6. Special Town Meeting Articles
The Town Manager had prepared a resume of the Articles submitted for the
Special Town Meeting and reviewed them briefly at this time. Selectman
D'Onofrio said he assumed that the Town Moderator will be notified and a meet-
ing with 'him scheduled. The Chairman also mentioned a meeting with the Fi-
nance Committee. Selectman D'Onofrio then asked to have the Town Engineer
and Zoning Officer detail information on the zoning articles, as well as Town
Counsel's input on those articles.
The Chairman of the Conservation Commission, Stu Sweet, was present and asked
about the two Commission articles. It was determined that one went in under

'Unpaid Bills', and the other, for a full -time Agent, was overlooked, but
the Board agreed that it could be included under Article 1 (of the listing).
MOTION: To close the Special Town Meeting Warrant and insert the Articles.

Conservation Commission /Stu Sweet
Stu Sweet presented the Commission's proposal to apply for Sweet's Pond
eligibility under the Clean Lakes Program. He said they had considered
Sweets Pond, Blakes Pond and Robinsons Pond, but due to requirements that
must be met, they have centered on Sweets Pond. He said 3/4 of the land
is owned by the Conservation Commission, it contains fresh slater, is pub-
licly owned and has public access, and is not a primary water supply. The
eligibility is determined by diagnosis of existing problems, investigation
of the restoration process, and all applications are placed on a priority
basis. The entire program runs for about three years; the application must
be submitted by October 1, 1986 and DEQE prioritizes all received by Janu-
ary 1, 1987; a local commitment is required by May 15, 1987 and met by
May 30, 1987. 70% is reimbursable by the State for the first phase, 75%
for implementation phase. Stu said he needed two authorizations to be
signed. The Town Manager will review the booklet on the program and report
back to the Board next week.
8. Planning Board Chairman and Planning Director
Marydee Flynn and Rich Callinan were before the Board to discuss two zon-
ing articles submitted by the Planning Board. The Town Manager had, prior
to tonight's meetings of both Boards, discussed the two articles with Rich.
The Town Manager felt one of the articles was worded in a manner difficult
to understand, and had combined the two articles. This change was the first
item on the Planning Board's agenda and the Chairman and Director came be-
fore the Selectmen to advise that the Planning Board had voted to keep the
two articles. Since the Warrant had already been closed by the Selectmen,
they requested 11,tl:bel: re- opened. Selectman D'Onofrio said he was hesitant
to reopen the Warrant after what happened before the Annual Town Meeting.
He said he feels what is in the Article as accepted tonight can be amended
on the floor of the Special Town Meeting.
MOTION: To reconsider the motion of the Board to close the Warrant.
Dunn /no second
Selectman D'Onofrio asked for a five minute recess to consult Town Counsel,
which was granted.

MOTION: To reconsider our Motion to insert Articles and close the Warrant,
and to reopen the Warrant.
Dunn /D'Onofrio
Selectman D'Onofrio asked Marydee what the thrust of the proposed
articles is. The answer - to try to rezone the downtown district,
to change multi - family units and density requirements by requiring
a Special Permit, not to prohibit, but to control, development.
Rich said it does not conflict with the fundamentals of the Master
Plan. Selectman D'Onofrio asked, is this appropriate now when
there is a Master Plan being developed. Selectmen Dunn and D'Ono-
frio said they felt that the Special Permit would give the Planning
Board arbitrary rights for proposals, without set regulations.
Marydee pointed out that the Special Permit allows for the Hearing
process.
Paul Folkman and John Day were present; Paul Folkman addressed his
concern that his 28 Court Street proposal, which he has been before
both Boards with, is now catching him in the middle if this zoning
goes through. John Day has a similar situation, he said, for an
apartment house on East Street. D'Onofrio said is there any way to
treat those caught in the middle? Marydee said not that she knows
of. Selectman Dunn said after this discussion, he will not support
reconsideration.
Motion OPPOSED: 0 -3
9. New Business
a) The Town Manager had given each Selectman a Memorandum covering a recom-
mended Computerized Parking Ticket Program, with the Plymouth County Com-
missioners. He reviewed pertinent facts and asked for three required
authorizations, as indicated below. Selectman D'Onofrio commented that
the Board should vigorously pursue appropriate parking space for Mans-
field residents.
MOTION: To authorize the Town Manager to enter into a contract with
the Plymouth County Commissioners for parking ticket collections,
as long as the contract is open- ended.
Dunn /D'Onofrio VOTED: 3 -0

b) The Town Manager proposed 2 -Hour Parking on both sides of Old Colony
Way between Rumford Ave. and Church Street, advising that this street
is evidently being used by commuters now.
* MOTION: To approve 2 -Hour Parking on Old Colony Way, as suggested.
D'Onofrio /Dunn VOTED: 3 -0
c) Selectman D'Onofrio reported he had received a call from Leon Dean of
49 Pine Street concerning his water bill. Mr. Dean lives solely on his
Social Security and his bill indicates a charge for 1,000 cubic feet,
which is the minimum charge per quarter. Mr. D'Onofrio had talked to
the DPW Office Manager and was advised that between 1980 and 1986 Mr.
Dean had been charged for 21,000 cubic feet when, in fact, he only used
6,700. Selectman D'Onofrio said he feels this is a tragedy and that the
Board should modify its policy, as Water Commissioners.
* MOTION: That in billing those Water Department customers who are over
62 years of age, and whose actual water use is less than the
minimum quantity of 1,000 cubic feet, a bill be sent only after
the consumption has reached the minimum of 1,000 cubic feet in
a given quarter.
D'Onofrio /Dunn VOTED: 3 -0
Selectman Dunn then said he thinks the Light Commissioners should con-
sider something similar.
The Board also asked for consideration of Mr. Dean's bill retroactively;
the Town Manager will ask for a recommendation from the DPW Office Man-
ager.
10. Adjournment
