETING FEBRUARY 17, 1993 PAGE 4 MOTION: To approve the Change of Manager subject to Police background check. Pasquale /Robinson VOTED: 5 -0 8. Public Hearing /New England Telephone This was a continuation of the hearing for Petition No. 92 -12 concerning a pole relocation on Maple Street which was tabled at the February 3rd meeting. John Larch, Director of the Electric Department, and Paul Ciampi representing New England Telephone, were both present; also Mr.Ryding who had attended the first hearing and raised some issues which Selectman Robinson, as Chairman of the Light Commissioners, was going to look into. Selectman Robinson reported he had investigated the situation and inter- section. There is a pole in the middle of Bird Road, but to put the lines underground would not allow lights for the intersection. An island was suggested; the DPW Director is not in favor of that. The Police Chief has advised that the pole must be moved from its present location. Selectman Robinson said there is no acceptable alternative other than setting a tree in front of the pole residents object to. John Larch offered an explanation of the overall situation, then recommended approval of the petition as it is. Mr. Ryding, 796 Maple Street, offered his views concerning underground being better for safety and it would be more aesthetically pleasing. John Larch said he agrees with Mr. Ryding and, if he had his way, everything would be put underground, but putting a single section underground would not accomplish much, and an island for the pole would increase cost considerably. Selectman Robinson added, there are alot of things that have to be considered in power usages, etc. MOTION: To set the pole within an island at the intersection of Bird Road. Colella /no 2nd MOTION: To approve Petition No. 92 -12 as submitted. Pasquale /Penney VOTED: 4 -1 Colella opposed Selectman Pasquale explained he feels that is the right thing to do. The four examples of islands sited (in town presently) can vary on conditions, width of road, etc. MOTION: To approve Petition No. 92 -13. Penney /Robinson VOTED: 5 -0 9. Waste Disposal /Collector & Recycling Program Service The Town Manager opened discussion by advising that the Town's present contract expires July 31, 1993. He had provided each Selectman with a Memorandum covering four options, with costs, to choose from. Bill stated at the workshop he had gotten the consensus that bi- weekly recycling was BOARD OF SELECTMEN f MINUTES OF MEETING FEBRUARY 17, 1993 PAGE 5 the most appealing. He said it will give reliability, serviceability and dependability. Rory Fall(n, the General Manager of Waste Systems was present and explained their equipment and procedure. In answer to a ques- tion by Selectman Penney, he said there will be something in the contract that will have a 'hold harmless' clause or Mansfield will be indemnified. The contract will be for three years, with an option for either side for the fourth and fifth year. Waste Systems will hold adequate sessions for residents to learn about recycling, in schools and otherwise. Ed McQuaid, Chairman of the Finance Committee was present, and said he feels what the Town Manager has accomplished has provided the Town with an array of costs on which he spent considerable time. Ed feels it is a good deal. Both Chairman Tartufo and Selectman Penney asked that the contract be made flexible enough to consider changes in regulations, etc. Chairman Tartufo stated his preference is Alternative #3. * MOTION: For the FY -94 budget the Town Manager use Alternate #3 (biweekly curbside recycling and recycling park open part- time). Pasquale /Penney VOTED: 4 -1 Robinson opposed Selectman Robinson explained he feels the recycling park will not be used much at all because residents will take the easy road. Chairman Tartufo said the park was an example for other towns and the percentage of participation was a pleasant surprise. Selectman Pasquale agreed and commended Selectman Robinson for his many hours work for and in the park. 10. Old Business - Town Man a) Bill thanked Ken Edwards, of Motorola /Codex, for his presentation at the February 11th Selectmen workshop. b) The Plymouth Street /Recreation Project plans have been submitted to the Planning Board, along with the Conservation Commission Order of Condi- tions. The IDC expects to meet with Cabot Partners for their part of this project. c) There will be a meeting with Representative Hyland, Senator Keating, the School Committee and Finance Committee at next Wednesday's Board meeting to discuss the Educational Reform Bill. d) Also, there is a Public Hearing at next Wednesday's Board meeting con- cerning the Cable TV license renewal. e) Each Selectman had received a copy of the Police Chief's Memorandum concerning "Right Turn on Red" intersections. He reported there are four such intersections in tom. There are no State requirements for such restrictions; it is strictly a local determination. He stated they have no data compiled as to number of accidents are caused by the "right turn on red "; it would take a minimum of three months to conduct BOARD OF SELECTMEN MINUTES OF MEETING ( FEBRUARY 17, 1993 PAGE 6 such a study; or the "right turn on red" could be removed from all the intersections and the police will monitor accidents at the intersections for three months. 11. Old Business - Selectmen a) Selectman Colella brought up the Retirement Bill and made the following motion: * MOTION: To put an article in a Special Town Meeting within the Annual Town Meeting for adoption of the Early Retirement bill for Town employees. Colella /Penney Selectman Pasquale pointed out it would include two other pro- visions. VOTED: 5 -0 Selectman Pasquale stated the motion does not say the Board is endorsing it. The Board must know the cost 'due to the retire- ment pension fund. b) Selectman Colella reported there are townspeople concerned about Town snow plows being out during the last two storms when they were only pushing water and slush. The Town Manager referred to rules and regu- lations covering use of the plows. Selectman Colella asked for the cost for equipment and overtime for the last two storms. c) Following a Memorandum from the Zoning Enforcement Officer, Bert Cook, concerning the Vendor license, it will be rescinded. Chairman Tartufo commented on another one he believed should be checked. d) Selectmen were advised that the Chairman of the Board of Health has indicated his Board is going to consider no smoking within municipal buildings, or a smoking room. 12. New Busines a) Selectmen had received a copy of a Memorandum to the Town Manager from his secretary regarding Printing of Annual Town Report and Annual Town Meeting Warrant. Facts presented showed a saving on both books, but a savings of $2,000 over last year's Annual Report, by producing it in -house on the newly acquired printer. b) The Town Manager asked the Board to approve an amendment to the Council On Aging budget to increase its appropriation by $14,603. This would enable the Council to increase the hours of the Outreach worker to full time, and to also provide a Social Service Coordinator, both of which are needed very much. It was pointed out that because of successful waste collection negotiations, this increase would not increase the bottom line of the budget. The Town Manager asked for a consensus of BOARD OF SELECTMEN MINUTES OF MEETING FEBRUARY 17, 1993 PAGE 7 the Board. Ed McQuaid, Chairman of the Finance Committee, who was still present, said the Finance Committee thought it was a worthwhile move. c) The Town Manager asked Board members to familiarize themselves with the information contained in a copy of a Memorandum to the Town Manager from Town Engineer, Bob Swanson, concerning funding the proposed potas- sium hydroxide system (KOH). Bob suggests a 1.5% increase for this year making the cost $18.08 c.f. water charge; this is the second step in a proposed three step program. He and Bob would like a decision in the very near future. d) A Memorandum from the Fire Chief to the Town Manager requests a desig- nated Tow Zone in front of the two overhead doors at the West Mansfield Fire Station, as vehicles are parking in front of the doors. He had discussed the issue with Lt. Figueredo and Traffic Control Officer,, Lance Lawson who recommend a sign placed on each door stating "NO PARK- ING /FIRE EXIT /TOW ZONE ". This would enable the police to ticket any vehicle so parked, as well as tow any vehicle. * MOTION: To approve posting the suggested area as a Tow Zone. Pasquale /Penney Selectman Penney asked that Donald Zecher, owner of The Country Store, be advised of this action. VOTED: 5 -0 e) Selectman Penney returned to the discussion of "Right Turn on Red ", asking for removal of the signs at Chauncy & North Main Street, and Chauncy & Copeland Drive only. * MOTION: To adopt the Police Chief's Option 2.
