D'Onofrio /Harrington VOTED: 4 -0 BOARD OF SELECTMEN MINUTES OF MEETING APRIL 30, 1986 PAGE 2 d) Selectman D'Onofrio advised the Board that he, Chairman McNair, the Town Manager and Chief of Police had held a meeting to review the list of entertainers submitted by Great Woods, Inc., after which he made the following motion: * MOTION: That the Board issue the Seven -day Entertainment License pre- viously approved by the Board, to Great Woods, Inc. D'Onofrio /Harrington VOTED: 4 -0 Nelia Phillips /Terry Welsh Mrs. Phillips came before the Board to complain about removal of surplus material from 350 Oakland Street the week of April 9th. She reported that the Planning Board had issued instructions for the route Turtlebrook Truck- ing was to use, as well as the hours, neither of which were being followed. She said the trucks were to travel Oakland to Franklin to Rt. 106 between the hours of 9 -2; this would allow school children safe travel to and from school. Neither the route nor the hours were being followed; they were going down Hope Street and starting at 7:00 A.M. Terry Welsh said he had called the owner of Turtlebrook Trucking, Mr. Staples, to discuss the matter; Mr. Staples had told him he pays taxes in town like everybody else and he would do whatever he pleases. Terry then asked who controls the Building Inspector and does he have the power to control this sort of thing? The Chairman advised him that he, the Tosco Manager and the Police Chief had learned of the problem, had gone to the sight and told the workers what they were to do. He went on to say that the entire opera- tion is over now, that the Building Inspector had moved the starting hour up to 7:00 A.M. feeling there was no school that week so it would be advantageous to let them get started earlier and get the job done while there was no school. Selectman Harrington suggested that the Planning Board be advised of the behavior of Turtlebrook Trucking on that job so that the next time the firm requests a permit they will have it in mind. Selectman Mahana said the next time a similar situation occurs, the residents could call the Registry of Motor Vehicles. Mrs. Phillips and Terry Welsh were advised that the Plan- ning Board does not control, it recommends to the Building Inspector. Sel- ectman D'Onofrio wondered if the Turtlebrook truckers even knew of the reg- ulations; perhaps it was Condyne's failure to inform and be sure the con- tractor followed regulations. Mr. Certuse, 151 Oakland Street said the trucks traveled at an outlandish speed; he felt there should be a special police on duty. Before leaving Nelia Phillips commented on what she felt was inadequate checking of registered voters, where people sat, etc. at Town Meeting. Old Business - Town Manager a) The Tom Manager said he wanted to familiarize the Board on developments to up -grade the Town computer system. He said funding was approved by the Town Meeting and he would like to have the new system up and running by the beginning of the fiscal year. He then briefly reviewed the pre- sent existence of three different computer systems in the Town Hall; one is overloaded now. They are considering conversion of the NCR system with network off for some PCs, word processors, etc. John Davern, the com- puter consultant who has worked closely with the town officials on the upgrading (voluntarily) added some facts. He said the water /sewer system has not yet been resolved as to which system it will be put on. He recom- mends that all Town departments have a PC. There was some discussion about triple billing (water, sewer, electric); the Town Manager wants to BOARD OF SELECTMEN MINUTES OF MEETING APRIL 30, 1986 PAGE 5 work up pros and cons, then present them to the Board. MOTION: To authorize the Town Manager to proceed as soon as possible. D /Onofrio /Harrington VOTED: 4 -0 Selectman D'Onofrio said he wanted to publicly recognize the invaluable assistance John Davern has given to the Town on a volunteer basis; he knows that the Treasurer and Accountant have both appreciated his assis- tance also. b) Each Board member had been given a copy entitled "Community Plan ", which was the data asked for last week concerning the Master Plan /Growth Devel- opment Council. The Town Manager reviewed each Phase, as listed, saying at present he feels there is time to get through the Planning Phase up to the Implementation Phase. The funding level is not as crucial as it appeared last week. He recommended meeting with the Planning Board next week to get things moving. He said the project is significant enough to the community to have a wide spectrum of interest from the community. 8. Old Business - Selectmen a) Selectman Harrington raised a question as to the time the Police Chief will have to spend covering the Great Woods Performing Arts Center per- formances during the season, and suggested hiring, or designating, a Safety Officer to oversee those activities. He had concern for other aspects of the Chief's duties being neglected. He felt the 10% adminis- tration fee being charged Great Woods, Inc. would cover the cost of the Safety Officer, or perhaps charging a tax on the ticket itself, such as Sullivan Stadium does. Chairman McNair advised him that the Police Chief's responsibilities were written into the contract with Great Woods, Inc. The Town Manager said he feels the Chief needs to be there and oversee everything, at least this first year. Selectman D'Onofrio referred back to the meeting in the afternoon where the discussion centered on the proposed entertainers at Great Woods for this summer and the feeling of the Police Chief as to level of security and safety required - his recommendations to the Board. He said there will be internal security supplied by Great Woods, Inc. as well as by the Mansfield police. He feels it is a negative approach to start off a new business with a tax on tickets. The Chairman said.he thinks the contract would have to be opened and rewritten if a tax were to be added. Select- man Harrington said he would like legal opinion on the matter. Select- man Mahana thought it would worthwhile to find out what Foxboro and War- wick Music Circus do about a tax - tax per gross sale, or per ticket. Selectman D'Onofrio presented a "philosophical argument "; let something that is doing well alone, and we will get more revenue. b) Selectman Harrington commented that both Selectman Dunn and D'Onofrio BOARD OF SELECTMEN MINUTES OF MEETING APRIL 30, 1986 PAGE 6 have worked for water protection, yet the Board's article was defeated at Monday night's Town Meeting. The Planning Board's article will come up next Monday and he would like the Board to support their article or some form of it; he asked, "What is the position of the Board ?" Select- man Mahana said he supports the Board's article (Article 24) and suggested substituting the language of Article 24 into the Planning Board's article (Article 44). Selectman D'Onofrio said he views Article 44 as anti- growth, not water protection and it shows economic disinterest. Select- man Dunn said he feels there is need to protect acquifer areas, which means sewering. He went on to say that although he had told Karen Galanti he would support her article if the Selectmen's was defeated, he must now retract that, due to recharge issues. He feels there should be an amendment made to Article 44. The consensus of the Board was for John Dunn to draft an amendment for presentation at Monday night's Town Meeting. Selectman Harrington suggested letting the Planning Board know of it prior to Monday night. c) The Chairman reminded the Board members they each have received the Town Manager's Performance Evaluation form, and it is to be completed by May 30th. 9. New Business a) The Town Manager said he has been approached by both Motorola and IBM regarding an antenna tower, and mentioned the water tower in the indus- trial park as a possibility. Bob Paza, of Cable Vision, advised that they should be in touch with Cable Vision first as that is where they have their antenna. MOTION: To give the Town Manager authority to enter into negotiations with Motorola and IBM. D'Onofrio /Mahana VOTED: 5 -0 b) Selectman Dunn brought up having someone come in to c) Selectman Mahana asked to Elm Street,at the bridge, that the responsibility o into it. the employee retirement plan and suggested explain how it works to Town employees. have something done with a large pot hole on the result of a water connection. He asked is f the developer. The Town Manager will check d) Selectman Mahana then mentioned Town -owned land in the area of Rt. 495 and Rt. 140; he wondered how much. His thought was for a parking lot for commuters to be served by a shuttle bus, possibly GATRA Park & Ride funds? e) Selectman Mahana said he wanted to congratulate Francis Leroux:on his recent election as Selectman in Norton. BOARD OF SELECTMEN MINUTES OF MEETING APRIL 30, 1986 PAGE 7 f) Chairman McNair asked the Town Manager to have the curb at Coach Road and Lantern Lane repaired; it was torn up by a snow plow this past winter. g) Chairman McNair said he has received complaints about1 ack of parking space for business owners downtown; they have been ticketed and have asked for "Loading Zone" for some areas. It was made clear that such a designation would not permit all day parking, which seemed to be the main intent. h) Chairman McNair had been advised that a paraplegic is moving into Cedar Court; his only mode of getting around is with an electric cart and he, therefore, needs a ramp up to the sidewalk at East Street and Park Street; the Town Manager will look into it. 10.
