Town Counsel reported he had met Monday (Sept. 14, 1992) with Bill Morton,
Selectman Colella and Building Inspector /Zoning Enforcement Officer,
Cook. Town Counsel said he had an,wthethepFishi& Game ituation;tsolunder State
Bert Cook. Mr. Morton is unhappy
law Zoning Board of Appeals decisions have to be answered in court, and Mr.
Morton has missed that opportunity. He has no case against the Building In-
spector /Zoning Enforcement officer. If Fish & Game considers use of the land,
it either reverts to the Town or the Board can exert some leverage through the
deed, Mr. Morton was told. In summary, there is no misconduct by Bert Cook on
zoning issues presented to and approved by the Zoning Board of Appeals. If the
Board wants to do something for Mr. Morton, ask Tom Counsel to exert leverage
under Mortonthasdregisteredcoppositionmorerthann once , butu has bnot gone to court. Mr.
Investigation re Police Department as requested by Selectman Colella
Tom Counsel advised the focus of inquiry must be narrow regarding criminal
misconduct; the reputation of character of an employee has a series of rights.
A first meeting would be to investigate charges made by the employee; a second
meeting should bring in the employee. The matter can be referred to the District
Attorney. Selectman Colella said the Police Dept. secretary has said she wants
to talk to all five Selectmen. There was discussion as to whether Town Counsel
should be present; it might be wise for reasons of liability. As to the allega-
tions, decide to investigate and find coroboration.
Selectman Pasquale raised the question, is it good policy to overstep the Town
Manager and go directly to the Selectmen (chain of command), and asked is there
a power struggle going on. Town Counsel said under the Town Charter the Town
Manager has charge of personnel; she can talk to the Tov+n Manager and still go
to the Board. Selectman Colella mentioned the oil change being charged improp-
erly to the Town.
Chairman Tartufo summarized: Have the Tom Manager contact the secretary and
if she feels comfortable, discuss the issue %.iith him, then he report back to the
Board; the Board can have her meet with them. Extreme ramifications can come
from this.
* MOTION: To direct the Town Manager to interview Sandra Jackson in the matter
of allegations of criminal conduct by an employee and then report back
to the Board, and instruct her of the process.
