Tarball, Mr. & Mrs. Fulop, and Mr. & Mrs. McPherson, all residents on Elm Street, against Mr. Phil Sorkin, owner of the Red Dog Inn, 590 Elm Street. The complaint was excessive noise /barking eminating from operation of the Red Dog Inn due to its close proximity to the neighboring residences. It was also claimed that Mr. Sorkin had three dogs of his own which bark alot. The Dog Officer's re- port was also read, in which he states that the By -law covering location of kennels was enacted after establishment of the Red Dog Inn and he feels, there- fore, he cannot rule against the kennel; the owner maintains it properly. He went on to say he had spoken to Mr. Sorkin about behavior of his personal BOARD OF SELECTMEN MINUTES OF MEETING ( SEPTEMBER 24, 1986 PAGE 4 dogs and was told he would take care of that. Mr. Sorkin's answer indicated Mr. Fulop had only lived there a year and had never complained until he wanted to sell his house. He said he bought his property in 1977 and there was a hearing for all abutters. Selectman Mahana asked about sound - proofing; Mr. Sorkin said most sound - proofing is not water proof. Mr. Tarball attended the hearing in 1977 and did not oppose it then. Mr. Sorkin said he would be willing to put up fencing and bushes. Chairman McNair advised him to try to work with his neighbors; otherwise it is more a legal case. The By -law says adjacent homes cannot be adversely affected by a neighbor's home; it should be brought into conformance, particularly Mr. Sorkin's own dogs. The Chairman asked the Town Manager to have the Health Agent use the noise level instrument. The Dog Officer said he will be contacting the MSPCA for suggestions. The Library Director, Dinah Amsden, aid funding is not possible until the question of the land is out of court proceedings; the Town Treasurer is working on that aspect; now it is simply a matter of time. The architect said a realistic figure for the building project is 2.1 million dollars approximately. The Bulger Bill, presently before the legislature, would give 75% funding. Gale Farrugia, Director of COA, said $10,000 funding, through Elderly Affairs, is available year to year. Selectman D'Onofrio suggested the possibility of funds /aid through the Executive Office of Communities and Development. The Library Trustees also have a Building Fund. The proposed facility is'ex- pected to handle a population of 20,000, and there is block space available for expansion. The COA also has a Building Fund. Selectman D'Onofrio asked for a possible alternative in the event present k hopes and plans fell through. He was told probably the present Library.
